"AN ORDINANCE ASSIGNING ONE (1) GOVERNMENT-OWNED HOSPITAL-BASED AMBULANCE VEHICLE FOR THE EXCLUSIVE USE OF THE PAGADIAN CITY INFIRMARY, LOCATED AT BARANGAY DANLUGAN, PAGADIAN CITY; ADOPTING RULES AND REGULATIONS GOVERNING THE LICENSURE OF AMBULANCES AND AMBULANCE SERVICE PROVIDERS; AND FOR OTHER PURPOSES"

WHEREAS, pursuant to Section 15 of the 1987 Philippine Constitution, "The State shall protect and promote the right to health of the people and instill health consciousness among them," while Section 16 of Local Government Code provides that "every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare;" 

WHEREAS, in relation thereto, the Local Government Unit of Pagadian City, consistent with its thrust and mandate to enhance the delivery of basic health services to its constituents, has established and operated the Pagadian City Infirmary, located at Barangay Danlugan, this city, which aims to bring proper medical services closer to the people living in the rural areas;  

WHEREAS, consequently, the provision of a hospital-based ambulance vehicle in the afore-mentioned medical institution--which shall be readily available for 24-hours--is imperatively necessary as it would ensure efficient and timely response of medical care and services to all patients admitted in the said hospital;

WHEREAS, considering that the City Government is a recipient of an ambulance vehicle through donation from the Department of Health, it is therefore prim and proper to assign exclusively, the donated ambulance vehicle to the Pagadian City Infirmary which assignment necessitates appropriate licensing for its operation that shall form part of the hospital license;

NOW, THEREFORE, Be it ordained by the Sangguniang Panlungsod (13th City Council) of Pagadian City in session assembled that:
SECTION 1. TITLE. -- "An Ordinance Assigning One (1) Government-Owned Hospital-Based Ambulance Vehicle For The Exclusive Use Of The Pagadian City Infirmary, Located At Barangay Danlugan, Pagadian City; Adopting Rules And Regulations Governing The Licensure Of Ambulances And Ambulance Service Providers; And For Other Purposes;"
SECTION 2. ASSIGNMENT OF HOSPITAL-BASED AMBULANCE VEHICLE FOR PAGADIAN CITY INFIRMARY. -- For purposes of this Ordinance, the Local Government of Pagadian shall assigned and provide one (1) government-owned hospital-based ambulance vehicle available for use of the Pagadian City Infirmary 24-hours in order to ensure immediate and timely response of medical care and services for its patients;
SECTION 3. ASSIGNMENT OF PERSONNEL. -- to ensure an effective and efficient delivery of ambulance services, the Chief of Hospital of the Pagadian City Infirmary through the Honorable City Mayor shall hire and/or designate and assign a competent and well-trained hospital personnel to operate, oversee and supervise the ambulance vehicle. 
As provided under the rules, there must be at least two (2) responders, excluding the driver, which shall require the Standard First Aid, Basic Life Support (BLS), EMT, and Advance Cardiac Life Support (ACLS)-trained from a DOH-RECOGNIZED training provider.
SECTION 4. AMBULANCE VEHICLE REGISTRATION. 
In accordance to DOH Advisory 2016-0029, the following are the primary requirements for its registration: 
The ambulance service providers shall secure registration for all vehicles at the Land Transportation Office (LTO) prior to application for license to operate;

Ambulance service provider shall secure DOH-LTO per vehicle to be issued by HFSRB (Health Facilities and Services Regulatory Board)

Ambulance service providers shall ensure that they are part of a functional referral network within the area/vicinity where they are allowed to operate;

Stakeholders shall strictly comply with the standards, criteria and requirements prescribed in the Assessment Tool for licensure of ambulances and ambulance service providers;

The DOH-LTO of ambulance service providers shall be valid for three (3) years from January of the first year to December of the third year:
 
Institution-based ambulance services shall be included in the One-Stop Shop (OSS) licensure system for hospitals and other health facilities. The DOH-LTO of the ambulance shall reflect in the health facility DOH-LTO. Hence, a separate DOH-LTO is not required;

Non-institution-based ambulance service provider shall secure a separate DOH-LTO;

SECTION 3. REPEALING CLAUSE. All existing ordinances which are inconsistent with the provisions herein are hereby repealed or modified.
SECTION 4. EFFECTIVITY CLAUSE. This Ordinance shall take effect immediate upon approval.
