"AN ORDINANCE PROVIDING FOR THE JOBSEEKER EMPLOYMENT INTERVENTION PROGRAM TO BETTER ACCESS JOB OPPORTUNITIES FOR PAGADIAN CITY RESIDENTS, PROVIDING THE PROCEDURES AND FOR OTHER PURPOSES"
WHEREAS, Section 16 of the Local Government Code of 1991 mandates Local Government Units to provide for the promotion of full employment among their constituents;
WHEREAS, Section 4 of Republic Act No. 10691 states that "For their part, persons who are seeking employment, particularly the unemployed, shall register at the PESO for employment facilitation assistance. The establishments, on the other hand, shall submit their job vacancies as well as applicants hired to the PESO to ensure the availability of accurate information on supply and demand for skills in the labor market."
WHEREAS, while the business decision to make or restrict hiring in the City of Pagadian is based on business profitability, product line, and long-term prospects of overall business contribution, the strategic advantage to hiring local talents is creating the leverage to support the following;
Contribution to local economy
Proximity to the business
Better work and life balance for employees
Established network connection
WHEREAS, it is on the above-mentioned premises that the City Government of Pagadian stands side by side with the private business sector to strengthen employment linkage and to provide jobseeker employment intervention programs. In general, accelerates the growth of the local economy;
NOW, THEREFORE, BE IT ORDAINED BY THE SANGGUNIANG PANGLUNSOD (14th CITY COUNCIL) OF PAGADIAN IN SESSION ASSEMBLED THAT:
SECTION 1. TITLE. - This Ordinance shall be known as the "Jobseeker Employment Intervention Program Ordinance."
SECTION 2. DECLARATION OF POLICY. -
It is hereby declared policy of the City Government of Pagadian to promote full employment opportunities and to provide jobseeker employment intervention programs that will facilitate employment and enhance the employability of jobseeker for job placement;
It is hereby declared policy of the Pagadian City Government to ensure the participation of the concerned National Government Agencies, Accredited Technical Vocational Institutions, Civil Society Organizations, and the Private Business Sector in the Implementation of this Ordinance;
SECTION 3. DEFINITON OF TERMS. - The following terms and/or phrase are herein defined as follows, viz:
Establishment - means a single physical location where one predominant business activity occurs;
Employment - means work performed for others in exchange for pay or profit;
Job Placement Report - means the report on applicants hired from the business employer showing the name, address, gender, and other relevant information on the newly hired employee;
National Skills Registration Program (NSRP) - means a Program initiated by the Department of Labor and Employment (DOLE) with the main objective of maintaining a continuing nationwide skills registry through its Skills Registry System database;
OCCUPATIONAL CLEARANCE - Is an ancillary clearance to be issued by PESO which is required prior to the issuance of an occupational permit before any occupation for domestic employment can be lawfully pursued in the City;
PESO Employment Information System (PEIS) - means the program initiated by the Department of Labor and Employment to maintain a continuing nationwide skills registry through its skills registry system database;
SECTION 4. EMPLOYMENT INTERVENTION PROGRAM. - The following are the PESO Employment Intervention Programs under this Ordinance:
PAGADIAN JOBSEEKER/ ESTABLISHMENT DATABASE - It is an employment intervention program that shall maintain a database of Jobseeker who are residents of Pagadian City and Establishments that are operating within the territorial jurisdiction of Pagadian City;
JOB OPENING POST - The program intends to enhance the widest dissemination of the updated labor market information, i.e. job vacancies by forging alliances with the private business sector;
PRE-EMPLOYMENT SEMINAR FOR LOCAL APPLICANTS (PESLA) - The program aims to equip jobseekers with comprehensive career pre-employment knowledge;
JOB FAIR - This institutionalized program intends to provide jobseekers the year-round employment opportunities and the private business sector to hire highly qualified applicants;
JOBSTART - The program intends to immerse the jobseeker in life skills training, technical training, and internship;
SPES - The program aims not only to help students from low-income families to finance their education but also gain work experience;
SPECIAL RECRUITMENT ACTIVITY - The program intends to provide the Jobseekers the special employment opportunities to directly engage the employers and/ or representative;
OTHER SKILLS ENHANCEMENT TRAININGS - Training, Seminar, Workshops, and Activities the PESO may undertake to enhance the Jobseeker's skills and work experience in collaboration with other city government offices and/or in partnership with other national government agencies, and accredited technical vocational institutions;
LIVELIHOOD PROGRAM - This program aims to increase wages and self-employment and to improve socio-economic well-being through the acquisition of productive assets and income;
SECTION 5. PROCEDURES. - The procedures for the jobseeker employment intervention programs are set forth therein, as follows:
PAGADIAN JOBSEEKER/ESTABLISHMENT DATABASE - All unemployed Jobseekers who are residents of Pagadian City and all establishments operating within the territorial jurisdiction of Pagadian City shall be registered at the PESO
Procedure:
1.1 Conduct of Jobseeker's Registration who are residents of Pagadian City:
1.1.2 All walk-in Jobseekers/applicants who seek PESO assistance shall present the following PESO requisites;
1.1.2.1 For Pagadianon
a. Resume' or Curriculum Vitae
b. Barangay Clearance
1.1.2.2 For non-Pagadianon
a. Resume' or Curriculum Vitae
b. Barangay Clearance
PESO or Mayor's Recommendation
1.1.2.3. Filling-up of NSRP Form
1.2 Require all establishments operating in the City of Pagadian to participate in the industry forum at least once a year:
1.2.2 Conduct of the Industry Forum
1.2.2.2 Brief orientation on the jobseeker intervention program and its applicable laws and benefits to the jobseekers, establishments, and LGU;
1.2.2.3 Industry's presentation on what types of businesses they are operating, the equivalent skills, vacancies, and qualifications needed;
1.2.2.4 Present Job opportunities for developing the workforce with the industry partners through the enhancement skills training for selected beneficiaries and;
1.2.2.5 Necessitates the Industry partners to get involved in the preparation of the workforce development plan by forging an agreement.
JOB OPENINGS - PESO bulletin board, FB Page PESO Pagadian, and FB Page Asenso Pagadian shall be the official media to post job openings.
Procedure:
2.1 Conduct of Job Solicitation:
2.1.1 Solicit job openings from establishments operating in the Pagadian City;
2.1.2 Post solicited job openings in the PESO bulletin, FB Page PESO Pagadian, and FB Page Asenso Pagadian;
PRE-EMPLOYMENT SEMINAR FOR LOCAL APPLICANTS (PESLA) - at least once a week, jobseekers shall undergo the PESLA
Procedure:
3.1 Conduct the pre-employment seminar for local applicants based on the approved career guidance and employment program to those who have complied with the requisites in the preceding provisions;
Who may apply? - Residents of Pagadian City may apply to any of the employment intervention programs of this Ordinance.
a.1 Displaced workers
a.2 Out-of school youths
a.3 Former Overseas Filipino Workers
a.4 Professionals
a.5 Persons with disability
a.6 Other interested residents
What are the qualifications?
b.1 Eighteen (18) years of age before the start of program except under SPES program.
b.2 Junior High School Graduate
b.3 Residents of Pagadian City
b.4 Know how to read and write
b.5 Fit to work.
What are the requirements?
c.1 Two (2) copies of bio-data with 2x2 pictures
SECTION 6. NGA AND INSTITUTION. - The Pagadian City Government shall forge a partnership with the National Government agencies (NGA), Civil Society Organizations, and accredited Technical Vocational Institutions for the Implementation of this Ordinance.
SECTION 7. AUTHORITY. - The Local Chief Executive is hereby authorized to enter into an agreement with any of the following entities, such as; beneficiaries of the employment intervention programs; National Government Agencies; Civil Society Organizations, and accredited Technical Vocational Institutions for purposes of this ordinance.
SECTION 8. ASSESSMENT FEES, ALLOWANCES, HONORARIA OR STIPENDS. - For this purpose, the Pagadian City Government may provide assessment fees, allowances, or stipends, whichever applies, for the qualified beneficiaries to carry out the completion of their trainings, and to the support personnel and trainers subject to existing laws, COA auditing rules and regulations.
SECTION 9. DOMESTIC EMPLOYMENT CLEARANCE. - Any individual engaged in domestic employment in the City of Pagadian is required to secure domestic employment clearance duly signed by the PESO Manager and/or his authorized representative to ensure the updated labor market information.
SECTION 10. FUNDING. - The funding requirement for any or all of the Jobseeker Employment Intervention Program may be provided in the appropriation ordinance.
SECTION 11. SEPARABILITY CLAUSE. - If any section or provision of this Ordinance or any part thereof or the application of such section, provision, or portion is declared invalid or unconstitutional, the remainder thereof shall not be affected by such declaration.
SECTION 12. REPEALING CLAUSE. - Any Ordinance, Executive Order, or Rules and regulations inconsistent herewith shall be deemed amended, modified, or repealed accordingly.
SECTION 13. EFFECTIVITY. - This Ordinance shall take effect immediately after fifteen (15) days from posting thereof in at least two (2) conspicuous places in the City.
ENACTED AND APPROVED by the Sangguniang Panlungsod (14th City Council) during its 91ST Regular Session on 25 September 2024 at the SP Session Hall, 4th Floor City Commercial Center (C3), Santiago District, Pagadian City.
