RESOLUTION NO. 2019-0045 (Sponsor: Committee on Infrastructure, Public Bidding and Community Development) "A RESOLUTION REQUESTING THE HONORABLE CITY MAYOR TO DIRECT THE CITY LEGAL OFFICER TO COLLABORATE WITH THE PAGADIAN CITY POLICE OFFICE IN THE CONDUCT OF AN IN-DEPTH INVESTIGATION OVER THE REPORTED QUARRY OPERATION AT BARANGAY LOWER SIBATANG AND NEIGHBORING BARANGAYS AND, UNDERTAKE APPROPRIATE LEGAL ACTION AGAINST ANY AND ALL OWNERS AND/OR OPERATORS OF THE QUARRY THEREAT WHO SHALL BE FOUND TO HAVE VIOLATED EXISTING NATIONAL AND LOCAL LAWS, RULES AND REGULATIONS GOVERNING THE OPERATION OF QUARRY" WHEREAS, concerns and apprehensions over the continued operation of quarry at Barangay Lower Sibatang and neighboring barangays have been brought to the attention of the City Council by the residents thereat, particularly on the possible effect to the environment as well as the damage it caused to the road due to the frequent passing of heavy equipment used to carry sand and gravel out of the area where quarry operation is undertaking; WHEREAS, without having any assumption and speculation, the body through the Committee on Infrastructure, Public Bidding and Community Development, to which the foregoing concern was referred for initial evaluation and consideration, deemed it necessary to enjoin the City Legal Officer and the Pagadian City Police Office to conduct an investigation on the quarry operation in the City of Pagadian with particular reference to their compliance with all existing national and local laws, rules and regulations governing the same and, if warranted, undertake proper legal action against those erring quarry owners/operators; NOW, THEREFORE, on seconded motion of Honorable Arnold R. Gavenia, be it RESOLVED to request, as this body hereby requests the Honorable City Mayor to direct the City Legal Officer to collaborate with the Pagadian City Police Office in the conduct of an in-depth investigation over the reported quarry operation at Barangay Lower Sibatang and neighboring barangays and, undertake appropriate legal action against any and all owners and/or operators of the quarry thereat who shall be found to have violated existing national and local laws, rules and regulations governing the operation of quarry. RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his immediate favorable action; and to the City Legal Officer, this City, for information, guidance and/or appropriate action. APPROVED UNANIMOUSLY.
