RESOLUTION NO. 2019-0072 (Co-Sponsors: Committee on Police, Fire and Public Safety and Committee on Laws, Rules and Policy Formulation) "A RESOLUTION REMANDING TO THE BARANGAY COUNCIL OF SAN JOSE, THIS CITY, ITS BARANGAY ORDINANCE NO. 04, S. 2018, WITHOUT ACTION, WITH AN ADVICE THAT APPROPRIATE CORRECTIONS AND/OR MODIFICATIONS BE MADE ON THE STIPULATED PENALTY TO CONFORM WITH THE AUTHORITY AND/OR POWER OF BARANGAY GOVERNMENT UNITS PRESCRIBED UNDER THE LOCAL GOVERNMENT CODE" WHEREAS, the Barangay Council of San Jose enacted Barangay Ordinance No. 04, s. 2018, entitled: "An Ordinance Prohibiting the Sale/Drinks of Alcoholic Beverages to Minors Below 18 Years Old Within the Territorial Jurisdiction of Barangay San Jose, Pagadian City" and submitted the same to this august body for review and confirmation as mandated by R.A. 7160" WHEREAS, the Committee on Police, Fire, and Public Safety and Committee on Laws, Rules and Policy Formulation to which the foregoing concern was jointly referred for initial consideration, recommended in its Joint Committee Report No. 021 that the same be remanded to the concerned barangay council, without action, for the reason that the stipulated penalty has exceeded the prescribed penalty authorized under the Local Government Code; NOW, THEREFORE, on seconded motion of Honorable Vincenzo E. Cagampang, be it RESOLVED to remand, as this body hereby remands to the Barangay Council of San Jose, this City, its Barangay Ordinance No. 04, s. 2018, without action, with an advice that appropriate corrections and/or modifications be made on the stipulated penalty to conform with the authority and/or power of Barangay Government Units prescribed under the Local Government Code. RESOLVED FURTHER, to let copies of this Resolution be transmitted to the Barangay Council of San Jose through Punong Barangay Glenn Stephen R.
