"AN ORDINANCE INSTITUTIONALIZING HEALTHY LEARNING INSTITUTIONS (HLI) IN PAGADIAN CITY"

WHEREAS, the 1987 Constitution of the Republic of the Philippines declares that the State shall protect and promote the right to health of the people and instill health consciousness among them;

WHEREAS, the Universal Health Care Act of 2018 (Republic Act No. 11223) embodies the principle of an integrated and comprehensive approach to ensure that all Filipinos are health literate, provided with healthy living conditions, and protected from hazards and risks that could affect their health, whereby directing local government units to issue and implement effective health promotion policies and programs that promote health literacy and healthy lifestyle among their constituents. Furthermore, under Section 30, schools under the supervision of the Department of Education (DepEd) are designated as healthy settings;

WHEREAS, the World Health Organization (WHO) recognizes that health should be holistic, and that schools are regarded as a key setting for promoting the health, wellbeing, and development of children and adolescents; 

WHEREAS, the Department of Health's Health Promotion Framework Strategy (HPFS) takes a life-course approach, and prioritizes health promotion among the youth; Furthermore, it identifies 7 priority areas for health promotion, specifically diet & physical activity, environmental health, immunization, substance use, mental health, sexual and reproductive health, violence & injury prevention;

WHEREAS, the Department of Education (DepEd), likewise recognizes the importance of health to education and aims to provide all learners and DepEd personnel with a sustainable holistic school health and nutrition program towards healthier behaviors and better learning outcomes  through its OK sa DepEd program (DepEd Order No. 028, s. 2018); 

WHEREAS, the Joint Department of Health-Department of Social Welfare and Development-Department of Education-Commission on Higher Education-Legal Education Board-Technical Education and Skills Development Authority-and Department of the Interior and Local Government Administrative Order No. 2022-0001 enjoins local governments to support learning institutions in implementing policies, programs, and efforts for health education and promotion; 

WHEREAS, the Local Government Code of 1991 (Republic Act No. 7160) accords every local government unit power and authority to promote general welfare within its territorial jurisdiction, including the promotion of health and safety of its constituents;

WHEREAS, owing to the aforementioned, the City of Pagadian acknowledges the need for a strongly-supported, well-coordinated, multi-sectoral approach to transform schools to become Healthy Learning Institutions; 

WHEREAS, this Ordinance shall provide guidance and outlines roles and responsibilities of the local government to operationalize Healthy Learning Institutions program in the City of Pagadian.

NOW, THEREFORE: BE IT ORDAINED by the Sangguniang Panlungsod of Pagadian (14th City Council), in session assembled: that: 

CHAPTER I. GENERAL PROVISIONS

Section 1. Short Title. -This Ordinance shall be known as "The Healthy Learning Institutions Ordinance of Pagadian City."

Section 2. Declaration of Principles and Policies. -It is the policy of the City of  Pagadian to uphold the right to health and education of its constituents and instill health consciousness among them. Pagadian City further recognizes that health promotion in learning institutions maximizes the positive impact of education in learners' development. Towards this end, shall adopt a settings-based approach that ensures an avenue for population-based health interventions, age-appropriate health education, and implementation of health-promoting policies in learning institutions.

Section 3. Objectives. -This Ordinance seeks to:
Outline guiding principles for the realization of healthy learning institutions as envisioned in the UHC Act;
Provide a framework for development and prioritization of healthy learning institution programs and/or standards in accordance with existing laws;
Promote a settings-based approach for health promotion focusing on learning institutions;
Provide support to learning institutions to meet the relevant standards for healthy learning institutions; and
Establish a referral system for efficient delivery of healthcare and services to learners.

Section 4. Scope. -Healthy learning institutions interventions shall cover all public and private learning institutions as defined herein, within the jurisdiction of Pagadian City.

Section 5. Governing Laws. -This Ordinance hereby adopts the following relevant and enforceable national laws, rules, and other regulations, governing healthy learning institutions, such as but not limited to:

Republic Act No. 11223. An Act Instituting Universal Health Care for All Filipinos, Prescribing Reforms in the Health Care System, and Appropriating Funds Therefor;
Republic Act No. 10627. An Act Requiring All Elementary and Secondary Schools to Adopt Policies to Prevent and Address the Acts of Bullying in their Institutions;
Republic Act No. 11036. An Act Establishing a National Mental Health Policy for the Purpose of Enhancing the Delivery of Integrated Mental Health Services, Promoting and Protecting the Rights of Persons Utilizing Psychiatric, Neurologic and Psychosocial Health Services, Appropriating Funds Therefor, and for Other Purposes;
Republic Act No. 11313. Safe Spaces Act;
Republic Act No. 9710. Magna Carta of Women;
Republic Act No. 11053. An Act Prohibiting Hazing and Regulating Other Forms of Initiation Rites of Fraternities, Sororities, and Other Organizations, and Providing Penalties for Violations Thereof;
Republic Act No. 11900. Vaporized Nicotine and Non-Nicotine Products Regulation Act;
Republic Act No. 10754. An act expanding the benefits and privileges of persons with disability (PWD);
DOH-DSWD-DepEd-CHED-LEB-TESDA-DILG Joint Administrative Order No. 2022-0001. Guidelines on Healthy Settings Framework in Learning Institutions;
Department of Health Administrative Order No. 2013-0013. National Policy and Strategic Framework on Adolescent Health and Development;
Department of Education (DepEd) Order No. 40, s. 2012. DepEd Child Protection Policy;
DepEd Memorandum No. 2015-0238. Guidelines in the Implementation of School-based Immunization;
Executive Order No. 326, s. 1941. Regulating the Operation of Bars;
Executive Order No. 26, s. 2017. Providing for the Establishment Smoke-Free Environments in Public and Enclosed Spaces;
Executive Order No. 106, s. 2020. Prohibiting the Manufacture, Distribution, Marketing, and Sale of Unregistered and/or Adulterated Electronic Nicotine/Non-Nicotine Delivery Systems Heated Tobacco Products, and Other Novel Tobacco Products, Amending Executive Order No. 26 (s. 2017) and for Other Purposes.

Section 6. Definition of Terms. -The following terms shall be construed as follows:

Health- refers to a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity (World Health Organization, 1948).

Health Promotion Framework Strategy (HPFS)- refers to the Department of Health's 10-year national roadmap on health promotion, which shall be the basis of implementation of health promotion in the country, nationwide and locally.

Healthy Learning Institutions- refer to learning institutions that foster health and well-being of learners and personnel. These are learning institutions that have met the standards jointly established by DOH, DepEd and other NGAs (DSWD, DILG, CHED, TESDA, LEB) to be recognized or awarded as such.

Learning Institutions-  refer to the institutions below that provide education to Filipino students and are encompassed by this policy:

d.1. 	Child Development Centers- refer to early learning centers, public or private, that offer early education and/or child care programs for children zero (0) to four (4) years old, who are taught by Child Development Teacher(s)/Worker(s).

d.2. 	Community Learning Centers-  refer to physical spaces to house learning resources and facilities of a learning program for out-of-school children in special cases and adults. These are venues for face-to-face learning activities and other learning opportunities for community development and improvement of the people's quality of life.

d.3. 	Basic Education Institutions-  refer to institutions that provide basic education or education that is intended to meet basic learning needs which provide the foundation on which subsequent learning can be based, including institutions that provide kindergarten, elementary and/or secondary education, as well as alternative learning systems for out-of-school learners and those with special needs.

d.4. 	Higher Education Institutions (HEI)- refer to educational institutions, private or public, offering CHED-recognized higher education programs.

d.5. 	Technical Vocational Institutions-  refer to institutions, whether public or private, offering Technical Vocational Education and Training registered program(s). These shall include TESDA Technology Institutions, Private Technical Vocational Institutes, HEIs, State Universities and Colleges, Local Colleges and Universities, Training Centers, and enterprises.

d.6. 	Legal Education Institutions (LEIs)- refer to institutions, whether public or private, offering LEB-registered law programs.

CHAPTER II. GENERAL GUIDELINES

Section 7. The following are the general guidelines in the operationalization of healthy learning institutions in the City of Pagadian.

The local DSWD, DepEd, CHED, LEB, TESDA, DOH, and DILG shall ensure the implementation and enforcement of set guidelines and standards for healthy learning institutions, provide support to learning institutions in order to achieve these goals, and create and maintain a recognition or compliance system for individual institutions to be recognized as healthy learning institutions, in accordance with existing laws;

The policies, activities, and implementation of healthy learning institutions framework shall be in line with the six pillars of the WHO Health Promoting Schools Framework: 1) healthy school policies, 2) physical school environment, 3) social school environment, 4) health skills and education, 5) links with parents and communities, and 6) access to health services;

The goals of the healthy learning institutions framework shall be guided by the key priority areas of the HPFS are: 1) Diet and Physical Activity, 2) Environmental Health, 3) Immunization, 4) Substance Use, 5) Mental Health, 6) Sexual and Reproductive Health, and 7) Violence and Injury Prevention. The overarching goal of health literacy and knowledge of health rights shall also be integrated in the curriculum, programs, and activities of the learning institution; and

The local DOH, DSWD, DepEd, CHED, LEB, TESDA, and DILG shall ensure the promotion of health of the students, faculty, and personnel especially those with disabilities, senior citizens, pregnant and lactating women, members of indigenous groups, indigents, rebel returnees, and members who are part of the Lesbian, Gay, Bisexual, Transgender, Queer or Questioning (LGBTQ+) Community and other vulnerable individuals.

CHAPTER III. ROLES AND RESPONSIBILITIES

Section 8. Local/City School Board. -As the principal implementer of this Ordinance, the City School Board shall lead the planning, needs assessment and targeting, resource allocation, and monitoring of learning institutions in the LGU. In this capacity, the Board shall undertake the following:

Review the capacities of learning institutions in its area and identify needs to operationalize and meet the standards for Healthy Learning Institutions;
Determine, in accordance with the criteria set by the concerned national government agency in education, the annual budgetary needs to be able to support the operationalization of HLI in schools with priority given to public schools for equity considerations;
Authorize the city treasurer to disburse funds from the local government's annual National Tax Allocation (NTA) or the Special Education Fund, and other sources, as appropriate, to support Healthy Learning Institutions programs and activities pursuant to the budget prepared and in accordance with existing rules and regulations;
Serve as an advisory committee to the Sanggunian concerned on educational matters such as, but not limited to, the necessity for and the uses of local appropriations for health and educational purposes;
Monitor and evaluate with the Health Promotion Committee the implementation of HLI in Pagadian City and submit an annual report to DOH and DepEd, detailing the progress and impact of HLI; and
Provide city-level recognition and awards for schools within their localities that consistently meet or surpass standards for Healthy Learning Institutions; and coordinate with national-level government agencies for national recognition of the aforementioned schools. 

Section 9. Local Health Board. -The functions of the local health board shall be:

In coordination with City School Board, oversee the implementation and evaluation of Healthy Learning institutions in the LGU;
Propose to the Sanggunian annual budgetary allocations for the operationalization of HLI; 
Provide assistance to learning institutions in ensuring that appropriate medical assistance of the City  is accessible through the Information and Service Delivery Network (ISDN); and
Ensure measures to ban the sale of, and prevent access to, tobacco products, alcohol and illicit drugs in schools and in the immediate vicinity.

Section 10.  City Health Promotion Committee/Unit. - The functions of the Health Promotion Committee/Unit shall be to:

Guide the development and planning of HLI in the City, which may include, but is not limited to the conduct of capacity building, advocacy activities;
Recommend ordinances that strengthen and broaden existing health promotion policies, programs, and activities in learning institutions; 
Monitor and evaluate the implementation of HLI in the city, together with the city school board; and
Closely coordinate with the Department of Education, Schools Division Office for the planning, implementation, monitoring & evaluation of HLI, including the establishment or strengthening of  Information and Service Delivery Networks to ensure appropriate medical assistance are available to learners through schools' systems 

Section 11. City Social Welfare & Development Office. -The City Social Welfare & Development Office, through the City Social Welfare Development Officer, shall have the following functions:

Assess and provide psycho-social interventions to victims and offenders/perpetrators in cases involving child abuse, exploitation, discrimination, bullying or peer abuse and other acts of abuse referred by the school; and

Assess, provide appropriate interventions, and assist learners referred by the school who are victims of abuse at home, children at risk, children in especially difficult circumstances, children with special needs or at risk, or those who are exhibiting signs of aggressive behavior.

Section 12. Pagadian City Police Office. -The Pagadian City Police Office, through the Women and Children's Protection Desk, shall:

Conduct appropriate investigation upon receipt of complaint, which includes, but is not limited to, taking the formal statement of the victim-survivor and collecting other evidence necessary for the filing of the case;
Ensure the confidentiality of identity of the victim-survivor and all other parties directly involved with the case under investigation;
After the conduct of police investigation, shall refer the victim-survivor to the city  social welfare development officer, any DSWD shelters, NGOs, and other service providers for psychosocial intervention and other rehabilitation programs; and
Assist in the application and enforcement of the provisions of the protection order as may be issued by the barangay or the court.

CHAPTER IV. MONITORING

Section 13. Reporting and Monitoring. - The City of Pagadian, through the City School Board, shall regularly monitor the implementation of HLI, and other indicators related to components of this Ordinance. Feedback from the schools shall be incorporated into the monitoring process. Monitoring data shall be consolidated by the local school board and reported on a regular basis to DOH the national government agencies in education.
CHAPTER V. APPROPRIATIONS

Section 14. Appropriations. -The funding and other resources necessary to implement the provisions of this Ordinance and implement other related programs shall be included in the Annual Executive Budget of the City Government of Pagadian,  and may be sourced from the local government's annual National Tax Allocation (NTA), Special Education Fund, or Gender and Development (GAD) funds, and any other possible sources, provided requirements for use of these funds are satisfied and allowed, starting at ONE MILLION PESOS (P1,000,000.00), which may have incremental increase annually in consideration of the annual inflation rate, to cover various expenses, but not limited to the following:
office logistics, materials and supplies for the implementation of HLI Map of Materials
IEC
Official Meetings and functions, conduct of trainings and workshops
Transportation costs
Social mobilization and community activation activities for parents, guardians, school and community personnel
Expenditures for forming partnerships
Health supplies not provided by the DepEd or DOH, or as augmentation to supplies provided by the NGAs
Monitoring, supervision and evaluation activities to include travel, per diems and representation allowances
Meals, Snacks and related expenses for meetings, seminars, orientation, special gatherings and related events
Other expenses relating to the Six (6) Pillars of Health-Promoting Schools Framework, namely: Healthy School Policy, Physical School Environment, Social School Environment, Links with Community, Health Skills and Education, and lastly, Access to Health Care.
National Government Agencies (NGA) or Department of Health-Center for Health Development (DOH-CHD) subsidies for related programs, projects, and activities; and/or funding support or grants from other external development partners or non-government organizations (NGOs) may also be used.

CHAPTER VI. MISCELLANEOUS PROVISIONS

Section 15. Repealing Clause. - All other orders and issuances, or parts thereof, inconsistent herewith are repealed, amended, or modified accordingly.

Section 16. Effectivity. - This Ordinance shall take effect three (3) consecutive weeks after its publication in a newspaper of local or general circulation, or posting in at least two (2) conspicuous places within the City of Pagadian.
