Fernandez "AN ORDINANCE GRANTING CASH INCENTIVE TO ANY LIVING OCTAGENARIAN AND NONAGENARIAN SENIOR CITIZEN IN THE CITY OF PAGADIAN, OTHERWISE KNOWN AS "GAWAD KALINGA AWARD TO SENIOR CITIZEN" WHEREAS, pursuant to Article XV, Section 4 of the 1987 Philippines Constitution, it is the duty of the family to care of its elderly members while the State may design social security programs for them: WHEREAS, pursuant to R.A No. 7432 otherwise known as the "Senior Citizens Act", it is a declared policy of the State to encourage its families and communities where they live to reaffirm the valued Filipino tradition of caring for the Senior Citizens; WHEREAS, in consideration of the above provisions and in appreciation of the role of the Senior Citizens in nation-building, the City of Pagadian deemed it proper and appropriate to grant cash incentives to any senior citizens living in the City; NOW THEREFORE, BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD (14TH CITY COUNCIL) OF PAGADIAN IN SESSION DULY ASSEMBLED THAT: Section 1. Title. - This Ordinance shall be known and cited as "An Ordinance Granting Cash Incentive To Any Living Octagenarian and Nonagenarian Senior Citizen in the City of Pagadian, hereinafter referred to as the "GAWAD KALINGA AWARD TO SENIOR CITIZEN." Section 2. Purpose and Objectives. - This Ordinance aims to grant cash incentive to any living Senior Citizens in the City of Pagadian whose ages belong to 80 to 99 years old. This initiative aims to provide care, support and appreciation to the role of the Senior Citizens in the community and more importantly, to augment their resources to meet their health and economic needs; Section 3. Definition of Terms. - When used in this Ordinance, the following terms are defined as follows: Senior Citizen - refers to any elderly resident citizen of the Philippines at least sixty (60) years old; Octagenarian - refers to any Senior Citizen ages eighty to eighty-nine (1980-89) years old; Nonagenarian - refers to any Senior Citizen ages ninety-ninety-nine (1990-99) years old; Cash Incentive - refers to the monetary grant given by the City of Pagadian pursuant to this Ordinance. Section 4. Scope and Coverage. - This Ordinance shall cover all living Senior Citizens in the City of Pagadian ages eighty to ninety-nine (1980-99) years old, duly registered with the Office of the Senior Citizen Affairs (OSCA), including those who have retired from both government and private offices. He or she must be an active member of the association for at least six (6) months and presently residing in the city for at least five (5) years prior to the grant. Section 5. Documentary Requirements. - The following requirements should be complied and submitted to the City Social Welfare and Development Office (CSWDO) for verification and validation: Section 9. Separability Clause. - If any part or provision of this Ordinance shall be held unconstitutional or invalid, other parts or provisions hereof which are not affected shall continue to be in full force and effect. Section 10. Repealing Clause. - All ordinances, administrative circulars and executive orders or parts thereof which are found to be inconsistent with the provisions of this Ordinance are hereby repealed and amended accordingly. Section 11. Effectivity. - This Ordinance shall take effect immediately after fifteen (15) days from posting thereof in at least two (2) conspicuous places in the City.
