Fernandez "AN ORDINANCE ADJUSTING THE RATE OF FEE FOR THE COMMON UTILITY SERVICE AREAS (CUSA) TO ONE HUNDRED FIFTY (P150.00) PESOS PER SQUARE METER PER MONTH THEREBY, IN EFFECT, MODIFYING SUB-PARAGRAPH OF PARAGRAPH (a), SECTION 1 OF CITY ORDINANCE NO. 2022-520 WHICH AMENDED CITY ORDINANCE NO. 2022-520, ENTITLED: "AN ORDINANCE ESTABLISHING THE GUIDELINES AND POLICIES GOVERNING THE OPERATION AND MANAGEMENT OF THE CITY COMMERCIAL CENTER OF THE CITY GOVERNMENT OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF," WHEREAS, Sub-Paragraph of Paragraph (a) of Section 1 of City Ordinance No. 2010-311 provides for the rate of the Common Utility Service Areas (CUSA) in the amount of Thirty (P30.00) Pesos to cover the cost of electricity consumption of the City Commercial Center (C3) out of the common lightings, elevators, escalators, air-conditioning and other electrical equipment, among others; WHEREAS, due to the sudden increase in the electricity rate imposed by the city's public utility provider, the City Government of Pagadian through the C3 Management has expressed concern and alarm over the inadequacy of the rate for the Common Utility Service Areas (CUSA) to cover the electricity cost every month; WHEREAS, in an effort to address the foregoing predicament and, to initiate appropriate and prudent fiscal management to correct and remedy the prevailing practice of the past in subsidizing the variance of the C3's electricity cost, it is but prim and proper to adjust the rate of the Common Utility Service Areas (CUSA) in the City Commercial Center (C3); NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod (14th City Council) of Pagadian City in session assembled that: SECTION 1. Sub-Paragraph of Paragraph (a) of Section 1 of City Ordinance No. 2010-311 is hereby modified, which shall now be read as follows, to wit: "SECTION 1. X X X RENTALS of Stalls and Kiosks. X X X X X X X X X X X X X X X X X X The new uniform rate for Common Utility Service Areas (CUSA) is One Hundred Fifty (P150.00) Pesos per square meter per month. This new rate is applicable and collectible for all stalls in the City Commercial Center (C3), whether occupied or not. However, the City Mayor, upon review and evaluation and, finding necessity as the operation of the C3 so requires, through the recommendation of the C3 Board, is authorized to increase the rate of CUSA. SECTION 2. Implementing Guidelines. - To promote and preserve stability and balance in the interest of all the stakeholders in the City Commercial Center (C3), the City Mayor is hereby granted authority to implement the increase of the rate of the CUSA gradually. SECTION 3. Repealing Clause. Pertinent provisions of City Ordinance Nos. 2009-288 and 2010-311 are hereby repealed and/ or modified accordingly; SECTION 4. Effectivity Clause. This Ordinance shall take effect fifteen (15) days after the completion of posting in two (2) conspicuous places in the City of Pagadian.
