"AN ORDINANCE PRESCRIBING FOR THE ALLOCATION OF AT LEAST TEN PERCENT (10%) OF THE TOTAL PROCUREMENT VALUE OF THE CITY GOVERNMENT OF PAGADIAN, NGAs, RLAs AND OTHER GOVERNMENT AGENCIES HOLDING OFFICES IN PAGADIAN CITY FOR LOCALLY-PRODUCED GOODS AND SERVICES AND THEIR MANDATORY PROMOTION THEREOF"
WHEREAS, Article II, Section 20 of the 1987 Constitution provides that the State recognizes the indispensable role of the private sector, encouraged private enterprises, and provides incentives to needed investments;
WHEREAS, Republic Act No. 9501 or the Magna Carta for Micro, Small and Medium Enterprises (MSMEs), recognizes that MSMEs have the potential for more employment generation and economic growth and therefore can help provide a self-sufficient industrial foundation for the country, and thus declared the policy of the State to promote, support, strengthen and encourage the growth and development of MSMEs in all productive sectors of the economy particularly rural/agri-based enterprises;
WHEREAS, Section 4 of Republic Act No. 9501 or the Magna Carta for MSMEs, provide the eligible MSMEs shall be entitled to a share of at least ten percent (10%) of total procurement value of goods and services supplied to the Government, its bureaus, offices and agencies annually; and 
WHEREAS, the City Government of Pagadian has a legal and moral obligation to formulate local laws, rules, policies and regulations that will help boost the local economy by recognizing the specific needs of the MSMEs, undertaking the promotion of entrepreneurship, supporting entrepreneurs, encouraging the establishments of MSMEs and ensuring their continuing viability and growth and thereby attain countryside industrialization;
NOW, THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod (15th City Council) of Pagadian City, in session assembled, that: 

SECTION 1. TITLE. This Ordinance shall be known as the "Buy Local, Support Local Ordinance."

SECTION 2. DEFINITION OF TERMS. For the purpose of this Ordinance, the following terms shall mean:

LOCALLY-PRODUCED GOODS AND SERVICES are food and non-food products and services made, provided, or sold at MSMEs in the City of Pagadian;

MSME refers to Micro, Small and Medium enterprise, including cooperative, rural improvement clubs, associations and existing businesses without registrations, with a capitalization not exceeding Php 100 Million, has an existing product, food or non-food, or has commenced operation but is in the process of developing its product; 

MSME REGISTRY refers to the list of eligible local MSMEs registered by the City Economic Enterprise Office of the LGU producing and/or offering locally-produced food and non-food products and services, and the ones entitled  to the benefits provided for by this Ordinance; and

PASALUBONG CENTERS refer to the place established and operated by the national government and its instrumentalities, LGUs, NGOs, and private entities.

SECTION 3. COVERAGE AND ELIGIBILITY FOR ASSISTANCE. To qualify under this Ordinance, the establishment must be:

All manufacturing, processing, and/or production of agricultural produce and provision of services which are duly registered with the appropriate agencies as presently provided by law (DTI, SEC, CDA, or DOLE) and has secured the Mayor's permit, including other statutory obligations. 

One hundred percent (100%) owned, capitalized by Filipino citizens, whether single proprietorship or partnership or cooperative. If the enterprise is a juridical entity, at least sixty percent (60%) of its capital or outstanding stock must be owned by Filipino citizens residing in Pagadian City, Zamboanga del Sur; and

A business activity within the major sectors of the economy, namely: industry, trade, services, including operation of tourism-related establishments, and rural/agri-based enterprises. 

SECTION 4. PROGRAM GUIDELINES. The various programs, projects and activities to be implemented by virtue of this Ordinance shall be guided by the following principles:

In every purchase of goods and services by the City Government of Pagadian, consideration must be first made whether or not there are local counterparts of these products or services deemed to be purchased;

All tokens to be given in all activities of the City Government, NGAs, RLAs, and other government agencies holding office in Pagadian must be locally-produced goods and/or services;

At least ten percent (10%) of the total procurement value of goods and services supplied to the Municipal Government, NGAs, RLAs and other government agencies holding offices in Pagadian annually must be solely devoted to locally-produced goods and services;

Encourage MSMEs to act as consolidators of locally-produced goods and services to help facilitate marketing of these products; and

Establishment of more Pasalubong Centers or market outlets for MSMEs to display or sell their products. 

SECTION 5. THE LOCAL ECONOMIC DEVELOPMENT AND INVESTMENT PROMOTION CENTER-PAGADIAN CITY (LEDIPC-PAGADIAN CITY). The LEDIPC-Pagadian City is hereby designated as the primary implementing office of this Ordinance. As such, the Office is mandated to: 

Within three (3) months after the effectivity of this Ordinance, the office shall assess and register qualified MSMEs to be entitled with the benefits of this Ordinance. Registered MSMEs shall be compiled and be known as the MSME Registry of LGU Pagadian City. The MSME Registry shall be updated annually or as often as possible by the City Economic Enterprise Development and Management Office (CEEDMO) and, through the Office of the Local Chief Executive, recommends its approval by the Sangguniang Panlungsod. Any inclusion or exclusion from this list shall be thoroughly evaluated by the CEEDMO. The approved MSME Registry shall be posted in the online and offline platforms of the LGU and this shall serve as the basis of all concerned government entities for their procurement of needed locally produced products and services.

Design and prepare a Procurement and Marketing Plan for MSME Products pursuant to provisions of this Ordinance, subject for approval of the Local Chief Executive and the availability of funds;

Regularly coordinate with the National Government Agencies (NGAs), Regional Line Agencies (RLAs) and other government agencies holding offices in Pagadian with respect to the strict implementation of the provisions of this Ordinance;

Submit semi-annual report to the Office of the Mayor and the Office of the Vice Mayor of the status of implementation of this Ordinance; and
Exercise such other functions expressly granted and those necessarily implied therefrom, as well as those functions necessary, appropriate, and incidental to the effective implementation of the provisions of this Ordinance. 

SECTION 6. FUNDING AND AUTHORIZATION. An initial appropriation of not less than One Million Pesos (Php 1,000,000.00) shall be allocated from the available funds of the Procurement and Marketing Plan for MSME Products to be taken from the General Fund, subject to the approval of the Sangguniang Panlungsod. 

The City of Pagadian is hereby authorized to utilize at least ten percent (10%) of its Approved Annual Procurement Plan (APP) for the purchase of locally produced products and services of MSMEs. 

The City Government is hereby authorized to accept funds from the GOs, NGAs, RLAs, NGOs, CSOs, POs and the business sector to be utilized in the implementation of the abovementioned Procurement and Marketing Plan, subject to proper government accounting and auditing procedures. 

SECTION 7. SEPARABILITY CLAUSE. If any section or part of this Ordinance is held unconstitutional or invalid, the other sections or provisions not otherwise affected shall remain in full force or effect.

SECTION 8. REPEALING CLAUSE. All other orders, issuances, rules or regulations, which are inconsistent with the provisions of this Ordinance are hereby repealed, amended or modified accordingly.

SECTION 9. EFFECTIVITY. This Ordinance shall immediately take effect after fifteen (15) days of posting thereof in at least two (2) conspicuous places in the City of Pagadian.

ENACTED AND APPROVED by the Sangguniang Panlungsod (15th City Council) during its 15th  Regular Session held on 05 November 2025 at the SP Session Hall, 4th Floor City Commercial Center Building, Santiago District, Pagadian City.
