ORDINANCE NO: 2023-555 (Sponsored by: Hon. Ronald Christopher Glenn L. Ariosa) "AN ORDINANCE IMPOSING RENTAL AND FIXING THE RATE ON THE USE OF RICE HARVESTER OWNED BY THE CITY GOVERNMENT OF PAGADIAN" WHEREAS, in line with the programs of the Department of Agriculture (DA), the Local Government Unit of Pagadian City has been the recipient of various agricultural equipment/machines intended to benefit the general public; WHEREAS, to ensure the continued serviceability and good operational condition of the said equipment/machines, there is a need to institute appropriate preemptive measures in order to ascertain the preservation and protection of the said apparatus; WHEREAS, Article 5, Section 153 and Section 154 of Republic Act 7160 provides that the local government units may impose and collect reasonable fees and charges for services rendered and may fix the rates for the operation of public utilities owned, operated and maintained by them; WHEREAS, the City Government of Pagadian intends to maximize the use of its resources and create additional source of income by renting out the rice harvester; Be it ordained by the Sangguniang Panlungsod (14th City Council) of Pagadian City in session assembled, that: SECTION 1. Title - This ordinance shall be known as "An Ordinance Imposing Rental and Fixing the Rate on the Use of Rice Harvester Owned by the City Government of Pagadian." SECTION 2. Schedule of Rate of Fees and Charges. - The herein schedule of rate of fees and/or charges shall be implemented in the use or availment of the equipment: ITEM NO. EQUIPMENT/MACHINE FEES 1 Rice Harvester 5,000/hectare ?SECTION 3. Payment. - The fee imposed herein shall be paid to the City Treasurer or his/her authorized representative. It is a first come first serve basis through booking at the City Agriculture Office for proper scheduling. SECTION 4. General provisions governing the rental and use of equipment - The rental and use of equipment indicated under Section 2 shall be in accordance with the following conditions: The rental rate shall be exclusive of fuel and oil consumption and remuneration of the equipment operator. The equipment shall not be used other than for the purpose for which it is intended. It shall not be used or taken outside the City of Pagadian to serve for the benefit of any person or entity not residing or establishing business in the city; The city government has the sole obligation to do such repair and preventive maintenance work on the equipment; A rental agreement shall be executed between the City Government and the renting party indicating therein, among others, all attendant terms and conditions governing said agreement. SECTION 5. SEPARABILITY CLAUSE. - If, for any reason, any section or provisions of this Ordinance shall be held to be unconstitutional or invalid by any court of competent jurisdiction, such judgement shall not affect or impair the other provisions, section, or parts thereof which shall continue to be in full force and effect. SECTION 6. REPEALING CLAUSE. - All ordinance, rules and regulations or parts herein in conflict with or inconsistent to the provisions of this Ordinance are hereby repealed and/or modified accordingly. SECTION 7. EFFECTIVITY. - This Ordinance shall take effect after posting for a period of Twenty-One (21) days in two (2) conspicuous places of the City of Pagadian. ENACTED AND APPROVED by the Sangguniang Panlungsod (14th City Council) during its 55th Regular Session on 15 November 2023 at the SP Session Hall, 4th Floor City Commercial Center (C3), Santiago District, Pagadian City.
