ORDINANCE NO: 2021-500 (Authored by: Hon. Fernando Y. Pameron) "AN ORDINANCE PROVIDING INCENTIVES AND PRIVILEGES TO FULLY INOCULATED RESIDENTS OF PAGADIAN CITY AGAINST THE CORONAVIRUS DISEASE 2019 (COVID -19) AND FOR OTHER PURPOSES" WHEREAS, during the early months of Calendar Year 2020, the Philippines as well as all other nation of the world was caught off-guard and unprepared by the rapid emergence of a dreaded disease known as the Corona Virus Disease 2019 (COVID-19) which was then declared by the World Health Organization (WHO) as a pandemic; WHEREAS, as a measure to combat such dreaded disease, the national government has instituted national vaccination program which is set to inoculate at least Seventy Percent (70%) of the total population in order to attain herd immunity purposely to provide protection to the general population; WHEREAS, following the commencement of the vaccination program, the different Local Government Units had identified vaccination hesitancy among the citizenry as the leading predicament in attaining the government's vaccination target, thus the institution of appropriate measures that could entice or allure every individual to submit themselves for COVID-19 vaccination is most practical and reasonable; NOW, THEREFORE, be it ordained by the 13th City Council in session assembled that: SECTION 1. TITLE. - This Ordinance shall be known as "An Ordinance Providing Incentives And Privileges To Fully Inoculated Residents Of Pagadian City Against The Corona Virus Disease 2019 (COVID-19) And For Other Purposes." SECTION 2. PURPOSE. - This measure will be used as a tool to entice, motivate or encourage residents of the city to fully support, participate and submit to the City Government's vaccination program with the end in view of administering at least Seventy Percent (70%) of the population in order to attain the so-called population protection or herd immunity. SECTION 3. DEFINITION OF TERMS. - For purposes of this Ordinance, the following terms and/or phrases shall be construed to mean, as follows: COVID-19 - Corona Virus Disease 2019. Vaccine - COVID-19 vaccine that is prescribed and authorized by DOH to be used as vaccines for human consumption on whatever brand, such as, but not limited to, PFIZER, JANSSEN, SINOVAC, MODERNA, and ASTRAZENECA. Fully Vaccinated Individuals - refers to those persons identified and defined under IATF Resolution No. 123-C, series of 2021, who have received any of the following, to wit: More than or equal to two (2) weeks or after having received the 2nd dose of COVID-19 vaccine in a two (2) dose series; More than or equal to two (2) weeks after having received a single-dose vaccine; Vaccination Card - any document issued by the City Vaccination Center as prescribed by DOH showing proof of full vaccination; Incentives or Benefits - priority services LGU will give to vaccinated residents in the City of Pagadian. Privilege - a right or benefit that is given to some people and not to others; Incentive - something that makes someone want to do something or encourage an individual to do a thing. SECTION 4. INCENTIVES AND PRIVILEGES. - For purposes of this Ordinance, the following incentives and privileges shall be extended to all fully vaccinated residents in the City of Pagadian, viz: SECTION 5. SEPARABILITY CLAUSE. - If any provision or portion of the Ordinance, is declared illegal and/or found to be violative of the Constitution and declared invalid by a court of competent jurisdiction, the remainder of this Ordinance not so declared otherwise shall not be affected and shall remain in full force and effect. SECTION 6. REPEALING CLAUSE. - All Ordinances, executive orders and rules and regulations or parts thereof, which are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed, amended and/or modified accordingly. SECTION 7. EFFECTIVITY CLAUSE. - This Ordinance shall take effect immediately upon approval and after posting for a period of fifteen (15) days in two (2) conspicuous places of city.
