Ariosa "AN ORDINANCE AMENDING SECTIONS 22, 24 (5) & 28 (B) OF CITY ORDINANCE NO. 2019- 423 ENTITLED "AN ORDINANCE ADOPTING AN UPDATED PAGADIAN CITY INVESTMENTS, INCENTIVES AND PROMOTION CODE OF 2019" WHEREAS, there is an existing ordinance providing for incentives to prospective and existing investors in the City of Pagadian passed and approved in 2019 which was formulated to boost economic growth and development by increasing local capacities, encourage investment climate, promote productivity, generate employment, increase resources that will consequently improve the quality of lives of the locals, WHEREAS, with the current economic progress and development of the city and with the advent of its high urbanization, sprouting of business establishments is inevitable and in order to attract prospective bigger investors to establish large establishment in the city, there is a need to provide enticing additional incentives other than those provided under City Ordinance No. 2023-544; NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the Sangguniang Panlungsod of Pagadian, in session assembled that: Section 1. - Section 22 of City Ordinance No. 2019-423 be amended and shall hereinafter be read as follows, to wit: "Section 22. Types of Projects for Registration. - The following are the types of investment projects eligible for registration, provided they involve business activities included in the IPA List: New Projects; Expansion Projects; Modernization Projects; and Diversification Projects with the following additional requirements: Capitalization of at Least: P100 Million to P200 Million- Large A-Enterprise P201 Million to P500 Million- Large B Enterprise P501 Million to P1.2 Billion - Large C Enterprise Above P1.2 Billion - Large D Enterprise Employ at least 80% of non-technical personnel who are residents of Pagadian City; Comply with existing labor laws; and 30% of the product component are indigenous materials available in Pagadian City. Section 2. - Sub-Paragraph 5 of Section 24 thereof shall be amended to read as follows, to wit: "SECTION 24. Registration Procedures. x x x x x x x x x x x x x x x x x x x x x x x x x x x The PEIIC shall issue a non-refundable filing fee, an Order of Payment of the necessary fees shall then be issued by the PEIIC which shall be paid to the Local Treasurer's Office. 5.a That the following non-refundable filing fee rate shall be paid together with the required documents for registration: P100,000.00 - For enterprises with a capitalization of 100 Million to 200 Million (Large A Enterprise); P200,000.00 - For enterprises with a capitalization of 201 Million to 500 Million (Large B Enterprise) P300,000.00 - For enterprise with a capitalization of 501 Million to 1.2 Billion (Large C Enterprise) P400,000.00 - For enterprises with a capitalization above P1.2 Billion (Large D Enterprise) x x x x x" Section 3. - Sub-Paragraph (b) of Section 28 of City Ordinance No. 2019-423 shall be amended which shall now be read as follows: "SECTION 28. LOCAL FISCAL INCENTIVES. - x x x x x x x x x Tax Exemption Privileges through ordinances duly approved pursuant to Section 192 of the LGC as defined in Article 282 of the LGC Implementing Rules and Regulations. The following are specific exemptions and privileges given to large enterprise based on their classification, viz: LARGE A Enterprise Full exemption from: Locational Clearance Fees, Building Permit fees, and other charges; and Occupancy Permit Fees and other fees and charges Fully Exempt for a period of two (2) years from the start of the operation on Mayor's Permit fees, business taxes/fees and charges except on regulatory fees: Business Manager's Fee; SECTION 2. Repealing Clause. All ordinances, rules, order and regulations or parts thereof contrary to or inconsistent with any of the provisions of this ordinance are hereby amended, modified and/or repealed accordingly. SECTION 3. Separability Clause. If any provision of this Ordinance or the application thereof to any person, barangay or circumstances is held invalid, the remainder of this ordinance and the application of such provision to other persons or circumstances shall not be affected thereby. SECTION 4. Effectivity. This ordinance shall take effect immediately upon its approval.
