Pameron "AN ORDINANCE PRESCRIBING REGULATIONS AND CRITERIA GOVERNING THE CLASSIFICATION AND/OR RECLASSIFICATION INTO URBAN OR RURAL BARANGAYS OF THE CITY OF PAGADIAN" WHEREAS, Section 384 of R.A. 7160 otherwise known as the Local Government Code of 1991, declares the barangay as the basic political unit in the community; WHEREAS, it cannot be gainsaid that Pagadian City--after having been designated as the Regional Center of the Zamboanga Peninsula Region--is one of the fastest growing economy in this part of Mindanao, such that the opportunity to further develop and advance the socio-cultural-economic condition of the different barangays of the City is very inevitable; WHEREAS, with the keenness of this present administration to attain the full potential of the city, it is thus necessary to institute regulatory measures by setting criteria for the classification of the different barangays into urban and rural barangays; NOW, THEREFORE, in view of the foregoing premises, be it ordained by the Sanggunian Panlungsod (13th City Council) of Pagadian in session assembled that: SECTION 1. Title. - This Ordinance shall be known as "An Ordinance Prescribing Regulations and Criteria Governing the Classification and/or Reclassification into Urban or Rural Barangays of the City of Pagadian." SECTION 2. Scope of Application and Purpose. - This Ordinance shall serve as a guide in the classification or reclassification of all Barangay Government Units of Pagadian City into Urban or Rural Barangay. As such, this Ordinance is enacted purposely to establish a standard criterion in the classification and/or reclassification of barangays as urban or rural barangay in the City of Pagadian. SECTION 3. Definition of Terms. - For purposes of this Ordinance, the following words and phrases shall be construed to mean, as follows: a) Barangay - shall mean the basic political unit in the community organized and existing, or a newly carved political unit created by legislation possessing contiguous territory and inhabited by at least Two Thousand (2,000) residents; b) Urban Barangay - refers to a Barangay with upscale growth and development and has satisfactorily meet the required population and establishments set forth under Section 4.1 of this Ordinance; c) Rural Barangay - refers to less dense barangay and has failed to meet the requirements set forth under Section 4.1 hereof; SECTION 4. Regulations and Criteria in the Classification and/or Reclassification of Barangay. - The classification and/or reclassification of a barangay into urban or rural barangay shall be governed by the following regulations and criteria, viz: 4.1 - The classification or reclassification into Urban Barangay shall have to meet any of the three (3) requirements specified hereunder: Minimum population of at least Five Thousand (5,000) in the latest census conducted by the Philippine Statistics Authority (PSA); Presence of commercial/industrial or manufacturing establishment with a minimum employee of at least One Hundred (100) personnel; Presence of five (5) or more commercial/industrial or manufacturing establishments having employed at least ten (10) to ninety-nine (99) personnel; Presence of at least two (2) residential subdivisions having a minimum of at least One Hundred (100) units/lots each; Presence of a major transport facility such as Airport, Seaport, Integrated Bus Terminal (IBT), and Regional Government Center. Presence of a major tourist destination site with minimum record of visitors of at least One Hundred (100) tourists per month; 4.2 - For Rural Barangays - Those barangays falling short of the requirements set forth under Section 4.1 hereof, shall be classified as Rural Barangay. SECTION 5. Updating of Barangay Classifications. - For purposes of updating the classification and/or reclassification of the different barangays of the city, the following procedures shall be observed as herein specified, to wit: The City Local Government Operation Office (CLGOO) and the City Planning & Development Office (CPDO) shall, every after release of new census data by the Philippine Statistics Authority (PSA) or its equivalent office, may on its own, evaluate and update the classification or reclassification of the different barangays of the city; and The concerned Barangay may seek the update of their status through any of the following means, to wit: b.1 A resolutions enacted by the concerned Sangguniang Barangay seeking for an update on the classification or reclassification of their barangay into urban barangay; b.2 A petition-letter signed by at least Fifty Percent (50%) of the residents of the barangay concerned; b.3 All resolutions or petition-letter seeking for an update on the classification or reclassification of the barangay into an urban barangay shall be endorsed to the Sangguniang Panlungsod for support and recommendation to the Honorable City Mayor for approval. SECTION 6. Separability Clause. - If any provision or portion of this Ordinance is declared illegal and/or found to be violative of the Constitution and declared invalid by a court of competent jurisdiction, the remainder of this Ordinance not so declared otherwise shall not be affected and shall remain in full force and effect. SECTION 7. Repealing Clause. - All ordinances, executive orders and rules and regulations or parts thereof, which are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed, amended or modified accordingly. SECTION 8. Effectivity Clause. - This Ordinance shall take effect immediately after posting for a period of Fifteen (15) days in two (2) conspicuous places of the city.
