AN ORDINANCE ESTABLISHING THE PAGADIAN CITY HALAL INDUSTRY DEVELOPMENT AND MONITORING COUNCIL, DEFINING ITS PURPOSE AND FUNCTIONS FOR THE GROWTH AND DEVELOPMENT OF HALAL INDUSTRY IN THE CITY AND OTHER RELATED PURPOSES
WHEREAS, Republic Act No. 9997, otherwise known as the "National Commission on Muslim Filipinos (NCMF) Act of 2009" mandated the NCMF to preserve and develop the culture, tradition, institutions, and well-being of Muslim Filipinos, and to accomplish this mandate, it is empowered, among others to promote and develop the Philippine Halal Industry for the utmost benefits of Muslim Filipinos and in partnership with appropriate agencies, individuals and institutions here and abroad;
WHEREAS, Section 2, R.A. 10817 further states that it is the policy of the State to protect consumers and users of Halal products, processes, and services from unscrupulous and unfair agricultural, manufacturing and trade practices, it is also the  policy of the state to develop and promote Halal industries as a mode of achieving equity and justice among our farmers, producers, and increasing employment opportunities for the domestic labor force;
WHEREAS, Chapter 7, Section 60, of the Product Standardization & Consumer Safety of Republic Act No. 8435, otherwise known as the "Agricultural & Fisheries Modernization Act of 1997 declared that, "it is the policy of the State to involve all sectors in the production, processing, distribution and marketing of food and non-food agricultural and fisheries products shall adhere to, and implement the use of product standards, so to ensure consumer safety and promote the competitiveness of agricultural fisheries products';
WHEREAS, Republic Act No. 7394, otherwise known as the "Consumer Act of the of 1992" likewise declares that "it is the policy of the State to protect the interest of consumer, advance his general welfare and to establish standards of conduct for business and industry';
WHEREAS, Republic Act No. 3740, otherwise known as an "Act to Penalize Fraudulent Advertising, Mislabeling or Misbranding of Any Product, Stock Bond, etc. declared that "it shall be unlawful for any person, firm, or corporation, either as principal or agent, to display, sell, barter, or exchange or to offer to expose for display, sale, barter or exchange in the Philippines, or to possess with intent to sell, or to cause to be sent, carried, or bought for display, sale, barter or exchange to any foreign country into the Philippines, or from the Philippines into any foreign country, any article which is falsely packed, labeled, marked, or branded, or is packed, labeled, marked or branded in such way a way to misrepresent the character, amount value, contents, properties, or condition of the article contained or of the materials of which the article is composed, or any article which is accompanied by advertising matter which misrepresents the character, amount, value, contents, properties or condition of the article advertised, or of the materials of which it is composed whether or not the article or the container thereof is mislabeled, misrepresented, or misbranded";
WHEREAS, Section 32, of Republic Act No 9710 otherwise known as Magna Carta for provides the availability of Halal food in regular schools shall be ensured;
WHEREAS, Section 2 (d) of Republic Act No 9593 or the Tourism Act of 2009, provides that the State shall seek to create a favorable image of Philippines with the International Community, thereby strengthening the attraction as a tourism destination and eventually paving the way for other benefits that may result to positive global view of the country;
WHEREAS, to align the effort of the City Government of Pagadian and the private sector to the national government's thrusts and policies, there is a need to create the Pagadian Industry Development and Monitoring Council and to define its purpose and functions in order to ensure the growth and development of the halal industry in the City.
NOW THEREFORE, BE IT ENACTED AS IT IS HEREBY ENACTED, by the Panlungsod of the City of Pagadian in regular session assembled that:
SECTION 1. TITLE. Be it ordained that this Ordinance shall be known as the "HALAL DEVELOPMENT AND MONITORING COUNCIL ORDINANCE OF THE CITY OF PAGADIAN".
SECTION 2. DECLARATION OF POLICY AND PURPOSE. The purpose of this council is to promote Halal tourism, trade and investment for the growth and development of the Halal industry in Pagadian City. Furthermore, it is the policy of the City to protect the interest of Muslim populace and safely ensure compliance with standards of good manufacturing and hygienic practices by institutionalizing a Halal system for food, non-food products and services in recognition and respect to the rich tradition and way of life of the Filipina Muslims;
SECTION 3. DEFINITION OF TERMS. For the purpose of this ordinance, the
following terms are defined:
(a) Business Establishments - refers to all establishments that produce, manufacture, process, supply and sell Halal food and raw food products.

SECTION 6. FUNCTIONS. The Council will have the following functions:
14. Come up with a draft of necessary Halal-related ordinance in the city and submit to the Sangguniang Panlungsod of Pagadian, and;
15. Exercise and perform other tasked and functions as may be necessary.
SECTION 7. SECRETARIAT AND ITS FUNCTIONS. The office of the City Tourism shall act as the Secretariat of the Council and shall have the following functions:
1. Responsible for the recording of the meetings of the Council;
2. Keep file of all the records of the Council;
3. Call upon of the Council to convene for a meeting;
4. Exercise and perform such other functions inherent in the office.
SECTION 8. CONDUCT OF REGULAR MEETINGS AND CREATION OF COMMITTEES. The Council may meet at least once every quarter and hold special meetings as the need arises. The Council may also create committees in support of its plans and programs, the duties, and functions of which will be determined by the members.
SECTION 9. FUNDING REQUIREMENTS. The Council will allocate funds to support its activities, plans, and programs which may be drawn from its members, private organizations. Pagadian-based companies, national government agencies, donor agencies, and other stakeholders of the Halal industry through the provision of grants and sponsorships. The City Government of Pagadian may also provide assistance in the programs and activities of the Council.
SECTION 10. SEPARABILITY CLAUSE. Should any provision, section or part of this Ordinance be adjudged or declared illegal or unconstitutional by any court of competent jurisdiction, such judgement shall not affect or impair the remaining provision, sections or part which shall continue to be in force and effects.
SECTION 11. REPEALING CLAUSE. All ordinances, rules and regulations, or part thereof, in conflict with or inconsistent with any provision of this Ordinance, are hereby repealed, amended, or modified accordingly.
SECTION 12. EFFECTIVITY CLAUSE. This Ordinance shall take effect upon approval.
ENACTED AND APPROVED by the Sangguniang Panlungsod (14th City Council) during its 17th Regular Session on 16 November 2022 at the SP Session Hall, 4th Floor City Commercial Center (C3), Santiago District, Pagadian City.
