Obaob "AN ORDINANCE MANDATING THE IMMEDIATE REMOVAL OF EXCAVATED MATERIALS, WASTE AND EXCESS MATERIALS IN CONNECTION WITH CONSTRUCTION ACTIVITIES ALONG PUBLIC ROADS, REQUIRING THE INSTALLATION OF PROJECT INFORMATION BILLBOARDS FOR GOVERNMENT-IMPLEMENTED INFRASTRUCTURE PROJECTS, AND IMPOSING ADMINISTRATIVE SANCTION FOR VIOLATIONS THEREOF" WHEREAS, the Sangguniang Panlungsod recognizes the increasing concern over the hazards and inconvenience caused by unattended excavated materials left along public roads and sidewalks during and after the implementation of infrastructure projects in the City of Pagadian; WHEREAS, such negligence not only endangers the safety of pedestrians and motorists but also contributes to the obstruction of drainage systems, resulting in localized flooding and traffic congestion; WHEREAS, there is a pressing need to institutionalize mechanisms to ensure accountability, compliance with safety standards, and transparency in the implementation of government-funded infrastructure projects; WHEREAS, the installation of Project Information Billboards will promote transparency and public awareness on the scope, budget, and responsible entities involved in the construction projects; NOW, THEREFORE, be it ORDAINED by the Sangguniang Panlungsod of Pagadian (15th City Council), in session duly assembled that: SECTION 1. TITLE. This Ordinance shall be known as "An Ordinance Mandating The Immediate Removal Of Excavated Materials, Waste and Excess Materials In Connection With Construction Activities Along Public Roads, Requiring The Installation Of Project Information Billboards For Government-Implemented Infrastructure Projects, And Imposing Administrative Sanction for Violations Thereof." SECTION 2. DECLARATION OF POLICY. It is hereby declared the policy of the City Government of Pagadian to ensure public safety, traffic order, environmental protection, and transparency in all government-implemented infrastructure projects. Contractors and project implementers must exercise due diligence and responsibility in the conduct of construction activities, particularly those affecting public roads and spaces. SECTION 3. DEFINITION OF TERMS. As used in this Ordinance, the following terms shall mean: 1. Excavated Materials - Soil, rocks, debris, sand, or other materials displaced or removed during construction or excavation works. 2. Waste and Excess Materials - any supplies or materials including construction debris and broken pavement left over after a project is completed. 2. Construction Activities - Any work involving excavation, roadworks, installation of utilities, or construction of structures. 3. Public Roads - All roads, streets, highways, and sidewalks that are owned and maintained by the government for public use, commissioned to undertake a public infrastructure project. 4. Contractor - Any individual, company, or entity engaged or any supply 5. Implementing Agency - The government office or department responsible for the execution or supervision of infrastructure projects. 6. Billboard or Project Information Board - A temporary signage with standard plywood size posted at the construction site that provides pertinent details about the project. 7. Government-Implemented Projects - Projects funded and/or supervised by the national government, local government unit, or government agencies. 8. Nuisance - Any act or condition that causes inconvenience, hazard, or damage to the community. 9. Immediate Removal - Refers to the clearing or hauling of excavated materials within forty eight (48) hours from excavation, except for the necessary volume and quantity required for backfilling. 10. Right-of-Way - The legal right to pass through property belonging to another, typically referring to roads and sidewalks. SECTION 4. SCOPE AND COVERAGE. - This Ordinance shall apply to all public infrastructure projects in Pagadian City, whether national or local, being implemented by private contractors or government agencies that involve excavation or construction activities along public roads, streets, or sidewalks. SECTION 5. PROHIBITED ACTS. The following acts are hereby prohibited: a. Leaving excavated materials unattended or unremoved beyond the prescribed period. b. Obstruction of roads, sidewalks, or drainage systems due to uncollected or unremoved construction debris, excavated materials, waste or excess materials. c. Commencing construction projects without installing the proper Project Information Billboard. d. Conducting excavation works without coordinating with or securing clearance from the City Engineer's Office. SECTION 6. MANDATORY REMOVAL OF EXCAVATED MATERIALS. - All contractors, project implementers, or persons responsible for construction or excavation activities along public roads within the jurisdiction of Pagadian City shall be required to: a. Immediately remove excavated materials from public roads, sidewalks, and drainage systems upon completion of daily excavation work or within forty-eight (48) hours therefrom; b. Ensure proper stockpiling of excavated materials, in temporary storage if necessary, in a manner that does not obstruct traffic or pedestrian movement, and does not cause flooding or environmental harm; and c. Coordinate with the City Engineer's Office and the City Traffic Management Office regarding construction schedules and excavation areas. d. Coordinate with the Pagadian City Traffic Division for the possible re-routing of motorists so as to avoid traffic congestion and delay of travel. SECTION 7. INSTALLATION OF PROJECT INFORMATION BILLBOARDS. - For all government-funded infrastructure projects, the concerned implementing agencies or contractors shall install a project information billboard on the project site prior to the start of construction. The billboard shall contain the following information: a. Name of Project b. Implementing Office/Agency c. Name of Contractor d. Source of Funds and Amount e. Start and Completion Dates f. Contact information for complaints/inquiries SECTION 8. INSPECTION AND MONITORING. - The City Engineer's Office (for city-funded projects) and the Department of Public Works and Highways (for nationally-funded projects) shall be responsible for the regular inspection and strict enforcement of this Ordinance. Barangay Officials may assist in reporting violations occurring in their respective jurisdictions. SECTION 9. ROLE OF THE CITY ENGINEER'S OFFICE. - The City Engineer's Office (CEO) shall: a. Monitor compliance of contractors with this Ordinance. b. Conduct inspection and clearance before any excavation project can be deemed completed. c. Maintain a registry of all active infrastructure projects within the City. d. Issuance of a Stoppage Order, as applicable, against any ongoing construction or excavation activity found to be non-compliant until such time as full compliance is achieved. e. The City Government may pursue further legal remedies including but not limited to the revocation of permits, blacklisting of contractors, and the filing of appropriate complaints before the courts or regulatory bodies, when warranted. SECTION 10. ADMINISTRATIVE SANCTIONS. - a. Failure to comply with the provisions of this Ordinance or for commission of the prohibited acts above-mentioned, contractors, project implementers, or persons responsible for construction or excavation activities shall be subject to the following sanctions: a. For the First Offense: Written warning and immediate compliance order; b. For the Second Offense: Issuance of a stoppage order until compliance; c. For the Third and Subsequent Offenses: Blacklisting from participating in public bidding process or future city projects, and possible revocation of business permits or authority to operate in the City. b. The City Engineer's Office through the City Engineer, its engineers and personnel in charge of implementing the provisions of this Ordinance and other pertinent laws shall be administratively liable for neglect of duty in case of their refusal or failure to perform their duties and responsibilities under this Ordinance and other pertinent laws. SECTION 11. APPROPRIATION OF FUNDS. An initial amount of P500,000.00 shall be appropriated from the City General Fund to support the implementation, monitoring, and enforcement of this Ordinance. SECTION 12. SEPARABILITY CLAUSE. If any provision of this Ordinance is declared unconstitutional or invalid, the remaining provisions shall not be affected and shall continue to be in full force and effect. SECTION 13. REPEALING CLAUSE. All ordinances, rules and regulations inconsistent with this Ordinance are hereby repealed or modified accordingly. SECTION 14. EFFECTIVITY CLAUSE. -This Ordinance shall take effect immediately after its publication for three (3) consecutive weeks in a newspaper of local or general circulation and after fifteen (15) days from posting thereof in at least two (2) conspicuous places in the city.
