"AN ORDINANCE CREATING THE PAGADIAN CITY YOUTH DEVELOPMENT OFFICE (PCYDO) AS A DIVISION UNDER THE OFFICE OF THE CITY MAYOR AND THE PAGADIAN CITY YOUTH DEVELOPMENT COUNCIL (PCYDC), PROVIDING ITS PERSONNEL COMPLEMENT AND COMPOSITION, DEFINING THEIR DUTIES, FUNCTIONS AND RESPONSIBILITIES AND FOR OTHER PURPOSES"
WHEREAS, it is the policy of the City Government of Pagadian to recognize and encourage the participation of the youth in nation-building, particularly in the legislation and enforcement of programs, projects and activities that will promote and protect their interest and well-being;
WHEREAS, pursuant to Chapter III, Section 23 of Republic Act No. 10742 otherwise known as the "Sangguniang Kabataan Reform Act of 2015," the Department of the Interior and Local Government (DILG) issued Memorandum Circular No. 2017-36 which mandates the creation of a Local Youth Development Office (LYDO) and the organization of a Local Youth Development Council (LYDC) in every province, city, and municipality to ensure the wide and multi-sectoral youth participation in local governance;
WHEREAS, in view of the foregoing mandate, it is thus appropriate and in order to establish and/or create the Local Youth Development Office under the Office of the City Mayor as well as the constitution of the Local Youth Development Council in the City of Pagadian purposely to develop and advance youth participation and contribution in the over-all development of the city;
NOW, BE IT ORDAINED, AS IT IS HEREBY ORDAINED, by the 13th City Council of Pagadian, in Session assembled that:
SECTION 1. Title. - This ordinance shall be referred to as the "Pagadian City Local Youth Development Ordinance of 2022."
SECTION 2. Definition of Terms - As used in this Ordinance, the following terms shall mean:
Youth - refers to those persons whose age ranges from fifteen (15) to thirty (30) years as provided under Republic Act No. 8044.
Local Youth Development Office - shall refer to the youth office in every local government unit headed by a local youth development officer whether appointed or designated by the local chief executive.
Commission - shall refer to the National Youth Commission created under Republic Act No. 8044.
Local Chief Executive - shall refer to the city mayor.
Sangguniang Panlungsod - refers to the Sangguniang Panlungsod of Pagadian as the legislative body of the local government unit.
Youth Organizations - shall refer to those organizations whose membership/composition are the youth, and
Youth-serving Organizations - shall refer to those registered organizations whose principal programs, projects and activities are youth-oriented and youth released.
SECTION  3. Creation. - There is hereby created, under the Office of the City Mayor, the Pagadian City Youth Development Office that shall be primarily responsible for the herein functions, to wit:
In accordance with Section 24 (d) of the Rules and Regulations Implementing R.A No. 10724, register and verify youth and youth-serving organizations (Subject to the revitalized Youth Organizations' Registration Program (YORP) guidelines;
Provide technical assistance to the Pagadian City Youth Development Office in the formulation of the Pagadian City Youth Development Plan (PCYDP);
Facilitate the election of the Pagadian City Youth Development Council (PCYDC) representatives;
Serve as secretariat to the Pagadian City Youth Development Council (PCYDC);
Conduct the mandatory and continuing training of SK Officials and PCYDC members in accordance with the programs jointly designated and implemented by the National Youth Commission (NYC) and the DILG. The PCYDO and/or his or her staff shall apply for accreditation from the NYC in order for them to conduct the mandatory and continuing training programs of SK officials and PCYDC members; 
Provide technical, logistical and other support in the conduct of the mandatory and continuing training programs, and such other programs of the NYC and DILG;
Coordinate with the NYC with regards to youth programs within their jurisdiction;
Perform such other functions as may be prescribed by law, ordinance, or as the Local Chief Executive, the DILG, or the NYC may require.
SECTION 4. Appointment/Designation of the Pagadian City Youth Development Officer; Duties and Responsibilities. - The Pagadian City Youth Development Office (PCYDO) shall be manned by Pagadian City Youth Development Officer who shall be appointed/designated by the City Mayor and shall perform the duties and responsibilities provided under Republic Act No. 10742. 
The City Government, upon the recommendation of the Pagadian City Youth Development Officer, may provide additional staffing requirements in the Pagadian City Youth Development Office (PCYDO) and shall be appointed by the City Mayor in whatever status deemed appropriate and in accordance with civil service rules and regulations.
SECTION 5. Appointment and Qualification. - In addition to the requirements prescribed by the Civil Service Commission (CSC), the Pagadian City Youth Development Officer who shall be appointed by the City Mayor to the position created and provided under Section 4 hereof, must at least possess the requirements and qualifications on education, eligibility and work experience hereunder stipulated, to wit:
Preferably not more than thirty years of age at the time of his/her appointment;
Be of good moral character; 
Must have acquired experience in youth development affairs or involvement in youth or youth-serving organizations for at least three (3) years; and
He or she shall be appointed by the City Mayor, but in no case, is he or she be within the fourth (4th) civil degree of consanguinity or affinity of the appointing authority.
SECTION 7. Creation of the Pagadian City Youth Development Council. - There is hereby created the Pagadian City Youth Development Council (PCYDC) which shall be responsible for the formulation of policies and implementation of youth development programs, projects and activities in coordination with various government and non-governmental organizations.
SECTION 8. Objectives of the Pagadian City Youth Development Council. - The Pagadian City Youth Development Council shall have the following objectives.
General Objectives:
To develop and harness the full potential of the youth as responsible partners in nation-building.
To encourage intensive and active participation of youth in all government, non-government programs, projects and activities affecting them.
To harmonize all government and non-government initiatives for the development of the youth sector, and
To supplement government appropriations for youth promotion and development with funds from other sources.
Specific Objectives:
To broaden and strengthen the service provided by the national government agencies, local government units, and private agencies to young people.
To provide information mechanism on youth opportunities In the areas of education, employment, livelihood, physical and mental health capability and networking.
To increase the spirit of volunteerism among the youth in the City of Pagadian particularly the maintenance of peace and order and preservation, conservation, and protection of the environment and natural resources within their locality.
To provide monitoring and coordinating mechanism for youth programs, projects and activities, and
To provide a venue for the active participation of the youth in cultural and eco-tourism awareness programs.
SECTION 9. Composition of the Pagadian City Youth Development Council (PCYDC). - The Pagadian City Youth Development Council shall be composed of a minimum number of ten (10) to a maximum of twenty-one (21) members. The PCYDC shall be composed of the following, to wit:
Chairman	:	City Mayor
Vice Chairperson	:	City Vice Mayor and
		City Social Welfare and Development Officer
Members	:	Sangguniang Kabataan Federation President;
Sangguniang Kabataan Federation Vice President;
SP Member, Chairperson-Committee on Youth Welfare, Juvenile Delinquency & Drug Abuse Prevention;
SP Member, Chairperson-Committee on Police, Fire and Public Safety;
City Local Government Operations Officer;
Representative of student leaders from State Universities and Colleges;
Representative of student leaders from private colleges;
Representative of student leaders from public high schools;
Youth representative from girls' organization;
Youth representative from the out-of-school-youth;
Youth representative from the performing arts groups;
Youth representative from community-based organizations;
Youth representative from the indigenous peoples groups;
Youth representative from faith-based organizations;
Other members of the youth sector as may be required by the PCYDC in accordance to R.A. No. 10742. 

SECTION 10. Functions of the Pagadian City Youth Development Council - The Pagadian City Youth Development Council shall perform the following functions, duties and responsibilities:
To formulate policies and component programs in coordination with the various government agencies handling youth-related programs, projects and activities.
To coordinate and harmonize activities of all agencies and organizations in the City of Pagadian engaged in youth development programs.
To develop and provide support for the development and coordination of youth projects and designed strategies to gain support and participation of the youth.
To accredit sports and recreational centers, hostels, training centers and other institutions providing services to the youth as identified in the ordinance.
To assist the national government and government agencies in the promotion of programs, projects and activities in the local level.
To assist various government and non-government agencies in the identification and nomination of qualified participants different programs, projects and activities.
To conduct fund raising programs and solicitations. It shall likewise receive donations, bequests and may enter into contracts with the government and non-government agencies necessary for the accomplishment of the objectives of this ordinance.
To recommend youth programs and project proposals to appropriate government agencies and non-government organizations necessary for the accomplishment of the objectives of this ordinance.
To accredit training pools for the purpose of assisting line agency in implementation training and capability building programs.
To solicit books and receive donation from any individual non-government agency both local and international.
To create research team that will formulate a mechanism to come up with a local youth stationers.
To establish youth centers as deemed necessary.
To monitor implementation of programs and projects at the local level.
To nominate its delegate to the National Youth Parliament, and
To perform such other functions as may be provided by law.
SECTION 11. Budgetary Support and Funding. The personnel and operating expenses of the Pagadian City Youth Development Office (PCYDO) and the Pagadian City Youth Development Council (PCYDC) shall first be sourced under the City Mayor's Office (CMO) budget, if available. Thereafter, the amount needed for the operation and maintenance of the PCYDO and the PCYDC shall be included in the annual budget.
SECTION 12. Separability Clause - If any provision of this ordinance is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting.
SECTION 13. Repealing Clause - All orders or parts thereof which are inconsistent with the provisions of this ordinance are hereby repealed or modified accordingly.
SECTION 14. Effectivity - This ordinance shall take effect immediately upon approval.
ENACTED AND APPROVED by the Sangguniang Panlungsod (13th City Council) during its 133rd Regular Session on 15 June 2022 at the SP Session Hall, 4th Floor City Commercial Center (C3), Santiago District, Pagadian City.
