"AN ORDINANCE INSTITUTIONALIZING THE "DUGONG BAYANI" BLOOD DONATION PROGRAM OF THE CITY OF PAGADIAN AND PRESCRIBING POLICIES ON THE CONDUCT OF BLOOD DONATION ACTIVITIES IN THE CITY"

      WHEREAS, Republic Act 7719 or the National Blood Service Act of 1994 mandates for the provision of adequate, safe, affordable and equitable distribution of blood and blood products through active promotion and conduct of voluntary blood donation by the citizenry and to instill public consciousness on  the principle that blood donation is a humanitarian act;
              
      WHEREAS,  the City Government of Pagadian is committed to protect the life, health and safety of its constituents; 
              
      WHEREAS, blood is an essential and vital body fluid, considered as the lifeline of the human body and performs many important functions such as delivery of oxygen to body cells and tissues, supply of nutrients, removal of body wastes, regulation of body temperature immunologic, and other circulatory functions;

      WHEREAS, during disasters, accidents and illnesses, blood may be lost from the body or may not be produced adequately by the body, and may endanger the life of an individual if it is not replaced with correct and safe blood components; 

      WHEREAS, there is a need to institutionalize a systematic blood donation program that will ensure a steady and enough supply of blood in the blood banks that can be readily accessed or availed by a patient or by the constituents whenever it is needed; 
              
      WHEREAS, the DUGONG BAYANI BLOOD DONATION PROGRAM of the City of Pagadian aims to ensure enough and sustainable supply of blood and blood products available to the constituents of Pagadian City by actively promoting and campaigning voluntary blood donation and conducting blood donor recruitment and blood donation activities in the community. 
              
      NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod (15TH City Council) of Pagadian, Zamboanga del Sur that:

      SECTION 1.-TITLE - This Ordinance shall be called the "Blood Program Ordinance" of the City of Pagadian. 
      SECTION 2.-SCOPE AND COVERAGE - The policies prescribed in this ordinance shall apply to all sectors of the community, whether public or private entities, including but not limited to academic, medical, business, government and non-government institutions or organizations located or operating within the City of Pagadian, entities, institutions and organizations operating outside of the City but who will conduct blood donation activities within the area of Pagadian City.
      SECTION 3. DEFINITION OF TERMS. As defined in this Ordinance, the following terms shall mean:
a. Blood - refers only to whole blood, packed red blood cells and fresh frozen plasma. It does not include other blood components like platelet concentrate.

b. Blood Bank - an institution which has the capability to recruit and screen blood donors, collect, process, store, transport the issue of blood for transfusion and provided information and/or education on blood transmissible diseases.

c. Blood Council - refers to a non-profit, multi-sectoral group whose members come from government and private sectors in the local community committed to support the blood program. Its objective is to plan and implement blood donation programs in accordance with the Department of Health (DOH) policies and guidelines.

d. Blood Donor - refers to any qualified, healthy individual fit to donate blood on his own volition or initiative and expecting no monetary compensations.

e. Blood Donation/Bloodletting - is the act of giving blood to a person who needs it through a transfusion.
f. Blood Screening - is a process that analyzes a blood sample to detect markers of disease or infection. 

g. Barangay Health Station (BHS) - is a government run facility that provides basic health care services to a local community.

h. City Health Office (CHO) - is a government office that provides health services to a city's residents.  It is responsible for planning, implementing and managing health programs and services. 
      SECTION 4. BLOOD DONATION POLICIES - It shall be the policy of the City of Pagadian to promote and safeguard the health and wellness of its constituents by ensuring adequate, safe and accessible human blood for transfusion
4.1 Blood and blood products shall be always made available. The availability of blood is the shared responsibility among all sectors of the community;

4.2 Voluntary blood donation shall be an integral part of the health and wellness programs of the city. All sectors of the community, whether public or private entities, including but not limited to academic, medical, business, government and non-government institutions or organizations located or operating within the city of Pagadian shall be required to institute a voluntary blood donation advocacy program or activity, whether in the form of blood donation promotions, donor recruitment or actual participation in blood donation or bloodletting activities; 

4.3 Only DOH accredited blood centers or blood banks such as Philippine Blood Center, Philippine Red Cross or hospitals duly accredited and licensed by DOH to conduct mass blood donation, shall be allowed to conduct blood donation activities in the city;

4.4 Standard screening procedures shall be employed to all who would be blood donors to prevent blood transmissible diseases;

4.5 Individuals with known infectious disease/s shall not be allowed to donate blood in blood donation activities of the city;

4.6 Blood donation for a fee is strictly prohibited;

4.7 Only properly screened blood products shall be issued and transfused to patients needing blood transfusion; 

4.8 The City Government of Pagadian shall aspire to provide blood or blood products to patients needing blood transfusion for free. No patient shall be denied available products based on his or her gender, religion, belief, political inclination, status in the community or financial capacity; 

4.9 Priority recipients of blood products gathered by the city are the residents of Pagadian City, blood donors or his or her relatives or chosen recipients or based on the level of urgency of blood transfusion as recommended by physician or by health officers; 


4.10 Blood products gathered or owned by the city may be issued or given to patients who are not residents of the city provided there is no immediate or anticipated request coming from patients who are residents of Pagadian City.
      SECTION 5. THE DUGONG BAYANI BLOOD DONATION PROGRAM - The Dugong Bayani Blood Donation Program of the Pagadian City Health Office shall be the official blood program of the City. The program shall encompass advocacy, campaign and promotion of voluntary blood donation, donor recruitment, regular blood donation or bloodletting activities, and storage and supply of safe and affordable, if not totally free, blood products.
      SECTION 6. CREATION OF CITY BLOOD COUNCIL - In order to ensure sustainability and efficiency of the blood program of the city that is supported by all sectors of the community, the Pagadian City Blood Council is hereby created
6.1 Composition:

      6.2 Functions:

6.2.1 	Participate in the formulation or enhancement of the city blood program that will fulfill the needs for blood transfusion in the community;

6.2.2 Plan and implement sustained information, education, and communication activities in the community to promote and campaign voluntary blood donation; 

6.2.3	Plan and implement sustained blood donor recruitment and retention program and activities; 

6.2.4	Organize community-based blood donation activities in coordination with City Health Office and authorized blood centers or authorized blood collecting agencies/facilities; 

6.2.5 	Spearhead or conduct fund-sourcing or fund-raising activities to support blood donation program of the city; 

6.2.6 	Establish and strengthen the network of referral among health facilities within the city, for the access and procurement of safe and affordable blood products; 

6.2.7 	Monitor the implementation of city blood donation program by conducting regular program implementation review, 

6.2.8 Develop program on awarding and recognition of stakeholders; 

6.3 Members of the blood council shall be designated or appointed through an executive order by the Local Chief Executive.
      SECTION 7. CREATION OF BARANGAY BLOOD COUNCIL. To ensure grassroots participation, each barangay is mandated to organize its own Barangay Blood Council.
7.1 Composition:
a. Barangay Captain
b. Barangay Councilor, Chair-Committee on Health
c. Barangay Councilor, Chair-Committee on Budget & Appropriations
d. SK Chairman
e. Barangay Nurse/Midwife in Charge
f. Barangay Health Workers

7.2 Functions:
7.2.1 	Conduct barangay-level information and education campaign on voluntary blood donation. 
7.2.3 	Maintain a master list of voluntary blood donors in the barangay.
7.2.4 	In coordination with City Health Office, may conduct regular community-based blood donation activity in the barangay. 
      SECTION 8. COMMUNITY MOBILIZATION
8.1 	To mobilize all sectors of the community, the City Government of Pagadian shall endeavor to attain the criteria set by local government unit (LGU) scorecard for voluntary blood donation program which is to have Blood Donation Rate of one percent (1%) of the total population. 
8.2 	The city of Pagadian through the City Health Office (CHO) shall conduct community-based blood donation activity at least three (3) times a year. 
8.3 	The City Government of Pagadian shall support all other community-based blood donation activities conducted by other institutions or organizations as long as the activities are properly coordinated and registered at Pagadian City Health Office as mandated in this ordinance. 
8.4 	Each barangay shall organize its own Barangay Blood Council. 
8.5 	Barangay Health Stations (BHS) or Health Centers (HC) shall be designated as the centers for voluntary blood donation advocacy and social mobilization. Public health nurses, midwives and Barangay Health Workers, after undergoing proper training, shall be designated as Blood Donor Recruitment Officers (BDRO). BHS or HC shall establish and maintain blood donor registry 
8.6 All government and private institutions, including but not limited government agencies, business establishments, schools/universities and hospitals are encouraged to establish regular voluntary blood donation campaign and blood donor recruitment activities.
      SECTION 9. REGULATION OF COMMUNITY-BASED BLOOD DONATION ACTIVITIES
9.1. Registration and Coordination Requirements. All community-based blood donation or bloodletting activities within Pagadian City must be registered with the City Health Office at least two (2) weeks before the scheduled activity. Properly coordinated with the concerned Barangay where the activity will take place.
9.2 	The following is the registration procedures:
9.2.1 	The organizer shall coordinate with the Barangay where the activity will be  held.
9.2.2 	The Barangay Nurse or Midwife and the organizer will jointly facilitate registration with the City Blood Donation Program Coordinator at the CHO.
9.2.3	The City Health Office will assist the organizer in selecting a blood collection facility (either Philippine Red Cross or Margos Regional Hospital) and proceed with scheduling the activity.
9.3 	Post-Activity Reporting. The organizers must submit a post-activity report to the City Health Office within five (5) days after the blood donation activity.
9.4 	Screening Authority. The Pagadian City Health Office has the authority to screen all community-based blood donation activities within the city.
9.5 	Scheduling Conflicts. The City Health Officer may disallow or reschedule any proposed blood donation activity if it conflicts with another previously approved activity.
9.6 	Enforcement Authority. The City Health Officer is empowered to disallow or stop any blood donation activity if:
9.6.1	The organizer fails to comply with Sections 9.1 to 9.4, or 9.6.1 The activity is conducted without proper registration or coordination.
      SECTION 10. STORAGE AND DISPOSITION OF BLOOD PRODUCTS
10.1 	All blood products shall be stored at licensed or accredited blood bank such as the Philippine Red Cross and Margos Regional Hospital. 
10.2 	Blood products gathered by the city through the Dugong Bayani Blood Donation Program shall be given or issued to patients for free. Partner blood bank or blood station however may charge a minimum fee for the storage of the blood product and its processing.
10.3 	"NO Storage fee" to be charged by the partner blood bank or station and shall be mutually agreed upon by the City Government of Pagadian and the partner blood bank or station. 
10.4 Storage and disposition of blood products gathered through blood donation activity conducted by other organizations or institutions shall be the responsibility and on the discretion of the organizer and their partner agencies or organizations. 
10.5 	Selling of blood and blood products are strictly prohibited in the city of Pagadian to include commercial donor.
10.6 	Prohibition of Commercial or Contracted Blood Donors. The engagement or acceptance of commercial or contracted blood donors in any community-based blood donation or bloodletting activity within the City of Pagadian is strictly prohibited. Only voluntary, non-remunerated blood donors shall be allowed to participate in accordance with the provisions of Republic Act No. 7719 (National Blood Services Act of 1994) and its implementing rules and regulations.
      SECTION 11.-FUNDING - The City Blood Donation Program shall be included in the annual work and financial plan of the city. Budget for the program is ONE HUNDRED THOUSAND PESOS ONLY (P100,000.00) and shall be sourced out from GAD fund.
      SECTION 12.-SEPARABILITY CLAUSE - If any part, section or provision of this ordinance is declared invalid or unconstitutional, the other provisions not affected thereby shall remain in full force and effect,
      SECTION 13.-REPEALING CLAUSE - All ordinances, rules and regulations or parts not consistent with any provision of this ordinance are hereby repealed, amended or modified accordingly
      SECTION 14.-EFFECTIVITY - This ordinance shall take effect upon approval and publication within the City.
