ORDINANCE NO: 2022-519 (Authored by: Honorable Ann Marjorie N. Revelo) "AN ORDINANCE PROMULGATING THE GUIDELINES ON THE GRANT OF MONETARY INCENTIVES TO ANY INDIVIDUAL, PAIR, GROUP OR TEAM, INCLUDING THEIR RESPECTIVE COACHES OR TRAINERS, WHO HAVE BEEN DECLARED AND RANKED WITHIN THE TOP THREE (3) WINNERS OF ANY SPORTS, SKILLS, ARTS AND ACADEMIC COMPETITIONS IN THE REGIONAL, NATIONAL AND INTERNATIONAL EVENTS AND APPROPRIATING FUNDS THEREFOR" WHEREAS, pursuant to Republic Act No. 19699 otherwise known as the "National Athletes and Coaches Benefits and Incentives Act", it is thus the policy of the national government to give incentives to athletes who are winners or medalists in legitimate local and international sporting events in recognition of their efforts, sacrifices and determination in bringing honor and prestige to our country, in general; WHEREAS, in view of the foregoing Act, this body deems it essential to adopt the same as a policy of the City Government of Pagadian to grant monetary incentives to any individual, pair, group or team who have excelled in any sports, skills, arts and academic competitions as a gesture of recognizing, inspiring, motivating and encouraging resident-delegates for giving honor, pride and distinction not only to themselves, their families, but more importantly to the City of Pagadian; NOW, THEREFORE, in view of the forgoing, be it ordained by the Sangguniang Panlungsod (14th City Council) of Pagadian in session assembled that: SECTION 1. Title. - This Ordinance shall be known as "AN ORDINANCE PROMULGATING THE GUIDELINES ON THE GRANT OF MONETARY INCENTIVES TO ANY INDIVIDUAL, PAIR, GROUP OR TEAM, INCLUDING THEIR RESPECTIVE COACHES OR TRAINERS, WHO HAVE BEEN DECLARED AND RANKED WITHIN THE TOP THREE (3) WINNERS OF ANY SPORTS, SKILLS, ARTS AND ACADEMIC COMPETITIONS IN THE REGIONAL, NATIONAL AND INTERNATIONAL EVENTS AND APPROPRIATING FUNDS THEREFOR" SECTION 2. Declaration of Policy. - it is hereby declared the policy of the City of Pagadian to extend financial incentives to deserving Pagadianon athlete/contender/contestant for giving honor to the City of Pagadian in various legitimate competitions in the fields of sports, academics and skills competitions. SECTION 3. Definition of Terms. - as used in this ordinance, the following terms shall be defined as follows: Sports Competitions - refer to various sports competitions that are accredited or sanctioned by the following government agencies: Department of Education Philippine Olympic Committee Philippine Sports Commission Department of the Interior and Local Government Commission on Higher Education Sports competitions may be categorized as: Regional Sports Competitions including, but not limited to, the following: Zamboanga Peninsula Regional Athletic Association (ZPRAA Meet) Regional Athletic Meet National Sports Competitions including, but not limited to, the following: Palarong Pambansa Philippine National Youth Games (Batang Pinoy) National Open National Games Special Olympics For international and worldwide levels of sports competition which include regular sports competitions sanctioned by the International Olympic Committee and/or the International Sports Federations such as: Summer Olympics World Championship of respective sports Asian Games Asian Championship of respective sports SouthEast Asian Games (SEA Games) ASEAN Championship of respective sports Special Olympics Skills Competitions - refer to the multi-level skills competitions which aim to recognize the skills excellence of young skilled workers and graduates of technical vocational schools and training centers. Skill competitions must have been duly organized and/or sanctioned/authorized or accredited by the Technical Education and Skills Development Authority (TESDA). For Purposes of this Ordinance, the following are the Level of Skills Competition: Regional Skills Competition National Level ASEAN Level World/International Level Arts Competition - refer to creative competitions showcasing artworks. It encompasses a wide range of art forms including, but not limited to, music, dance, film, fine art, literature, poetry and visual arts. Art competitions must have been duly organized and/or sanctioned/authorized or accredited by the National Commission for Culture and the Arts (NCCA). For Purposes of this Ordinance, the following are the Level of Skills Competition: Regional Festival of Arts National Level World/International Level Academic Competitions - refer to the academic related competitions in the national, international or worldwide levels and are duly organized by national government agencies for competitions conducted within the country while participation in the International and Worldwide competitions must have been permitted and/or authorized by the concerned national government agency. SECTION 4. Limitations. - In reference to Sports Competitions, exhibition games or any events in which there is no competitive value or any significant kind to any competitor regardless of the outcome are not included. SECTION 5. Number of Grantees. - The number of grantees under this Program depends on how many have qualified within the requirements set forth in this Ordinance. SECTION 6. Qualification of Grantees. - In order to be qualified under this Program, the grantee must possess the following qualifications, to wit: A bona fide resident of Pagadian City for at least one (1) year or residing in the city as boarder in case of in-school-youth (lSY) for at least two (2) years and must have duly represented the City of Pagadian in the competitions he/she had participated; Must have informed the City Incentive Committee through writing of his/her participation and that he/she is an official representative of the city and/or the country in a particular competition before the actual competition for records purposes; Must have been duly certified by the City Incentive Committee that the grantee(s) have satisfactorily submitted and have passed the basic requirements set forth in this Ordinance through an appropriate resolution of the City Incentive Committee; For coaches and/or trainers, the following conditions must be followed to avail of such grant under this Program: e.1 For Regional and National Competitions: e.1.1 He/she must be a Filipino citizen; SECTION 7. The City lncentive Committee. - There shall be created the City lncentive Committee, which is primarily tasked to judiciously screen applicants based on the qualifications set forth in this Ordinance and its implementing rules and regulations. The City Incentive Committee shall be composed of the following, viz: Chairperson : City Mayor Vice Chairperson : City Vice Mayor Members : Chairperson-SP Committee on Sports (in case of sports) Chairperson-SP Committee on Education (in case of academic excellence award) Chairperson-SP Committee on Trade and Industry (in case of skills excellence award) Chairperson-SP Committee on Tourism (in case of Arts) Chairperson-SP Committee on Finance and Appropriations City Schools Division Superintendent or his/her duly authorized representative (in case of Elementary, High School, Junior and Senior High students) Regional Director-Commission on Higher Education or his duly authorized representative (in case of college students) City Budget Officer The City Planning and Development Coordinator's Office shall serve as the Secretariat of the City Incentive Committee. SECTION 8. Amount of Incentives. - (a) For individual sports, skills and academic competitions for the regional, national or international levels of competitions, qualified grantees shall be entitled to receive the following cash incentives: Regional Competitions 1st Place/Gold Medalist - Php 3, 000.00 2nd Place/Silver Medalist - Php 2, 000.00 3rd Place/Bronze Medalist - Php 1, 000.00 National Competitions 1st Place/Gold Medalist - Php 5, 000.00 2nd Place/Silver Medalist - Php 3, 000.00 3rd Place/Bronze Medalist - Php 2, 000.00 International Competitions ASEAN 1st Place/Gold Medalist - Php 10, 000.00 2nd Place/Silver Medalist - Php 7, 000.00 3rd Place/Bronze Medalist - Php 5, 000.00 ASIAN 1st Place/Gold Medalist - Php 20, 000.00 2nd Place/Silver Medalist - Php 15, 000.00 3rd Place/Bronze Medalist - Php 10, 000.00 WORLD 1st Place/Gold Medalist - Php 50, 000.00 2nd Place/Silver Medalist - Php 30, 000.00 3rd Place/Bronze Medalist - Php 20, 000.00 (b) For pair or group/team sports, skills or academic competitions, grantees shall be entitled to receive the following incentives for the whole group: Regional Competitions 1st Place/Gold Medalist - Php 5, 000.00 2nd Place/Silver Medalist - Php 4, 000.00 3rd Place/Bronze Medalist - Php 3, 000.00 National Competitions 1st Place/Gold Medalist - Php 10, 000.00 2nd Place/Silver Medalist - Php 7, 000.00 3rd Place/Bronze Medalist - Php 5, 000.00 International Competitions ASEAN 1st Place/Gold Medalist - Php 20, 000.00 2nd Place/Silver Medalist - Php 15, 000.00 3rd Place/Bronze Medalist - Php 10, 000.00 ASIAN 1st Place/Gold Medalist - Php 50, 000.00 2nd Place/Silver Medalist - Php 30, 000.00 3rd Place/Bronze Medalist - Php 20, 000.00 WORLD 1st Place/Gold Medalist - Php 100, 000.00 2nd Place/Silver Medalist - Php 50, 000.00 3rd Place/Bronze Medalist - Php 30, 000.00 (c) Only the qualified grantee/s shall be entitled to receive the financial incentive. The grant shall be non-transferrable. (d) Coaches/Trainers of qualified grantees shall receive financial incentive equivalent to ten percent (10%) of the financial incentive received by the grantee(s). SECTION 9. Funds for the Program. - To carry out the provisions of this Ordinance, the amount of One Million ( 1,000,000.00) Pesos shall be appropriated from the General Fund of the city as the initial fund for this Program. The amount of Three Hundred Thousand ( 300,000.00) Pesos shall be appropriated annually for replenishment. Supplemental budget should be done in supplemental appropriation. SECTION 10. Issuance of Implementing Rules and Regulations. - The City Incentive Committee shall formulate and issue the implementing Rules and Regulations (IRR) as may be necessary to carry out the provisions of this Ordinance. SECTION 11. Separability Clause. - The provisions of this Ordinance are hereby declared separable and if one or more provisions are held invalid or unconstitutional, the remainder, or any provision hereof not affected, shall remain valid and effective. SECTION 12. Repealing Clause. - All ordinances, resolutions, rules and regulations inconsistent with or contrary to the provisions of this Ordinance are hereby repealed, amended or modified accordingly. SECTION 13. Effectivity. - This Ordinance shall take effect immediately upon approval and after fifteen (15) days from posting in at least (2) conspicuous places in the City of Pagadian.
