"AN ORDINANCE SUSPENDING THE IMPLEMENTATION OF SECTION 216 OF CITY ORDINANCE NO. 2018-400, OTHERWISE KNOWN AS THE "ROAD NETWORK AND TRANSPORTATION MANAGEMENT CODE OF PAGADIAN CITY," PERTAINING TO THE APPORTIONMENT OR SHARING SCHEME FOR THE PROCEEDS OF ALL ADMINISTRATIVE/JUDICIAL FINES, FOR FURTHER STUDY AND EVALUATION"
WHEREAS, City Ordinance No. 2018-400, otherwise known as the Road Network and Transportation Management Code of Pagadian City, was enacted to ensure effective regulation of road use and proper traffic management within the City of Pagadian, and Section 216 thereof provides for the apportionment or sharing scheme for the proceeds of all administrative and judicial fines collected pursuant to its implementation;
WHEREAS, concerns have been raised regarding the implementation and fiscal implications of the said provision, necessitating a comprehensive review and consultation with concerned offices, including the City Treasurer, City Accountant, and Roads and Traffic Management Office;
WHEREAS, pending the conduct of such study and evaluation, the temporary suspension of the implementation of Section 216 is deemed necessary to safeguard the proper management and allocation of public funds;
NOW THEREFORE, be it ordained by the Sangguniang Panlungsod (15th City Council) of Pagadian City in session assembled that:
SECTION 1. Suspension of Implementation - The implementation and enforcement of Section 216 of City Ordinance No. 2018-400, pertaining to the apportionment or sharing scheme for the proceeds of all administrative and judicial fines, is hereby suspended until further legislative action by the Sangguniang Panlungsod.
SECTION 2. Study and Evaluation - The appropriate Committee of the Sangguniang Panlungsod is hereby directed to conduct a thorough study and evaluation of the said provision, in coordination with the City Treasurer's Office, City Accountant's Office, City Legal Office, The Road and Traffic Management Office, and other concerned offices/agencies, and to submit findings and recommendations within a reasonable period.
SECTION 3. Effectivity - This Ordinance shall take effect immediately upon approval and compliance with publication/posting requirements under applicable laws.
