AN ORDINANCE CREATING THE PAGADIAN CITY SUPER HEALTH CENTER LOCATED AT BARANGAY TIGUMA, PAGADIAN CITY

	WHEREAS, the 1987 Constitution, under Section 15, Article II, provides that the State shall protect and promote the right to health of the people and instill health consciousness among them. In the same vein, Section 11, Article 13 provides that the State shall adopt an integrated and comprehensive approach to health development which shall endeavor to make essential goods, health and other social services available to all the people at affordable cost;

	WHEREAS, health center facilities are vital components of local government units in the delivery of basic health services for common diseases, maternal and child health care and other basic health services including health education and information to the needy residents;

	WHEREAS, the delivery of the most basic health services will be most effective if a particular area has a super health center which has more extensive health services than an ordinary health center;

	WHEREAS, the Pagadian City Super Health Center shall primarily serve Barangay Tiguma with approximately 12,953 residents and secondary catchment areas (Contiguous to Barangay Tiguma) Barangay Manga with approximately 3,094 residents, Barangay Lenienza with approximately 3,827 residents, Barangay Bulatok with approximately 3,972 residents, Tawagan Sur with approximately 2,483 residents, Barangay Muricay with approximately 3,313 residents and Barangay White Beach with approximately 1,708 residents;

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of Pagadian (14th City Council), Zamboanga del Sur that:

SECTION 1.	Creation and Establishment of the Pagadian City Super Health Center. - There shall be created and established a PAGADIAN CITY SUPER HEALTH CENTER at Barangay Tiguma, Pagadian City, under the operational supervision and control of the City Health Office.

SECTION 2.	Infrastructure Requirements In the Establishment of the Pagadian City Super Health Center. - The City Engineer's Office in coordination with the Department of Health-Health Facility Enhancement Program (HFEP) shall determine the infrastructural requirements in the establishment of the Pagadian City Super Health Center. For this purpose, it shall be the duty of the City Engineer's Office to secure the Permit-To-Construct (PTC) under the Regulation, Licensing and Enforcement Division (RLED) of the Department of Health.

SECTION 3.	Fund Sources. - The Capital Outlay for the Infrastructure and Medical Equipment necessary for the operation of the Pagadian City Super Health Center shall be sourced out from the General Appropriations Act for Fiscal Year 2022 under the Health Facilities Enhancement Program (HFEP) of the Department of Health Zamboanga Peninsula-Center for Health Development, where the amount of Six Million Five Hundred Thousand (P6,500,000.00) Pesos was appropriated for the infrastructure project and Five Million (P5,000,000.00) Pesos for medical equipment.

SECTION 4.	Duty and Responsibility of the City Health Officer. - The City Health Officer, having the control and supervision over the Pagadian City Super Health Center, shall be responsible for designating and assigning the necessary medical and other administrative personnel for the effective and efficient operation of the said health center. Initially, the existing personnel of the City Health Office shall be assigned/designated to man the operation of the Pagadian City Super Health Center. The City Health Officer, if necessary, shall recommend to the City Mayor and the City Council for the creation of additional medical, operational and/or administrative personnel in accordance to licensing standards.

SECTION 5.	Licensing. - The City Health Officer shall ensure full compliance of Pagadian City Super Health Center as a licensed Primary Care Facility. Add on services such as Clinical Laboratory shall comply with the licensing requirement set by the Regulations, Licensing and Enforcement Division (RLED) of the Department of Health while the Pharmacy shall comply with the licensing requirement set by the Bureau of Food and Drug Administration (BFAD). 

Relatedly, the Pagadian City Super Health Center must be a Philhealth Accredited facility.

SECTION 6.	Allocation of One Percent (1%) of the City's Total Budget for Health. - The City Government shall allocate at least One Percent (1%) of the city's total budget for health every year for the continuing maintenance of the infrastructure.

SECTION 7. Separability Clause. - If any part of this Ordinance is declared not valid, unconstitutional or unlawful, such declaration shall not affect or impair the remaining provisions or sections or parts thereof, which shall remain or continue to be in full force and effect.

SECTION 8. EFFECTIVITY. - This Ordinance shall take effect fifteen (15) days following its posting in two (2) conspicuous places of the city.
