Co "AN ORDINANCE AMENDING SECTION 9 OF CITY ORDINANCE NO. 2023-550, ENTITLED "AN ORDINANCE PROVIDING PROTECTION FOR CHILDREN AT RISK IN ACCORDANCE WITH ALL THE EXISTING LAWS THAT PROTECT CHILDREN AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF", THEREBY IMPOSING A DIRECT AND SINGULAR PENALTY FOR EVERY INFRACTION THEREOF" WHEREAS, there is a need to amend the sanction for parents or guardian in order to strongly discourage the roaming of minors during the curfew hours set in City Ordinance No. 2016-358. WHEREAS, under Section 220 the Family Code of the Philippines, parents and those exercising parental authority have the right and duty to supervise their activities, recreation and association with others, protect them from bad company, and prevent them from acquiring habits detrimental to their health, studies and morals; and to perform such other duties as are imposed by law upon parents and guardians. WHEREAS, it is the policy of the City Government of Pagadian to impose a direct and singular penalty for every infraction of the curfew for minors in order to compel both parents and minors to solemnly and consciously observe the mandate of City Ordinance No. 2016-358. NOW THEREFORE, the Sangguniang Panlungsod of Pagadian City in session assembled do ordain, as it hereby ordains that: SECTION 1. Section 9 of the Ordinance is hereby amended as follows: "Sanction for Parents or Guardians. The parents or guardian shall be sued under the provisions of Section 10, Article VI of R.A. 7610 providing for "Other Acts of Neglect, Abuse, Cruelty, or Exploitations and other Conditions Prejudicial for the Child's Development" and/or provisions of P.D. 6-3 known as "The Child and Youth Welfare Code." SECTION 2. REPEALING CLAUSE. - City Ordinance No. 2016-358 is thereby amended accordingly. All other Ordinances, Resolutions, Implementing Rules and Regulations, Executive Orders, Memorandum Circulars and Administrative Orders or parts thereof which are inconsistent with any provisions of this Ordinance are hereby repealed or modified accordingly. SECTION 3. EFFECTIVITY CLAUSE. - This Ordinance shall take effect upon its publication for three (3) consecutive days in a newspaper of local circulations, in accordance with Section 188 of R.A. No. 7160, otherwise known as the Local Government Code of 1991.
