ORDINANCE NO: 2024-576 (Authored by: Hon. Priscilla M. Fernandez) "AN ORDINANCE CREATING THE CITY HEALTH PROMOTION COMMITTEE AND ESTABLISHING THE CITY HEALTH PROMOTION UNIT IN THE CITY OF PAGADIAN AND PROVIDING FUNDS THEREOF" WHEREAS, Section 102 of the Local Government Code provides that the Local Health Board, consistent with the technical and administrative standards of the Department of Health, shall create committees which shall advise local health agencies on matters such as, but not limited to, personnel selection and promotion, bids and awards, grievances and complaints, personnel discipline, budget review, operations review and similar functions; WHEREAS, Republic Act No. 11223 better known as the "Universal Health Care Act," provides that it shall be the policy of the State to protect and promote the right to health of all Filipinos and instill health consciousness among them and towards this end, it adopts, among others, an integrated and comprehensive approach to ensure that all Filipinos are health literate, provided with healthy living conditions and protected from hazards and risks that could affect their health; WHEREAS, the afore-mentioned Act also promotes Province-wide and City-wide Health Systems (P/CWHS) which shall have the following minimum components, viz: a) primary care provider network with patient records accessible throughout the health system; b) accurate, sensitive, and timely epidemiologic surveillance systems; and c) proactive and effective health promotion programs or campaigns; WHEREAS, based on the foregoing, the Department of Health (DOH) issued Administrative Order No. 2020-0042 which mandates Local Health Board to create the Health Promotion Committee (HPC) purposely to provide guidance and direction on the operationalization of health promotion as envisioned in the Universal Health Care Act; NOW, THEREFORE, be it enacted by the Sangguniang Panlungsod of the City Government of Pagadian, in regular session assembled, that: Section 1. Title. - This Ordinance shall be known as "Creation of the City Health Promotion Committee and the Establishment of the City Health Promotion Unit in Consonance with Republic Act No. 11223 and Providing Funds thereof." Section 2. Coverage. - This Ordinance shall cover all fifty-four (54) barangays in the City of Pagadian, concerned government sectors, civil society organizations, academic institutions, private sector and health facilities within the city-wide health system and will ensure the development and implementation of health promotion policies and programs as well as coordinate with local government and Barangay Health Workers (BHWs) as barangay-level Health Education Promotion Officers (HEPOs). Section 3. Purpose. - This Ordinance aims to provide guidance and directions to the City Health Board on health promotions policies, programs and activities, particularly involving the determinants of health and health-risk factors. Section 4. Declaration of Policy. - Section 468(a) of Republic Act No. 7160, otherwise known as the Local Government of 1991, authorizes the City Government through the Sangguniang Panlungsod to formulate effective health promotion policies, programs and activities that promote health literacy and healthy lifestyle of their constituents, prevent and control diseases and their risk factors to advance population-health and individual well-being and so therefore, it is hereby declared the policy of the City Government of Pagadian to establish the City Health Promotion Unit and create a Health Promotion Committee in order to attain the goal of this Ordinance and to defray the expenses incurred during the period of its operation. Section 5. Definition of Terms. - The hereunder terms are defined for the purpose of this Ordinance: Capacity Building for Health Promotion - refers to the development of knowledge, skills, commitment, structure, systems and leadership to enable effective health promotion. City-Wide Health Systems (CWHS) - refers to an integrated local health system composed of all health systems within its jurisdiction. A City-wide system is composed of the 54 barangays health systems; and Conflict of interest - situation in which a person/organization is involved in multiple interests or otherwise, serving one interest could involve working against another. Determinants of Health - refers to those factors that have significant influence, whether positive or negative, on an individual's or population's health which can include biological, political and social factors, among others. Health Promotion - is the process of enabling people to increase control over, and to improve, their health. Health Promotion Framework Strategy (HPFS) - refers to a ten (10) year old national roadmap on health promotions which shall be the basic of implementation of health promotion in the country, nationwide and locally. Health Public Policy - improve the conditions under which people live: secure, safe, adequate, and sustainable livelihoods, lifestyles, and environments, including housing, education, nutrition, information exchange, child care, transportation, and necessary community and personal social and health services. Health Risk Behaviors - refers to behaviors that potentially have negative effects on health such as, but not limited to, smoking, alcohol drinking, unhealthy diet, absence of physical activity, risky driving, substance use, etc., Section 6. Creation of the City Health Promotion Committee and Establishment of City Health Promotion Unit (CHPU). - The City Health Promotion Committee (CHPC) of Pagadian City shall be created to provide guidance and technical support to the Local Health Board on health promotion policies, programs, and activities particular or involving the determinants of health and health risk factors. Relative to this, the Local Health Board shall oversee the implementation and evaluation of said health promotion policies, programs, and activities in the City-wide Health Systems (CHWS), composed of the following: Chairman : City Health Officer Co-Chairman : SP - Committee on Health Chairman Members : City Health Education Program Officer City Information Officer City Administrator City Budget Officer City Social Welfare and Development Officer City Environment and Management Officer City Head, Department of Interior and Local Government Representative, Provincial DOH Office Representative, Philippine Medical Association - ZDS Chapter Representative, Philippine Nurses Association - ZDS Chapter President - Barangay Health Workers Association Representative, Liga Ng Mga Barangay Medical Doctor/Nurse, Department of Education - City School Division 6a. Functions - In providing guidance to the Local Health Board to address determinants of health and health risk factors, the CHPC shall perform the following specific duties and responsibilities, but not limited to: Guide the development and planning of provision of proactive and effective health promotion policies, programs, and activities campaigns in the City-wide Health System; Recommend stricter ordinances that strengthen and broaden existing health promotion policies, programs, and activities; and Monitor and evaluate with the CHPU the implementation of health promotion in the City-wide Health System, and submit a semestral report to DOH and DILG detailing the progress and impact of the health promotion policies, programs, and activities. 6b. Quorum. - A quorum of the Committee shall be composed of a simple majority of all voting members. The Chairperson shall vote only in case of a tie. 6c. Meetings. - The Committee shall agree to meet on a twice (2x) a year basis to discuss matters with regard to the implementation, enforcement and monitoring of health promotion policies, programs and activities or on a per needed basis as called by the chairperson and on a written request of simple majority among the committee members. 6d. Representation. - Representatives from the private sector and civic society organizations shall comprise one-third of the committee membership. Section 7. Conflict of Interest. - Members of the Committee shall submit an annual declaration of conflict of interest so as to avoid conflict of interest in the delivery of primary care services, particularly on tobacco and milk products in keeping with R.A. 9211 or the Tobacco Regulation Act of 2003 and EO No. 51 or the National Code of Marketing of Breastmilk Substitutes, Breastmilk Supplements and Other Related Products. Section 8. General Guidelines. - A City Health Promotion Unit (CHPU) is hereby established under the Technical Division of the City Health Office. The CHPU shall ensure the development and implementation of health promotion policies and programs in City - Wide Health System and exercise coordination with local government and Barangay Health Workers (BHWs) as barangay-level HEPO's and with the following additional function/s: Governance Structure Oversight Technical and managerial oversight of BHWs with regard to implementation of health promotion activities in the community shall be the responsibility of the appointed City Health Office - Health Education Promotion Officer; Relative this, local HEPOs shall establish and maintain functional and regular coordination with the Health Promotion of the City to ensure the seamless and standardized implementation of health promotion activities across the City-wide Health System; and It shall be the responsibility of the DOH and CHD to provide additional technical assistance, as necessary. Capacity Development Training and capacity building to enhance necessary knowledge and skills competencies of the BHW shall be the responsibility of the City Health Office; It shall be the responsibility of the DOH- to develop and provide the tools, standards and/or process guides necessary to capacitate the BHWs on health promotion. The City Health Promotion Unit (CHPU) shall be manned by the following: Health Education and Promotion Officer; Registered Nurse or Health Program Officer; and Encoder / graphic / lay out artist All City-wide Health System promotion activities shall be anchored on the Health Promotion Framework Strategy; The envisioned City - wide Health System health promotion goals shall be anchored in the following: That all individuals are empowered to make healthy choices and choose healthy lifestyle to curb risk factors; That communities are informed, engaged and mobilized in ensuring their health and well-being; and That all settings wherein an individual lives, schools and works foster an environment that promotes health; City - wide Health System shall implement the five (5) action areas of the Ottawa Chapter as the underlying framework. These action areas are all interwoven and linked with one another which, if completed, can bring synergized and compounded impact on the health and health outcomes of Filipinos in line with the UHC's goals. The following shall be the action areas: Implementing healthy public policies that promote health and well-being. Establishing healthy public policies that promote health and wellbeing for all is critical in the implementation of health promotion. Healthy public policies will promote healthier individual choices and eliminate barriers to behavioral change. Re-orienting health services and communities to health promotion. For effective behavioral change to happen, a re-orientation and re-balancing of resources among promotion, prevention and treatment services must be made at all levels of the health sector. Strengthening personal and community health promotion capacity. Personal skills and community development are necessary for health promotion action to be successfully undertaken. Fostering supportive and conducive environments / settings through the life course. Environments and settings are influential in determining societal and individual behavioral patterns. Conducive environment / settings for health are necessary to lessen health inequity in a community. Development of strong collaborative inter-sectoral partnership and collective efforts in the local setting. As factors influencing health are diverse and numerous, collaborative and collective action among various stakeholders and community members are vital to effectively address determinants of health and health-risk behaviors promotion strategies and interventions. City - Wide Health System shall provide population-based health promotion interventions, activities and initiatives in the following strategic approaches; Life-course Approach - All health promotion policies and programs shall consider all life-course stages; Lifestyle and Behavioral Approach - All health promotion policies shall target the behavior of individuals to promote enabling and healthy choices to curb risk factors; and Sociological Approach - All health promotion policies and programs shall consider environment in which an individual lives, schools, and works in as this determines his or her over-all well-being. Section 9. Specific Guidelines. The City - Wide Health System, through its Barangays, shall strengthen existing health promotion policies and programs; It shall strengthen existing and develop new partnership across all sectors to ensure a comprehensive, consistent and effective approach to health promotion by: Involving all concerned sectors in the development and implementation of healthy public places including, but not limited to, counterpart government agencies, civil organizations, private sector and educational institutions; Engaging, empowering and mobilizing the community to implement any societal action and behavioral change required; Ensuring continuous and meaningful dialogue to address people's issues and concerns and promote collective community participation and behavioral change; As mandated in the UHC law, the City - Wide Health System shall prioritize the following policies and programs in communities, schools, workplaces and health facilities: Ensuring measures to ban the sale of and prevent access to tobacco products, nicotine & non-nicotine electronic cigarettes "vape" and alcohol in schools and in the immediate vicinity; Promoting healthy lifestyle through physical activity, proper nutrition, injury prevention and mental health programs; Intensifying the fight against the spread of communicable disease through the promotion of programs that include, among others, personal hygiene, oral health, access to safe water and sanitation and environmental measures to prevent vector-borne diseases and vaccinations; Strengthening existing health promotion policies and programs towards the improvement of health indicators; and Hospital HEPOs shall maintain linkages with local HEPOs within the City - wide Health Systems to facilitate necessary health promotion services upon a patient's return to the community and vice versa. Section 10. Funding and Disbursement. - for the purpose of implementing this Ordinance, the City shall appropriate in the general fund the amount of ONE HUNDRED THOUSAND PESOS (Php 100,000.00) annually for the operations and implementation of health promotion activities. Disbursement shall be approved by the City Mayor, subject to the accounting and auditing procedures. The said funds will be allocated as follows: (a) Capacity Development and Meetings - 50%; (b) Health Promotional Materials and IT Equipment - 35%; and (c) Monitoring and Supervising Visits - 15%. Other source for the management, operations and implementation of health promotion policies, programs and activities shall be funded from the Special Health Fund once it becomes operational. Section 11. Monitoring and Evaluation. - The City Local Health Board, through the Health Promotion Committee and the Health Promotion Unit, shall monitor and evaluate the implementation of health promotion in the City and shall submit a semestral report to the DOH and DILG detailing the progress and impact of health promotion policies. Section 12. Repealing Clause. - All ordinances, resolutions or laws of local application and effect that are inconsistent with the provisions of this Ordinance are hereby modified, superseded and repealed accordingly. Section 13.? Separability Clause. - If, for any reason/s, any part or provision of this Ordinance is declared unconstitutional or invalid, other parts or provisions hereof that are not affected shall continue to be in full force and effect. Section 14. Effectivity. -?This Ordinance shall take effect upon its approval, subject to the completion of the fifteen (15) day posting requirement in two (2) conspicuous places or its full publication in any newspaper of general circulation within the City of Pagadian, Province of Zamboanga del Sur, whichever is earlier.
