ORDINANCE NO: 2021-476 Sponsored By: Committees on Ways & Means; on Laws, Rules and Policy Formulation; and on Health and Social Services "AN ORDINANCE FIXING THE RATE OF SOCIALIZED FEES FOR THE AVAILMENT OF ADMINISTRATIVE ADOPTION PROCEEDINGS IN THE CITY SOCIAL WELFARE AND DEVELOPMENT OFFICE AND THE OFFICE OF THE LOCAL CIVIL REGISTRAR OF PAGADIAN CITY PURSUANT TO REPUBLIC ACT NO. 11222, OTHERWISE KNOWN AS "AN ACT ALLOWING THE RECTIFICATION OF SIMULATED BIRTH RECORDS AND PRESCRIBING ADMINISTRATIVE ADOPTION PROCEEDINGS FOR THE PURPOSE" WHEREAS, Republic Act No. 11222, known as "An Act Allowing the Rectification of Simulated Birth Records and Prescribing Administrative Adoption Proceedings for the Purpose," provides for simpler and less costly mode/method in rectifying simulated birth records as well as administrative adoption proceedings; WHEREAS, Section 27 thereof provides that the City Social Welfare and Development Office and the Office of the Local Civil Registrar may charge socialized fees in an amount not exceeding One Thousand (P1,000.00) Pesos from those who avail of the administrative adoption proceedings under the said Act provided, however, that the said fees shall be waived if the petitioner(s) is/are found to be indigent; WHEREAS, in view thereof, there is thus a need to fix the rate of socialized fees that may be charged by the concerned departments or offices of the Local Government Unit of Pagadian City to any and all petitioners availing the administrative adoption proceedings as provided under Republic Act No. 11222; NOW, THEREFORE, the Sangguniang Panlungsod (13th City Council) of the City of Pagadian in session duly assembled do ordain, as it hereby ordains that: SECTION 1. - TITLE. - This Ordinance shall be known as "AN ORDINANCE FIXING THE RATE OF SOCIALIZED FEES FOR THE AVAILMENT OF ADMINISTRATIVE ADOPTION PROCEEDINGS IN THE CITY SOCIAL WELFARE AND DEVELOPMENT OFFICE AND THE OFFICE OF THE LOCAL CIVIL REGISTRAR OF PAGADIAN CITY PURSUANT TO REPUBLIC ACT NO. 11222, OTHERWISE KNOWN AS "AN ACT ALLOWING THE RECTIFICATION OF SIMULATED BIRTH RECORDS AND PRESCRIBING ADMINISTRATIVE ADOPTION PROCEEDINGS FOR THE PURPOSE." SECTION 2. - SCOPE AND COVERAGE. - This Ordinance shall be applicable to all persons who may avail of Administrative Adoption Proceedings in the City Social Welfare and Development Office and the Office of the Local Civil Registrar of Pagadian City. SECTION 3. -? OBJECTIVES. - This Ordinance primarily aims to collect the amount prescribed under Republic Act No. 11222 for the availment of Administrative Adoption Proceedings in the Offices of the City Social Welfare and Development and Local Civil Registrar of Pagadian City. SECTION 4. - RATE OF FEES FOR THE AVAILMENT OF ADMINISTRATIVE ADOPTION PROCEEDINGS. - There shall be collected the amount of One Thousand (P1,000.00) Pesos for the availment of Administrative Adoption Proceedings in the City Social Welfare and Development Office and the Office of the Local Civil Registrar of Pagadian City. SECTION 5. - IMPLEMENTING OFFICE. - The fee imposed herein shall be paid to the City Social Welfare and Development Office and/or Office of the Local Civil Registrar, and the corresponding receipts for the collection thereof shall be issued for accounting and auditing purposes. SECTION 6. - REPEALING CLAUSE. - All orders, memoranda, rules and regulations, or any part or parts hereof, inconsistent with the provisions of this Ordinance are hereby revoked or modified accordingly. SECTION 7. - EFFECTIVITY CLAUSE - This Ordinance shall take effect fifteen (15) days after its publication in a local newspaper of general circulation in the City.
