ORDINANCE NO: 2024-573 (Authored by Honorable Ann Marjorie N. Revelo) "AN ORDINANCE CREATING THE PAGADIAN CITY SPORTS DEVELOPMENT OFFICE (CSDO) UNDER THE OFFICE OF THE CITY MAYOR, PROVIDING ITS PERSONNEL AND COMPOSITION, DEFINING THEIR DUTIES, FUNCTIONS AND RESPONSIBILITIES AND FOR OTHER PURPOSES" WHEREAS, Section 17, Article of the 1987 Constitution states that "the State shall give priority to education, science and technology, arts, culture, and sports to foster patriotism and nationalism, accelerate social progress, and promote total human liberation and development;" WHEREAS, Section 19 1, Article XIV, of the 1987 Constitution provides that "The State shall promote physical education and encourage sports programs, league competitions, and amateur sports, including training for international competition, to foster self-discipline, teamwork and excellence for the development of a healthy and alert citizenry;" WHEREAS, Section 2 of Republic Act No. 6847, also known as "The Philippine Sports Commission Act" states that "It is the policy of the State to promote physical education, encourage and sustain the development of sports in the country to foster physical fitness, self-discipline, teamwork and excellence for the development of a healthy and alert citizenry through a unified national sports promotion and development program, and that the establishment and creation of a single, unified and integrated national sports policy-making body shall further this objective."; WHEREAS, it shall be the policy of the City Government of Pagadian to promote an established and upgraded, comprehensive, competitive and dynamic sports program; WHEREAS, to realize the goal of strengthening the sports program of the city, there is a need for the City Government create the Pagadian City Sports Development Council, and provide for mechanisms thereof; NOW, BE IT ORDAINED AS IT IS HEREBY ORDAINED, by the 14th City Council of Pagadian, in session assembled that: BE IT ENACTED BY THE 14TH CITY COUNCIL OF PAGADIAN IN SESSION ASSEMBLED, THAT: SECTION 1. TITLE OF THE ORDINANCE. - This Ordinance shall be referred to as the "City Sports Development Office (CSDO) Ordinance." SECTION 2. DECLARATION OF POLICY. - It is hereby the declared policy of the City of Pagadian to develop a sports program in providing opportunities to bring out the best in the players and elevate them to a highest level in sports. In creating a City Sports Development Office (CSDO), it will encourage all sports organizations be it city-wide or barangay based level, to foster a development program in an atmosphere of cooperation and participation and to support implementors and its leaders toward capability-building; SECTION 3. CREATION OF PAGADIAN CITY SPORTS DEVELOPMENT OFFICE. - There shall be created the Pagadian City Sports Development Office (CSDO), under the Office of the City Mayor which will be headed by a Sports Director who shall be appointed by the City Mayor. SECTION 4. COMPOSITION. - The Pagadian City Sports Development Office (CSDO) shall be headed by a Sports Director with subordinate Secretary, Program Coordinators/Area Facilitators, Administrative Assistant, and Office Personnel, as may be proposed by the City Sports Director duly approved by the City Mayor and that, the CSDO shall regularly coordinate with the Pagadian City Local Youth Development Office. SECTION 5. POWERS, FUNCTIONS AND RESPONSIBILITIES. - The Pagadian City Sports Development Office (CSDO) shall be responsible in carrying out the mandate of this Ordinance. It shall be equipped with office facilities and manned by competent and efficient staff. The Pagadian City Sports Development Office (CSDO) office shall exercise any and all of the following specific powers and functions: a. To supervise, manage and administer the sports program of the City and the resources thereto; b. To formulate plans and approve Sports Development Program and strategies and evaluates sports activities of the City of Pagadian aimed at excelling in national and international sports competitions, and upon the approval thereof by the Local Chief Executive, facilitate the implementation; c. To provide Pagadian City athletes and coaches with technical assistance, exposure and access to high training standard by top-caliber athletes and mentors; d. To invite and engage the services of sports consultants and experts for the various forms of sports activities in the City; e. To create action teams to supervise the different sports programs of the City; f. To provide athletes, coaches with adequate sports facilities; g. To coordinate with and enlist all sports organizations in Pagadian City for a planned and concerted effort to realistically attain full implementation of all sports programs; h. To invite and bring in more sports stakeholders like individuals, civic/NGOs, private corporations, school and others to support every sports program in the City; i. To make Pagadian City known in the national and international sports community; j. To advise and endorse to the City Mayor, as the case may be, measures necessary for the improvement of the sports program of the City; k. To synchronize and integrate all ongoing sports activities, leagues or tournaments which may hereafter be planned out by the Office; l. Subject to the approval of the authorities concerned, the office may use all available vacant schoolyards and/or public playgrounds, barangay halls and other public facilities in the City of Pagadian suitable for the activities organized by the Office; m. To promulgate and adopt rules and regulations covering the internal and administrative functions of the same, as well, as rules and regulations for Sports tournaments/leagues directly promoted and supervised by the commission; n. To promulgate and adopt rules and regulations governing the granting of recognition and awards of those athletes and mentors who have done exemplary performance in regional, national and/or international sports competitions; and o. To exercise other powers and perform such other duties and functions as may be delegated by the City Mayor and/or prescribed by law and ordinance. SECTION 6. RESPONSIBILITIES OF THE CITY SPORTS DIRECTOR. - The Pagadian City Sports Director, is charged by this Ordinance with the following responsibilities: a. Direct all operations of the Office; b. Establish procedures for the effective operation of the Office; c. Submit to the City Mayor rules and regulations, and other guidelines which would require the Local Executive's attention including annual and periodic reports; d. Submit Semi-annual Report on the status of the Sports Program, regulations in force and other pertinent information and recommendations to the City Mayor for transmission to the City Council; e. Delegate any function and/or task to the competent staff of the Office; f. Arbitrate through appropriate committee on administrative cases of sports association; g. Prepares and submits the annual and supplemental budgets of the Office; h. Initiate in formulating, recommending Pagadian City Sports Programs in coordination with Pagadian City Sports Associations, barangays, schools, NGO's, civic and differently-abled groups; i. Subject to the approval of the City Mayor, arrange for incentives, donations, grants, gifts, and to implement sports plans, programs, and policies; j. Oversee the implementation of City Sports Development Program; k. Perform such other functions as may be assigned by the Office of the City Mayor. l. Represent Pagadian City in any provincial, regional, national or international forum, meeting and functions related to sports; and m. Is a regular member of the City Incentives Committee. SECTION 7. STAFF OF THE CITY SPORTS DIRECTOR. - The Office of the City Sports Director shall be supported by the following staff: A. Secretary B. Program Coordinators, Directory, Tournaments and Games C. Area Facilitators D. Promotions and Advocacy E. Information Dissemination and Communication F. Training and Development G. Infrastructure and Facility Development H. Research, Development and Linkages I. Sports Media Component SECTION 8. FUNCTIONS AND POWERS OF STAFF OF THE SPORTS OFFICE. - The staff of the Sports Office shall be charged and invested with the following powers and functions; A. Secretary i. Oversees the preparations of the minutes, agenda and records the attendance and proceedings of all meetings of the City Sports Development Office; ii. Disseminates notices of all meetings; iii. Performs all duties incidental to the office and those that may be delegated or assigned to her/him by the Sports Director; and iv. Responsible for the filing of all sports documents. B. Program Coordinators, Directory, Tournaments and Games i. Responsible for establishing and maintaining the roster of officers and members of the different sports association, in the barangays, NGOs, schools and civic organization. A list of the city players and their ranking must also be maintained. This directory shall include all pertinent data and information regarding all sports and games; and ii. Plan, initiate, facilitate and coordinates sports and games in all levels, i.e. local, provincial, regional and international. C. Area Facilitators Assist and coordinate with: i. Private or Public Educational Institutions including primary, secondary and tertiary ii. Barangays (SK and barangay sports) iii. NGOs (civic and industries) iv. Sports associations/clubs v. Government agencies vi. Differently-abled Groups (DAGs) D. Promotions and Advocacy Creates public awareness, through multi-media channels on the implemented sports programs and activities; ii. Address issues and public concerns related to the sports being disseminated and games being conducted; and iii. Conducts advocacy programs for the City Sports Commission. E. Information Dissemination and Communication i. Handles the dissemination and forwarding of information to specific associations/clubs, barangays and individuals who are involved in sports programs/activities; ii. Takes feedback form sports constituents for the sports commission; and iii. Plan, recommends and implements communication facilities for the Pagadian Sports Development Office. F. Training and Development i. Develops, recommends, initiates, coordinates and implements a more effective and systematic training program for the commission's staff, sports association's mentors, coaches and players; ii. Develops and maintain systematic data-based records and documentation on trainings; iii. Acquires and maintains training facilities including training materials and reference; and iv. Creates a pool of sports trainers in the different fields of sports. G. Infrastructure and Facility Development i. Plans, develop and maintains sports complex, building and ground, facilities and equipment for efficient use in sports activities; ii. Prioritizes the construction of the City Sports Development Office and the Pagadian City Sports Complex in the long-term; and iii. Assists and coordinates with sports associations, barangays, NGOs, schools on alternative use of venue for city-wide and/or big sports events and field practice/trainings. H. Research, Development and Linkages i. Conducts research for the continuous improvement of the athletes ranking career performance; ii. Undertakes access and establishes networks in the provincial, regional, international levels on sports; and iii. Keeps records and updates new development in sports. Social Media Component Focus on multimedia-conducive approach; Documentation of activities; Standardized Sports Publication; and Ensures media facilities and equipment. SECTION 9. REPEALING CLAUSE. - All previous ordinance, executive orders, rules and regulations or parts thereof which are inconsistent with this Ordinance are hereby repealed and modified accordingly. SECTION 10. SEPARABILITY CLAUSE. - If, for any reason or reasons, any part or provision of this Ordinance shall be held unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force and in effect. SECTION 11. EFFECTIVITY CLAUSE. - This Ordinance shall take effect immediately upon its approval. ENACTED AND APPROVED by the Sangguniang Panlungsod (14th City Council) during its 83rd Regular Session on 17 July 2024 at the SP Session Hall, 4th Floor City Commercial Center (C3), Santiago District, Pagadian City.
