ORDINANCE NO: 2023-538 Sponsor: Honorable Patrisha Kaye N. Asugas "AN ORDINANCE AMENDING, BY ADDITION, SECTION 5 OF ARTICLE V OF CITY ORDINANCE NO. 2023-538 ENTITLED "AN ORDINANCE PROVIDING FOR THE GUIDELINES IN THE REGISTRATION OF ALL VESSELS WITH GROSS TONNAGE OF THREE (3) TONS AND BELOW AS DEVOLVED TO THE LOCAL GOVERNMENT UNITS BY VIRTUE OF EXECUTIVE ORDER NUMBER 305" WHEREAS, Executive Order (EO) No. 305 and Section 5.3 of its Implementing Guidelines directed all Local Government Units (LGUs) to require all applicants for registration of fishing vessels that are three gross tonnage (3GT) and below to secure a clearance from PNP Maritime Group certifying that the fishing vessel is not involve in any criminal offense; WHEREAS as practice, Fishing Vessel Clearance was being issued already by the Philippine National Police (PNP) Maritime Group Regional Maritime Unit 9 Zamboanga del Sur MARPSTA prior to the approval of the vessel registration by the City Government; WHEREAS, in order to preclude any possible conflict between the provisions under Executive Order No. 305 and City Ordinance No. 2005-246, it is thus necessary to institute amendment to the local ordinance to conform with the national directive, hence, this amendatory ordinance; NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod (14th City Council) of Pagadian City in session assembled that: SECTION 1. Section 5, Article V of City Ordinance No. 2005-246 is hereby amended which shall now be read as follows, to wit: "ARTICLE V - ORGANIZATION & IMPLEMENTATION SECTION 5 - The Office of the City Mayor is tasked to implement the provisions of this Ordinance through the Motorized Tricycle Regulatory Unit, the Office of the City Agriculturist and the Office of the Philippine National Police (PNP) Maritime Group Regional Maritime Unit 9 Zamboanga del Sur MARPSTA as an added function of the said offices. These offices will perform the following duties, to wit: The MTFRU shall enlist all sea vessels with gross tonnage of three (3) tons and below after these have been evaluated/inspected by the competent personnel of the Office of the City Agriculturist; The MTFRU in coordination with the Office of the City Agriculturist shall attend to the documentation for the registration and proper identification of all sea vessels either motorized or non-motorized and whether for hire or not for hire; Secure Fishing Vessel Clearance from the Office of the Philippine National Police (PNP) Maritime Group Regional Maritime Unit 9 Zamboanga del Sur MARPSTA; and Submit all processed applications for registration/proper identification with all the supporting prescribed documents to the Honorable City Mayor for his approval." SEPARABILITY CLAUSE - If any provision or part of this Ordinance is declared invalid by a competent court, other provision or part thereof not affected shall continue to be in full force and effect. REPEALING CLAUSE - All previous ordinances, local issuances or rules inconsistent with the provisions of this Ordinance are hereby repealed, amended or modified accordingly. EFFECTIVITY CLAUSE - This Ordinance shall take effect ten (10) days after its publication in a local newspaper of general circulation in the city. , ENACTED AND APPROVED by the Sangguniang Panlungsod (14th City Council) during its 40th Regular Session on 05 July 2023 at the SP Session Hall, 4th Floor City Commercial Center (C3), Santiago District, Pagadian City.
