CITY ORDINANCE NO. 2025-619 (Authored by: Honorable Lance Samuel F. Co) "AN ORDINANCE CREATING THE CITY DISASTER RISK REDUCTION AND MANAGEMENT OFFICE AS A DEPARTMENT OF THE CITY GOVERNMENT OF PAGADIAN, ADOPTING ITS ORGANIZATIONAL STRUCTURE WITH CORRESPONDING POSITIONS AND STAFFING PATTERN AND PROVIDING THE NECESSARY FUNDS THEREFOR" WHEREAS, in pursuance with the mandate provided under Republic Act No. 10121 otherwise known as the "Philippine National Disaster Risk Reduction Management System" the Sangguniang Panlungsod, enacted City Ordinance No. 2015-351, dated 17 March 2015, which in gist, established the City Disaster Risk Reduction and Management Office under the Office of the City Mayor and Created Personnel Positions Thereat and Determined Its Powers, Duties and Functions; WHEREAS, after more than a decade since its creation, the City Government of Pagadian through the Sangguniang Panlungsod, after careful evaluation and in consideration of the rapid urban development of the city along with the effects of climate change, deems it imperatively necessary to advance and enhance all efforts in preparing and responding to any kinds of eventuality, thus upgrading the current City Disaster Risk Reduction and Management Office into a Department is most in order; ARTICLE I GENERAL PROVISIONS SECTION 1. TITLE - This Ordinance shall be known as an "Ordinance creating the City Disaster Risk Reduction and Management Office (CDRRMO) of the City of Pagadian, adopting its organizational structure with corresponding positions and staffing pattern, and providing the necessary funds therefor and for other purposes," otherwise known as the "Pagadian City CDRRMO Ordinance" SECTION 2. AUTHORITY - The legal bases of the creation of the CDRRMO are Section 12 of Republic Act No. 10121, the Philippine Disaster Reduction and Management Act of 2010; Section 76 of Republic Act No. 7160, the Local Government Code of 1991; Section 83 of Republic Act No.10354, the General Appropriations Act; and the Joint Memorandum Circular No. 2014-1, dated April 4, 2016, of the National Disaster Risk Reduction and Management Council (NDRRMC), Department of the Interior and Local Government (DILG), Department of Budget and Management (DBM), and the Civil Service Commission (CSC), prescribing the Implementing Guidelines for the establishment of Local DRRM Offices (LDRRMOs) in Local Government Units. SECTION 3. SCOPE - The City Disaster Risk Reduction and Management Office created in this Ordinance is the first line-proactive command department that is responsible for planning and implementing all actions and interventions pertaining to disaster preparedness, mitigation, response, and rehabilitation, and coordinate with all local, regional, and national government agencies, and the private sector in order to efficiently and effectively address exigencies and challenges brought about by such situation. ARTICLE II THE CITY DISASTER RISK REDUCTION AND MANAGEMENT OFFICE SECTION 4. CREATION - There is hereby created the City Disaster Risk Reduction and Management Office (CDRRMO) as a Department of the City Government of Pagadian, with its organizational structure, corresponding positions and staffing pattern as indicated hereunder. SECTION 5. OBJECTIVES - The purpose of creating the CDRRMO is to establish an organic Department that would implement laws, policies, plans and programs, pertaining to disaster preparedness, prevention and mitigation, response and rehabilitation and reconstruction. The office shall supervise an efficient implementation and effective delivery of services to victims and would-be victims of calamities and emergencies in the City in coordination with the City Disaster Risk Reduction and Management Council (CDRRMC). SECTION 6. FUNCTIONS - The CDRRMO shall perform the following functions: Set the direction, development, implementation and coordination of disaster reduction and management programs, plans, and activities within the territorial jurisdiction of the City of Pagadian; Design programs and coordinate disaster risk reduction and management activities consistent with the NDRRMC's standards and guidelines; Consolidate local disaster risk information which includes natural hazards, vulnerabilities, climate change risks, and maintain a local risks map; Organize and conduct training, orientation, and knowledge management activities on disaster risk reduction and management; Operate a multi-hazard early warning system which is linked to disaster risk reduction and management to provide accurate and timely advice to national or local emergency response organization and to the general public, through diverse mass media, particularly radio, landline communications, and technologies for communication; Formulate and implement a comprehensive and integrated Disaster Risk Reduction and Management Plan in accordance with the national, regional and provincial framework, and policies on disaster risk reduction, in close coordination with the City Development Council (CDC), and to submit to the Sangguniang Panlungsod (SP), through the CDC the annual CDRRMO plan and budget, the proposed programming of the DRRM Fund, other allotted disaster risk reduction and management resources, and other regular funding sources and budgetary support of the CDRRMO; Conduct continuous disaster monitoring and mobilize instrumentalities and entities of the City Government, Civil Society Organizations (CSOs), private groups and organized volunteers to utilize their facilities and resources for the protection and preservation of lives and properties during emergencies in accordance with the existing policies and procedures; Disseminate information and raise public awareness about hazards, vulnerabilities, and risk, their nature, effects, early warning signs and counter-measures; Identify and implement cost-effective risk reduction measures or strategies; Maintain a database of human resources, equipment. directories, and location of critical infrastructures and their capacities such as hospitals, and evacuation centers; Develop, strengthen and operationalize mechanisms for partnership or networking with the private sector, CSOs, and volunteer groups; Take all necessary steps on a continuing basis to maintain, provide, or arrange the provision of, or to otherwise make available, suitably trained and component personnel for efficient civil defense and disaster risk reduction and management; Organize, train, equip and supervise the local emergency response teams and the accredited community disaster volunteers, ensuring that humanitarian aid workers are equipped with basic skills to assist people in times of emergencies; Respond to and manage the adverse effects of emergencies and carry out recovery activities in the affected area, ensuring that there is an efficient mechanism for immediate recovery of food, shelter, and medical supplies for all affected individuals or families; Promote and raise public awareness of, and compliance with RA No. 10121, and others laws, official issuances or rules and regulations pertaining to disaster risk reduction and mitigation; Serve as the executive arm and secretariat of the CDRRMC; Establish linkages or networks with the other local government for disaster risk reduction and emergency response purposes; Prepare and submit, through the CDRRMO, and the CDC, a report on the utilization of CDRRMC Fund and other dedicated disaster risk reduction and management resources to the Commission On Audit (COA), copy furnished the Regional Director of the Office of The Civil Defense (OCD) and the Regional Director of the DILG; Take into account the needs of vulnerable and marginalized group before, during and after disaster situation; Act on other matters that may be authorized by the CDRRMC; ARTICLE III ORGANIZATIONAL STRUCTURE AND STAFFING PATTERN SECTION 7. A. OPERATIONS AND WARNING DIVISION. Ensures efficient implementation of plans/programs/interventions and effective delivery of various services pertaining to disaster preparedness, control, rehabilitation, and mitigation. Coordinates with the member agencies of the CDRRMC and other support agencies from the private sector in the area on disaster preparedness and control, coordinates with Barangay Disaster Risk Reduction and Management Committees on disaster preparedness and response; develops and coordinates programs for information, education, and training of the general public, barangay DRRM committees, volunteer workers and the like; serves as official spokesman of the City Mayor, as chairman of the CDRRMC; conducts press briefings during calamity or emergency, and releases hazard information and corresponding advisories efficiently and timely; Implements laws, policies, plans, programs, rules and regulations pertaining to disaster preparedness, mitigation, response, rehabilitation and reconstruction and provides economical, efficient, and effective delivery of basic services to the victims and would-be victims of calamities/emergencies in the area; Formulates policies and plans, subject to approval of the City Mayor and the CDRRMC, for the protection of the local populace and preservation of life property in times of calamities and other emergencies; Recommends, through the CDRRMC, the enactment of ordinances pertaining to disaster risk mitigation, prevention, and reduction consistent and in accordance with the mandates of RA 10121 and its implementing guidelines; Furnishes guidelines to all barangay officials in the preparation of the operational plans, organization and operation of their local barangay disaster risk reduction and management committees; Advises the CDRRMC chairman on matters concerning disaster prevention and control and makes such recommendations as may be deemed appropriate and as required by the Chairman; and B. ADMINISTRATIVE AND TRAINING DIVISION. For and in the absence of the City Government Disaster Risk Reduction and Management Officer, carries out and ensures efficient implementation of plans, programs, and interventions for the effective delivery of various services pertaining to disaster preparedness, control, rehabilitation, mitigation, and reconstruction. Assists the CDRRM Officer in coordinating with member agencies of the CDRRMC and support agencies and the private sector on disaster preparedness and control, including the Barangay Disaster Risk Reduction and Management Committee; Assists the CDRRM Officer in the implementation of laws, policies, plans, programs, rules and regulations pertaining to disaster preparedness, control, rehabilitation, mitigation and provides economical, efficient, and effective interventions to victims and would-be victims of calamities and disasters. Advises the CDRRM Officer on matters concerning formulation of plans and programs involving disaster prevention, control, and preparedness and makes such recommendations, which may be deemed appropriate. Assists in supervising the activities of the different divisions and sections of the CDRRMO; Coordinates the activities of divisions and sections of the CDRRM in the implementation of plans and programs concerning disaster mitigation and control; C. RESEARCH AND PLANNING DIVISION. Heads the Research and Planning Division, and ensures the adequate and proper collection, processing, analysis, and interpretation of statistical data for assessment and contingency planning. Designs program and coordinates disaster risk reduction management activities consistent with the NDRRMC's standards and guidelines; Facilitates and supports risk assessment and contingency planning activities at the local level; Consolidates local disaster risk information, which includes natural hazards, vulnerabilities, and climate change risks, and maintains a local risk map; Formulates and implements, upon direct supervision of the CDRRM Officer, a Comprehensive and Integrated City Disaster Risk Reduction and Management Plan in accordance with the national, regional, and provincial framework, and policies on disaster risk reduction and management, in close coordination with the CDC; Prepares proposals on the Annual Plan and Budget of the CDRRMO, subject to approval of the CDRRM Officer, for adoption by the Sangguniang Panlungsod, through the CDRRMC and the CDC, as well as the proposed programming of the City Disaster Risk Reduction and Management Fund (CDRRM Fund), other allotted and regular fund sources and budgetary support of the CDRRMO; Maintains a data base of human resources and their capacities, equipment directories, and location of critical infrastructures such as hospitals and evacuation centers; Prepares and submits, upon approval of the CDRRM Officer, through the CDRRMC, and the CDC, the report on the utilization of the CDRRM. Fund, and other allotted Disaster Risk Reduction and Management Fund resources to the Commission On Audit (COA), copy furnished the. Regional Director of the Office of Civil Defense (OCD) and the City Director of the DILG; and ARTICLE V PERSONNEL SCHEDULE SECTION 12. PERSONNEL SCHEDULE - Consistent with the creation of the City Disaster Risk Reduction and Management Office, an office which is previously a division of the City Mayor's Office, a Personnel Schedule is hereby redesigned, absorbing the existing filled up Plantilla positions, creating new positions, and herein appended to this Ordinance. BARANGAY DISASTER RISK REDUCTION MANAGEMENT COMMITTEE (BDRRMC) is hereby established under the direction and supervision of the City Disaster Risk Reduction Management Office (CDRRMO). It shall serve as the local body responsible for disaster risk reduction management at the Barangay level. The composition of the BDRRMC shall be as follows; Chairman - Punong Barangay Members - Seven (7) Barangay Kagawads Sangguniang Kabataan Council Two (2) Representatives from Non-governmental Organizations The Punong Barangay shall lead the setting of direction, development, implementation, and coordination of disaster risk reduction management programs. SECTION 14. DUTIES AND RESPONSIBILITIES OF BDRRMC - The following are the primary duties of BDRRMC; Disaster preparedness - a) develop and implement the Barangay Disaster Risk Reduction and Management Plan (BDRRMP) to include risk assessments, training and drills, and maintenance of early disaster warning systems; b) Provide posting area within its jurisdiction to conspicuously display hazard maps and other contingency plans; b) conduct information campaign through various channels of mass media; c) conduct regular drills on emergency response in coordination with the CDRRMO; Disaster mitigation - identify hazards, and implement risk reduction projects including public awareness campaign; Disaster response - a) Act as initial responders, providing immediate on-site assistance and coordinating with higher authorities as they arrive; b) lead the disaster response efforts to ensure evacuation, rescue operations, relief distribution, and emergency shelter management; Recovery and rehabilitation - assess damages to facilitate livelihood programs, and coordinate reconstruction efforts. Serve as the vital link with the CDRRMO and the National Agencies to ensure timely reporting, transition of responsibility and other related purposes ; SECTION 15. BARANGAY DISASTER PREPAREDNESS CENTER - There shall be established a Barangay Disaster Preparedness Center in every barangay to serve as resource center for all community-based disaster risk reduction and management under the supervision of CDRMMO. The Chairperson of the Barangay Committee on Peace and Order shall be the head to implement the disaster management plan of the barangay. He/she shall report immediately to the CDRRMO when disaster occurs in their respective barangay. ARTICLE VII CITY DISASTER RESPONSE LINE UNITS SECTION 16. LEAD AGENCIES DURING DISASTER RESPONSE AND CALAMITIES - In responding disaster emergencies and calamities, and in the aftermath of disaster/calamity, whichever is applicable, the CDRRMO and other line agencies automatically assume the responsibility, however as a general rule, the following shall take the lead; In case of one (1) barangay affected, the BDRRMC leads; In case of more than one (1) barangay is affected, the CDRRMO will take the lead, if applicable, in partnership with the private sector and the civil society organizations in accordance with the MOU/MOA and other mechanism of collaboration; SECTION 17. DISASTER RESPONSE LINE UNITS - All line agencies in the City Government of Pagadian shall provide all-out support to the CDRRMO by constituting the Disaster Response Line Units, as follows; Supply Support Unit. - The Offices of the City General Services and the City Social Welfare and Development are responsible in the acquisition, management, receipt, storage and issuance of supplies including logistics that are required to equip and sustain the disaster response and to the end users. The supplies can be categorized into two; Organic Source from the City Government External Source from non-members or local and international donors. Transportation Support Unit - the Transportation Division under the Office of the City Mayor is responsible in all sort of transporting movement of disaster-response personnel, logistics and other related equipment including victims of disasters. Transportation involves the City Government vehicles, military, commercial or civilian capabilities which are tapped for the purpose; Medical Support Unit - The City Health Office is responsible in providing appropriate medical care efforts in whatever forms of treatment necessary to save the lives of the victim during, and in the aftermath of disaster operation; Personnel Support Unit - The Human Resource Management Office is responsible in maintaining records of trained government employees for disaster operation; Security Support Unit - The Office of the Security Division is tasked to secure the disaster line units including their assets, as well as the lives and properties of the victims in case of disaster; Veterinary Service Unit - The Office of the City Veterinary is responsible in securing the lives of animals including rescue or treatment whichever is applicable; Fire-fighting Support Unit - The City Bureau of Fire Department is responsible in controlling the occurrence of fire or in putting out fire, and rescue of fire victims; Search and Rescue Support Unit - The City Bureau of Fire Department and the City PNP Police Station shall act in finding lost or injured persons for whatever efficient means possible; Information Unit - The City Information Office is tasked to compile, record, document, and maintain updated information on disaster. This unit shall formulate an information system as the database of the City Government; Maintenance and Infrastructure Unit - The City Engineers Office is tasked to perform building and infrastructure maintenance, construction support services, utility operations vehicle maintenance and repair operations; Evacuation Center Support Unit - The Office of the City School Division Superintendent is tasked to manage evacuation centers, in particular, public school buildings and facilities; and coordinate the efficient and proper use, handling and security of the facilities; SECTION 18. PROTOCOL. - In the disaster response operations, All Disaster Emergency Line Units shall observe protocol by coordinating with the CDRRMO the details of its disaster management and response in accordance to the approved plan and program of action, with due consideration of immediate and prudent response to the emergency situation. ARTICLE VIII VOLUNTEERS, CIVIL SOCIETY ORGANIZATIONS AND PRIVATE SECTOR SECTION 19. PARTICIPATION AND DEPLOYMENT OF DISASTER VOLUNTEERS. - For disaster management, the City Government of Pagadian through the CDRRMO shall ensure the participation and engagement of volunteers, either individual or organized groups such as civil society organizations, private agencies to complement the government personnel and logistical capabilities. SECTION 20. GUIDELINES OF VOLUNTEER/S, CSO, PRIVATE AGENCY/S' PARTICIPATION - The CDRRMO in collaboration with the Philippine Red Cross, Office of the Civil Defense, among others shall formulate the guidelines of participation and deployment of disaster volunteers including capacity building/training prior to accreditation, insurance coverage for accredited volunteers, issuance of identification cards and for other purpose subject to the approval of the City Disaster Risk Reduction Management Council consistent with the provisions of Republic Act No.10121. ARTICLE IX FORMAL AND NON-FORMAL INSTITUTIONS SECTION 21. INTEGRATION IN SCHOOL CURRICULA - The Disaster Risk Reduction Management Program shall be integrated in the school curricula in all levels of education, whether in private or public schools including formal, non-formal, technical-vocational, indigenous learning and out-of-school youth courses and programs. The City School Division Superintendent shall coordinate with the Department of Education, the Commission on Higher Education, The Technical Education and Skills Development Authority (TESDA), the National Youth Commission, the Department of Social Welfare and Development, the Office of the Civil Defense and other relevant agencies. ARTICLE X FUNDING SECTION 22. FUNDING REQUIREMENT/BUDGETARY ALLOCATION.- Funding/Budgeting requirements for Personnel Services, Maintenance, and Other Operating Expenses, and capital outlay for the City Disaster Risk Reduction and Management Office shall be sourced from the General Fund; however, pursuant to the General Appropriations Act, the Personal Services limitation prescribed under Sec. 325 (a) of RA 7160 is hereby waived to enable the City to fund the initial year requirements for the newly created four (4) mandatory positions, namely: the City Disaster Risk Reduction and Management Officer II (CDRRMO II), SG 25, and three (3) Local Disaster Risk Reduction and Management Officer II (LDRRMO II), SG 15, responsible for (1) Research and Planning. (2) Administration and Training, and (3) Operation and Warning. Maintenance and Other Operating Expenditures, and Other Capital Outlay requirements of the CDRRMO in the implementation of DRRM programs and projects shall be charged to the City DRRM Fund, subject to the provisions of Joint NDRRMC, DBM, and DILG Memorandum Circular No. 2013-1 and COA Circular No. 2012-002: ARTICLE XI FINAL PROVISIONS SECTION 23. FILLING UP OF POSITIONS. Qualification requirements prescribed under existing laws, rules and regulations shall be strictly adhered to in the selection and filling up of the four (4) mandatory positions in the CDRRMO as enumerated under Section 12 thereof. Other positions herein created to augment the four (4) mandatory positions may be filled up through the designation, reassignment, full-time or part-time detail or transfer of qualified employees/personnel from the different offices of the City Government of Pagadian. SECTION 24. SEPARABILITY CLAUSE. - If any part, section or provision of this Ordinance shall be held invalid or unconstitutional, the other provisions unaffected thereby shall remain valid and effective. SECTION 25. REPEALING CLAUSE.- All other ordinances, rules and regulations, or parts thereof that are inconsistent with any provision of this Ordinance are hereby repealed or modified accordingly. SECTION 26. EFFECTIVITY - This Ordinance shall take effect immediately upon approval and posting in at least two (2) conspicuous places within the territorial jurisdiction of the Local Government Unit of Pagadian City, in accordance with the provisions of the Local Government Code of 1991.
