RESOLUTION NO. 2019-0043 (Co-Sponsors: Committee on Ways and Means; Committee on Laws, Rules and Policy Formulation; and Committee on Commerce, Trade and Industry) "A RESOLUTION REQUESTING THE HONORABLE CITY MAYOR TO DIRECT THE CITY LEGAL OFFICER, THIS CITY, TO CONDUCT A STUDY AND REVIEW ON THE PROVISIONS OF CITY ORDINANCE NO. 2009-288, ENTITLED: "AN ORDINANCE ESTABLISHING THE GUIDELINES AND POLICIES GOVERNING THE OPERATION AND MANAGEMENT OF THE CITY COMMERCIAL CENTER OF THE CITY GOVERNMENT OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF," AND COME UP WITH RECOMMENDATION FOR THE BODY'S CONSIDERATION WITH REFERENCE TO THE FOLLOWING PROVISIONS AS STIPULATED HEREUNDER" WHEREAS, the City Commercial Center (C3), a commercial establishment owned and operated by the City Government of Pagadian, was established to help accelerate the socio-economic growth and development of city, and its management and operation is governed by City Ordinance No. 2009-288, entitled: "An Ordinance Establishing the Guidelines and Policies Governing the Operation and Management of the City Commercial Center of the City Government of Pagadian and Imposing Penalties for violation thereof; WHEREAS, after several years of operation, it was observed that certain provision in the Ordinance requires revision and/or amendment to complement the present demand or requirement for an effective and efficient operation of the said facility; WHEREAS, finding urgency and importance of the foregoing concern, this body through the concerned Committees, to which the matter was initially referred, deems it most logical and reasonable to commission the City Legal Officer to conduct a study and review on the provisions of the said Ordinance and, if necessary, come up with recommendation for the Sangguniang Panlungsod's appropriate consideration, hence this request; NOW, THEREFORE, on seconded motion of Honorable Troy B. Asugas, be it RESOLVED to request, as this body hereby requests the Honorable City Mayor to direct the City Legal Officer, this City, to conduct a study and review on the provisions of City Ordinance No. 2009-288, entitled: "An Ordinance Establishing The Guidelines and Policies Governing the Operation and Management of the City Commercial Center of the City Government of Pagadian and Imposing Penalties for violation thereof," and come up with recommendation for the body's consideration with reference to the following provisions, to wit: Paragraph (o) of Section 1 of Article VIII thereof, more specifically the matter on the payment of the Twelve Percent (12%) inclusive Value Added Tax (VAT) in relation to the provision stipulated under the Contract of Sale entered into by and between the City Government of Pagadian with the stall owners/holders at the City Commercial Center; and The provision concerning the manner of awarding stalls in the City Commercial Center from "through public bidding" to be amended/changed to a mere "letter of intent or negotiated contract." RESOLVED FURTHER, to let copies of this Resolution be forwarded to His Honor, City Mayor Samuel S. Co, for his preferential consideration; and the City Legal Officer, for information, guidance and/or appropriate action. APPROVED UNANIMOUSLY.
