RESOLUTION NO. 2019-0046 (Sponsor: Committee on Infrastructure, Public Bidding and Community Development) "A RESOLUTION EARNESTLY REQUESTING HIS HONOR, GOVERNOR VICTOR J. YU, PROVINCE OF ZAMBOANGA DEL SUR, TO DIRECT THE PROVINCIAL ENVIRONMENT AND NATURAL RESOURCES OFFICER (PENRO) TO FURNISH AND PROVIDE THE OFFICE OF THE CITY MAYOR WITH A COPY OF ALL PERTINENT DOCUMENTS SUBMITTED BY THE HOLDERS OF PERMIT TO OPERATE QUARRY WITHIN THE JURISDICTION OF THE CITY OF PAGADIAN AND, TO INCLUDE THE PENRO'S FINDINGS ON THE HOLDERS/PERMITTEES COMPLIANCE TO THE TERMS AND CONDITIONS STIPULATED UNDER THE ENVIRONMENTAL COMPLIANCE CERTIFICATE (ECC) AS WELL AS THEIR PERIODIC MONITORING, FINDINGS AND RECOMMENDATION RELATIVE TO THE QUARRY OPERATION, IF THERE ARE ANY" WHEREAS, in spite the declaration of the Provincial Government of Zamboanga del Sur suspending all permits to operate quarry within the province of Zamboanga del Sur to include the City of Pagadian, incidents of quarry operation are still persisting in some areas of the city where no less than the Chief of Police of Pagadian City has reported the apprehension and detention of heavy equipment used in quarry operation; WHEREAS, this Sanggunian, however, expressed more concern and alarm over the report that the identity of the owner/holder of the permit cannot be ascertained and located as the name registered in the permit is allegedly a sham or dummy, such that it is the desire of this august body to reveal and validate the real identity of those holders of permit so as to hold them responsible for whatever liability they may incur; WHEREAS, upon the recommendation of the concerned Committee to which this matter was referred to, this body finds the need to solicit the intercession of the Honorable Governor of the Province of Zamboanga del Sur in requiring the PENRO to provide all pertinent documents submitted by the permittees in support of their application for permit to quarry; NOW, THEREFORE, on seconded motion of Honorable Arnold R. Gavenia, be it RESOLVED to earnestly request, as it is hereby earnestly requested His Honor, Governor Victor J. Yu, Province of Zamboanga del Sur, to direct the Provincial Environment and Natural Resources Officer (PENRO) to furnish and provide the Office of the City Mayor with a copy of all pertinent documents submitted by the holders of permit to operate quarry within the jurisdiction of the City of Pagadian and, to include the PENRO's findings on the holders/permittees compliance to the terms and conditions stipulated under the Environmental Compliance Certificate (ECC) as well as their periodic monitoring, findings and recommendation relative to the quarry operation, if there are any. RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, Governor Victor J. Yu, Province of Zamboanga del Sur, Capitol Complex, Santo Nino District this City, for his preferential consideration; to the Provincial Environment and Natural Resources Officer, for information, guidance and/or appropriate action; and to His Honor, City Mayor Samuel S.
