Duterte "AN ORDINANCE FURTHER AMENDING PARAGRAPH A, SECTION 143, ARTICLE 2 OF CITY ORDINANCE NO. 2021-475, ENTITLED: "AN ORDINANCE PROVIDING FOR THE ROAD NETWORK AND TRANSPORTATION MANAGEMENT CODE OF PAGADIAN CITY" AS AMENDED BY CITY ORDINANCE NO. 2021-475" WHEREAS, due to public demand and in pursuance to Section 8, Article II of Republic Act No. 4136 on the Uniformity of Registration Fees and Classification, and Section 5 of Republic Act No. 8794 on the Reclassification and New Models of Motor Vehicle, the Land Transportation Office (LTO), on 30 September 2020, issued Memorandum Circular No. 2020-2216, which, in gist, classified Bajaj Maxima Z with piston displacement not exceeding 236cc as Motorcycle with Sidecar and qualified for three (3) year initial registration; NOW, THEREFORE, be it ordained as it is hereby ordained by the Sangguniang Panlungsod (13th Council) of Pagadian City in session assembled that: SECTION 1. - Section 143, Article 2 of City Ordinance No. 2018-400, Terminologies, particularly Paragraph (a) thereof, as amended by City Ordinance No. 2019-427, is further amended to include three-wheeled passenger conveyance or those Motorcycle-Tricycle with piston displacement not exceeding 236cc which is classified as Motorcycle with Sidecar by the Land Transportation Office, which shall hereinafter be read as follows: "SECTION 143. TERMINOLOGIES. - As used in this Chapter, the following terms shall mean: Motorized Tricycle - is a motor vehicle composed of a motorcycle fitted to a single-wheeled sidecar or motorcycle with two wheeled cab or any three-wheeled passenger conveyance or Motorcycle-Tricycle which is classified as Motorcycle with Sidecar by the Land Transportation Office in its Memorandum Circular No. 2020-2216, dated 30 September 2020, provided that the same shall have an engine displacement of not more than 236cc, with prescribed technical specifications, to wit: Make Bajaj or any other similar type Series MAXIMA or any other similar series Type of Body Three-Wheeled Passenger Vehicle Fuel Type Gasoline Piston Displacement 236cc Braking System Hand Brake/Foot Brake No. of Cylinder One (1) Seating Capacity Four (4) Clutch System Present/Functional" SECTION 2. - SEPARABILITY CLAUSE. - Any provision that may be declared by any competent court to be invalid shall not affect the rest of the provisions not so declared illegal. SECTION 3. - REPEALING CLAUSE. - Any resolution, ordinance or parts thereof which are inconsistent with this Ordinance are hereby repealed or amended accordingly. SECTION 4. - EFFECTIVITY CLAUSE. - This Ordinance shall take effect after fifteen (15) days of publication in any newspaper of general circulation in the City of Pagadian.
