"AN ORDINANCE ESTABLISHING THE PAGADIAN CITY INTERNATIONAL COLLEGE; DEFINING HEREIN THE RULES AND POLICIES TO GOVERN THE MANAGEMENT AND OPERATION; AND APPROPRIATING FUNDS THERETO"
WHEREAS, the 1987 Philippine Constitution mandates that the State shall protect and promote the right of all citizens to quality education at all levels and shall take appropriate steps to maintain and support Section 458, (Powers, Duties and Functions of the Sangguniang to maintain and support a complete adequate and integrated system of education relevant to the needs of the people and society;
WHEREAS, paragraph (5)(x), Section 458 of Republic Act 7160, otherwise known as the Local Government Code of 1991 provides, that subject to the availability of funds and the existing laws, rules and regulations, shall establish and provide for the operation of vocational, and technical schools and similar post-secondary institutions and, with the approval of the Department of Education and subject to existing laws on tuition fees and other school charges in educational institutions supported by the City Government;
WHEREAS, the City Government of Pagadian intends to develop scientific, technological and vocational educations among its constituents through rationalization of programs and institution of higher learning with set of policies, standards and guidelines in accordance with the Commission on Higher Education (CHED) Memorandum Circular No. 32, series of 2006;
WHEREAS, the City Government of Pagadian takes cognizance of its responsibility to equally provide access and distribution of opportunities for its constituents to advance the educational attainment under the auspices of a higher learning institution;
WHEREAS, the establishment of Pagadian City International College aims to offer baccalaureate degrees in Public Administration, Midwifery, Tourism Management, vocational-technical courses and other degrees to meet the manpower demand, and other relevant needs that will accelerate the economic development;
NOW, THEREFORE, in view of the foregoing premises, be it ordained by the Sangguniang Panlungsod (13th City Council) of Pagadian, in session assembled that:
SECTION 1. TITLE. - This Ordinance shall be known as "An Ordinance Establishing the Pagadian City International College; Defining Herein the Rules and Policies to Govern the Management and Operation; and Appropriating Funds Thereto"
SECTION 2. CHARTER. - This Ordinance shall be known as the Charter of Pagadian City International College and shall be situated at Barangay San Jose, Pagadian City.
SECTION 3. OBJECTIVES. - The Pagadian City International College shall primarily offer higher professional, technical instructions for special purposes, and promote research and extension services, advanced studies in academic disciplines such as, but not limited to, Public Administration, Midwifery, Tourism Management, short-term vocational-technical courses as may be relevant. It shall also pursue the integration of researches and studies for the continued progress and development of the City of Pagadian.
SECTION 4. ADMISSION TO THE PAGADIAN CITY INTERNATIONAL COLLEGE. - Admission of the Pagadian City International College shall be for every deserving qualified student regardless of age, sex, nationality, ethnic affiliation, religious belief or political affiliation.
SECTION 5. PAGADIAN CITY INTERNATIONAL COLLEGE AS CORPORATE BODY. - The Pagadian City International College shall constitute a corporate body and as such is vested with corporate powers and authority as provided in the provisions of this Charter and existing laws. The Pagadian City International College shall have the following corporate powers:
To have a continuous succession in its corporate name;
To have and use a corporate seal;
To exercise such powers as are granted by the Sangguniang Panlungsod of Pagadian City subject, however, to the limitations provided in this Ordinance and other pertinent laws.
SECTION 6. COMPOSITION OF THE BOARD OF TRUSTEE. - The governing body and corporate powers of the Pagadian City International College shall be exclusively vested in and exercised by the Board of Trustees with the following composition:
Chairman - City Mayor
Vice-Chairman - President of the College
Members: - President of the Faculty Association
President of the Supreme Student Council
President of the Alumni Association
The Chairperson of the Sanggunian
Committee on Education, Science & Technology
The Chairperson of the Sanggunian
Committee on Finance and Appropriations
The President/Representative of an accredited Business or Industry;
The Regional Director for the Department of Science and Technology (DOST)
Representative of the Association of Local Colleges and Universities (ALCU)
The City Budget Officer (ex-officio) with no voting rights;
SECTION 7. BOARD SECRETARY. - The Board Secretary shall be appointed by the Chairman of the Board of Trustees whose term of office is co-terminus with the Chairman. He/she shall serve as the Execom Secretary.
SECTION 8. TERM OF OFFICE. The members of the Board of Trustees shall have the following term of office:
Chairman - during his/her term as City Mayor
Vice-Chairman - for a term of four (4) years, subject to reappointment
Members:
President of the Faculty Association - during his/her term of office
President of the Supreme Student Council - during his/her term of office
Chairman, Committee on Education - during his/her term of office
as City Councilor
President/representative of an Accredited
Business or Industry - serve for a term of two (2) years
President of the Alumni Association - during his/her term of office
Regional Director of DOST XI - his/her tenure as Regional Director
City Budget Officer - For a term of four (4) years
SECTION 9. VACANCIES. - In case of vacancy by reason of resignation, removal from office, death or any other incapacity of one or more members of the Board of Trustees, the Chairman shall fill up the vacancy by appointment.
SECTION 10. COMPENSATION. - The members of the Board of Trustees/Execom shall serve without compensation except for a reasonable allowance or per diem as may be authorized by the Board of Trustees.
SECTION 11. QUORUM. - The members of the Board of Trustees shall consist of the majority of all the members of the Board.
SECTION 12. ALLOWANCE OF THE BOARD MEETING. - The members of the Board of Trustees shall be entitled to receive a reasonable allowance of at least Four Thousand Pesos (P4,000) per actually attended meeting, provided, that they shall be entitled of reimbursement for actual and necessary expenses incurred in the attendance of meetings and other official business authorized by resolution of the Board.
SECTION 13. POWERS AND DUTIES. - In addition to its general powers of administration and the exercise of all powers of a corporation embodied in Batas Pambansa Blg. 68, otherwise known as the Corporation Code of the Philippines, the Board of Trustees shall have the following powers and duties:
To enact rules and regulations not contrary to law as may be necessary to carry out the purposes and functions of the Pagadian City International College;
To receive and appropriate all sums as may be provided, for the support of the Pagadian City International College in the manner as it may determine, in its discretion to carry out the purposes and functions of the same College;
To receive in trust, legacies, gifts and donations of real and personal properties of all kinds and to administer and dispose the same when necessary for the benefit of the Pagadian City International College and subject to the limitations, directions and instructions of the donor, if any. Such donations shall be exempt from the donor's tax and the same shall be considered as allowable deductions from the gross income of the donor in accordance with provisions of the National Internal Revenue Code, as amended;
To fix tuition fees and other necessary school charges, such as, but not limited to, matriculation fees, graduation fees and laboratory fees, as the Board may deem proper to impose after due consultation with the involved sectors. Such fees and charges, including government subsidies and other income generated by the Pagadian City International College, shall constitute special trust funds and shall be deposited in any authorized government depository bank, and all interest that shall accrue therefrom shall form part of the same fund for the use of the Pagadian City International College. Any provision of existing laws, rules and regulations to the contrary notwithstanding, any income generated by the Pagadian City International College from tuition fees and other charges, as well as from the operation of auxiliary services and land grants, shall be retained by the Pagadian City International College and may be disbursed by the Board for instruction, research, extension or other programs/projects of the Pagadian City International College: Provided, that all fiduciary fees shall be disbursed for the specific purposes for which they are collected. If for reasons beyond its control, the Pagadian City International College shall not be able to pursue any projects for which funds have been appropriated and allocated under its approved program of expenditures, the Board may authorize the use of said funds for any reasonable purpose which, in its discretion, may be necessary and urgent for the attainment of the objectives and goals of the Pagadian City International College;
To adopt and implement a socialized tuition scheme and school fees for greater access to poor but deserving students;
To authorize the construction or repair of its buildings, machinery, equipment and other facilities and purchase and acquisition of real and personal properties, including necessary supplies, materials and equipment;
To appoint, upon the recommendation of the duly appointed officer of the Pagadian City International College, vice-president, deans, directors, head of departments, faculty members and other officials and employees;
To fix and adjust salaries of faculty members and administrative officials and employees subject to the provisions of the Revised Compensation and Classification System and other pertinent budget and compensation laws governing the hours of service and such other duties and conditions as it may deem proper, to grant them, at its discretion, leaves of absences under existing law and to remove them for cause in accordance with the requirements of due process of law;
To approve the curricula, institutional programs and rules of discipline drawn by the administrative and academic councils as herein provided;
To set policies on admission and graduation of students;
SECTION 17. EXECOM ACTS AND RESOLUTIONS. - All acts and resolutions approved by the Executive Committee shall be ratified by the Board of Trustees. Any important matters affecting the administrative and/or academic affairs of the Pagadian City International College shall be reported to the Board of Trustees thru the Chairman.
SECTION 18. EXECOM MEETINGS. - Execom meeting shall be held at the Pagadian City International College or any other place in Pagadian City, once in every week, provided it shall not exceed four (4) times a month.
SECTION 19. EXECOM ALLOWANCE. - The President/Administrator and other members of the Execom shall be entitled to Php 500.00 allowance in every actual meeting attended.
SECTION 20. NOTICES. - Notices of the time and place of the Execom meeting shall be given personally or by email, at least 3 days before the dates set for such meeting.
SECTION 21. QUORUM. - A quorum for any meeting of the Execom shall consist of the majority of the members and a majority of such quorum may decide any question raised in the meeting.
SECTION 22. ORDER OF BUSINESS. - The Order of Business of the Board of Trustees and Execom Meetings shall be as follows:

Roll Call
Approval of the Minutes of the previous meeting
Ratification of all Acts and Resolutions approved by the Execom (Only for Board of Trustees' meeting)
New Business
Other Matters
SECTION 23. VOTING. - Each Board of Trustees/Execom shall be entitled to one (1) vote and no proxy is allowed.
SECTION 24. COLLEGE COUNCIL. - There shall be a College Council with the President/Administrator as Chairperson and all academic staff with a rank not lower than Deans or Program Chairs and heads of different units or offices as members.
SECTION 25. DUTIES AND FUNCTIONS. - The College Council shall have the following duties and functions, subject to the approval of the Board of Trustees:
The duty to prescribe/recommend the curricula and rules of discipline;
Fix the requirements for admission to the Pagadian City International College as well as for graduation and conferment of degrees;
SECTION 36. SEPARABILITY CLAUSE. - If, of any reason, any section or provision of this Ordinance is held unconstitutional or invalid, the other sections or provisions thereof shall not be affected thereby.
SECTION 37. REPEALING CLAUSE AND AMENDMENT. - All laws, executive orders, rules and issuances or parts thereof inconsistent with the provisions of this Ordinance are hereby repealed, amended or modified accordingly.
