Pameron "AN ORDINANCE AMENDING SECTIONS 3 AND 7 OF CITY ORDINANCE NO. 2021-478, ENTITLED: "AN ORDINANCE REQUIRING THE MANDATORY USE OR WEARING OF FACE MASK IN ALL PUBLIC PLACES OF PAGADIAN CITY DURING OR ON OCCASION OF A DECLARED NATIONAL OR LOCAL PUBLIC HEALTH EMERGENCY DUE TO AN EPIDEMIC OR PANDEMIC DISEASE TRANSMISSIBLE THROUGH DROPLETS OR AIRBORNE, AND PROVIDING PENALTY FOR VIOLATION THEREOF, AND FOR THE PURPOSE, ABROGATING CITY ORDINANCE NO. 2021-478"" Be it ordained by the Sangguniang Panlungsod (13th City Council) of Pagadian City in session assembled that: SECTION 1. Section 3 of City Ordinance No. 2020-446, Definition of Terms, is hereby amended which shall now be read as follows: "SECTION 3. Definition of Terms. - For purposes of this Ordinance, the following words or terms shall be construed to mean as follows: X X X X X X X X X X X X X X X Improper or incorrect use or wearing of face mask - refers to the use or wearing of face mask which does not cover both the mouth and nose or not tied securely to minimize any gaps between the face and the mask, such as, but not limited to, the wearing of face mask under the chin or only the mouth is being covered, etc." SECTION 2. The penal provisions provided under Section 7 of the foregoing Ordinance, is hereby modified to read as follows: "SECTION 7. Penal Provisions. - Any person or persons found violating the provision of this Ordinance shall be meted with the following penalties, to wit: Improper/incorrect use or wearing of face mask: First Offense : P300.00 or Community Service of not exceeding One (1) day; Second Offense : P500.00 or Community Service of not exceeding One and One Half (1 ?) day; Third and Succeeding Offenses : P1,000.00 or Community Service of not exceeding Three (3) days; For not using/wearing face mask: First Offense : P500.00 or Community Service of not Exceeding One and One Half (1 ?) day; Second Offense : P1,000.00 or Community Service of not exceeding Three (3) days; Third and Succeeding Offenses : P2,500.00 or Community Service of not exceeding Seven (7) days." SECTION 3. Separability Clause. - If any provision of this Ordinance or the application thereof to any person is held invalid, the remainder of this Ordinance and the application of such provisions to other persons shall not be affected thereby. SECTION 4. Repealing Clause. - All previous ordinances inconsistent with this Ordinance shall deemed amended, modified or repealed accordingly. SECTION 5. Effectivity Clause. - This Ordinance shall take effect after fifteen (15) days of publication in any newspaper of general circulation in the City of Pagadian.
