Co "AN ORDINANCE PROVIDING FIRE SAFETY REQUIREMENTS FOR TECHNOLOGY-SOLUTION RETAIL OUTLETS (TSRO) IN THE CITY OF PAGADIAN" WHEREAS, pursuant to Section 5 (a) of Republic Act No. 9514, also known as the Fire Code of the Philippines of 2008, the Chief, Bureau of Fire Protection (BFP), with the approval of the Secretary of the Department of the Interior and Local Government (DILG), is authorized to issue implementing rules and regulations, and prescribe standards, schedules of fees/fire service charges, and administrative penalties related to fire safety; WHEREAS, the sale of liquid fuels such as gasoline and diesel in "bote-bote" or small containers is prohibited under DOE Department Circular No. DC-201-11-0011 due to the associated fire, security, health, and environmental risks; WHEREAS, Technology-Solution Retail Outlets (TSRO), also known as fuel vending machines, have emerged as a potential solution to the risks posed by "bote-bote" businesses; WHEREAS, there is a need to establish guidelines on the fire safety requirements for TSROs in order to ensure the safety of the public and the environment; NOW, THEREFORE, be it ordained by the 14th City Council of Pagadian in session assembled: SECTION 1. TITLE. This ordinance shall be known as the "Fire Safety Requirements for Technology-Solution Retail Outlets (TSRO) Ordinance of Pagadian City." SECTION 2. PURPOSE. The purpose of this ordinance is to provide guidelines on the fire safety requirements for Technology-Solution Retail Outlets (TSRO) in Pagadian City. SECTION 3. SCOPE AND COVERAGE. This Ordinance shall apply to the construction, storage, handling, and use of flammable and combustible liquids for Technology-Solution Retail Outlets (TSRO) within the jurisdiction of Pagadian City. SECTION 4. GENERAL GUIDELINES. 4.1 General Requirements: SECTION 6. SEPARABILITY CLAUSE. Should any provision, section or part of this Ordinance be adjudged or declared illegal or unconstitutional by any court of competent jurisdiction, such judgment shall not affect or impair the remaining provision, sections or part which shall continue to be in force and effect. SECTION 7. REPEALING CLAUSE. All ordinances, rules and regulations, or part thereof, in conflict with or inconsistent with any provision of this Ordinance, are hereby repealed, amended, or modified accordingly. SECTION 8. EFFECTIVITY CLAUSE. This Ordinance shall take effect after posting certified true copies of the same duly approved by the City Mayor in three (3) conspicuous places of the City for a period of three consecutive weeks and distribution of certified true copies to all punong barangays, LGU heads of offices, this City.
