"AN ORDINANCE PROMULGATING THE RULES AND REGULATIONS GOVERNING THE ESTABLISHMENT OF THE PAGADIAN CITY MEAT INSPECTION SERVICE (PCMIS), PRESCRIBING FEES AND CHARGES FOR ITS OPERATION AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF"
WHEREAS, the Local Government Code of 1991 mandates all local government units to?promote the general welfare of their inhabitants, provide basic services for their constituents, and enact ordinances which shall ensure the effective and efficient delivery of such services;
WHEREAS, Section 10 under "Regulation by the Local Government Units (LGUs)" of the RA No. 10536 also known as " The Meat Inspection Code of the Philippines" in relation to Article 24 of the Republic Act (RA) No. 7394 also known as "The Consumer Act of the Philippines," provides that the LGUs, pursuant to the provisions of RA 7160 otherwise known as the Local Government Code and Executive Order (EO) No. 137, shall regulate the construction, management and operation of slaughterhouses, meat inspection, meat transport and post-abattoir control, monitor and evaluate and collect fees and charges in accordance with the national policies, procedures, guidelines, rules and regulations and quality and safety standards as promulgated by the Secretary;
WHEREAS, in compliance with the foregoing Orders, and to ensure the safety and quality of meat in the City of Pagadian, this august body finds the need to establish the Pagadian City Meat Inspection Service (PCMIS) pursuant to Section 3 of the Department of Agriculture Administrative Order No. 21, Series of 2010;
NOW, THEREFORE, be it ordained by the 13th City Council in session assembled that:
ARTICLE I
Title, Scope of Application and Objectives
SECTION 1.1. Title of the Ordinance. - There is hereby enacted an Ordinance Promulgating the Rules and Regulations Governing the Establishment of the Pagadian City Meat Inspection Service (PCMIS), Prescribing Fees and Charges for its Operation and Providing Penalties for Violation Thereof, and shall be hereinafter referred to as The Pagadian City Meat Inspection Service Ordinance of 2020.
SECTION 1.2. Scope of Application. - This Ordinance shall provide for the guidelines commencing from the receipt of livestock animals deemed for slaughter, the dispatch of meat at the different meat establishments up to the distribution, handling and storage of meat to the different registered meat establishments. It shall also cover guidelines for the conduct of post-meat establishments activities such as, but not limited to, monitoring, surveillance and evaluation.
This Ordinance shall cover all meat establishments existing and operating in the City of Pagadian, both Local Government and private operated establishments, where food animals are slaughtered and manufactured for human consumption.
SECTION 1.3. Objectives. - The following shall be the objectives of this Ordinance:
Establish the Pagadian City Meat Inspection Services Office (PCMISO) as a Section under the City Veterinary Office;
Provide stronger guidelines in order to regulate the management and operation of slaughterhouse, meat markets/channels, meat processing plants, poultry dressing plants, meat cutting plants, cold storage, meat inspection, meat transport and post-meat establishment control; and
Monitor, evaluate and impose fees and charges in accordance with national policies, procedures, guidelines, rules and regulations, and ensure quality and safety standards as promulgated by the National Government.
ARTICLE II
Definition of Terms
SECTION 2.1. Definition of Terms. - For purposes of this Ordinance, the following words and phrases shall be construed to mean as follows:
AA Meat Establishment - premises such as Slaughterhouse, Poultry Dressing Plant, Meat Cutting Plant, Cold Storage Warehouse and others that are licensed and registered by the National Meat Inspection Service (NMIS) and/or Pagadian City Meat Inspection Service in which food animals or meat are slaughtered, prepared, handled, packed, stored and distributed within or outside the City of Pagadian;
Accreditation - the power of the National Meat Inspection Service (NMIS) to give authority to (a) any meat establishment engaged in the slaughtering operation, preparation, processing, manufacturing, storing or canning of meat and meat products for commerce; (b) any importer, exporter, broker, trader or meat handler; (c) any meat vehicle conveyance; (d) any person, firm, corporation, or provider of government service such as independent or third party service providers, or independent inspection or audit agencies;
Meat Inspection - the conduct of ante-mortem and post-mortem inspection and ensures the proper cleaning and disinfection of the meat establishment by the meat inspector. She/he is required to be present during the entire duration of slaughtering operation; an act by an official inspector to ensure compliance with rules and regulations including but not limited to humane handling of food animals, ante and post mortem inspection, quality assurance program, hygiene and sanitation program, good manufacturing practices, Sanitation Standard Operating Procedure (SSOP), Hazard Analysis Critical Control Point (HACCP) program, residue control program for any meat establishment facilities, transport vehicles and conveyance;
Butcher - a skilled person employed to transform food animals into meat;
Carcass - the body of any slaughtered food animal after bleeding and dressing;
Cleaning - the physical removal of soil, dirt, grease or other objectionable matter;
Codex Alimentarius - is a collection of international food standards adopted by the Codex Alimentarius Commission and presented in a uniform manner. It includes standards for all the principal foods, whether processed, semi-processed or raw;
Confiscation - means the taking into custody of livestock and/or poultry carcasses, edible or inedible part or parts from said carcasses by the controlling authority for its proper disposal for having been the subject of violation of the rules and regulations;
Controlling Authority - means the same as competent authority charged by the government with the control of meat inspection and meat hygiene, including setting and enforcing regulatory meat hygiene requirements pursuant to Codex Alimentarius;
Disease or Defect - a pathological change or other abnormality;
Disinfection - the reduction of the number of micro-organism in an environment to a level that does not compromise food safety or suitability by means of chemical agents and/or physical methods;
Fit for Human Consumption - meat that has passed and appropriately branded by an inspector as safe and wholesome and in which no changes due to disease, decomposition or contamination have subsequently been found;
Floor Dressing - unacceptable practice of progressively preparing the carcass on the floor. The use of unsalted dressing table is also considered as "floor dressing;"
Food Animal - all domestic animals slaughtered for human consumption such as, but not limited to, cattle, carabaos, buffaloes, horses, sheep, goats, hogs, deer, rabbits, ostrich and poultry;
Food Hygiene - refers to the measures and conditions necessary to control hazards that could lead to food-borne illnesses and to ensure fitness for human consumption of food of plant or animal origin taking into account its intended use;
Food Safety - refers to the assurance that food will not cause harm to the consumer when it is prepared or eaten according to its intended use;
Good Manufacturing Practices - refers to a quality assurance system aimed at ensuring that products are consistently manufactured, packed, repacked or held to quality standards appropriate for the intended use. It is thus concerned with both manufacturing and quality control procedure;
Hot Meat - the carcass or parts or carcass of food animals which were slaughtered from unregistered/unaccredited meat establishments and have not undergone the required inspection. It also includes undocumented, illegally shipped, and unregistered carcass and parts of carcass coming from other countries and those that are classified as hot meat by the National Meat Inspection Service (NMIS);
Inspected and Condemned - a condition wherein the carcass or parts of carcasses so marked have been inspected and found to be unsafe, unwholesome and unfit for human consumption;
Inspected and Passed - a condition wherein the carcasses or parts of carcasses so marked have been inspected and found to be safe, wholesome and fit for human consumption;
Locally Registered Meat Establishment - refers to slaughterhouse, meat processing plant, poultry dressing plant and other meat establishments that are registered by the City Government but not accredited by the National Meat Inspection Service (NMIS);
Meat - refers to the fresh, chilled or frozen edible carcass including offal derived from food animals;
Meat Control Officer - an inspector who is professionally qualified as a veterinarian duly appointed by the National Meat Inspection Service (NMIS) or City Mayor, and responsible for the supervision and control of meat hygiene including meat inspection;
Meat Establishment - premises such as slaughterhouse, poultry dressing plant, meat cutting plant, cold storage warehouse and others that are licensed and registered by the National Meat Inspection Service or the Pagadian City Meat Inspection Service in which food animals or meat are slaughtered, prepared, handled, packed or stored;
Meat Handlers - shall mean person directly involved in the preparation, transport and sale of meat;
Meat Inspector - a professionally qualified and properly trained officer, duly appointed by the National Meat Inspection Service (NMIS) or the City Mayor for meat inspection and control of hygiene under the supervision of a veterinary inspector;
Meat Inspection System - a system to ensure the safety and quality of meat for human food including but not limited to humane handling of slaughter animals, ante-mortem inspection, Quality Assurance Program, Hygiene and Sanitation Program, Good Manufacturing Practices (GMP), Sanitation Standard Operating Procedure (SSOP), Hazard Analysis Critical Control Point (HACCP) program and Residue Control Program of a country. It covers regulatory activities such as registration, licensing, accreditation, and enforcement of regulations and supported by laboratory examination;
Meat Transport Vehicle - is an enclosed conveyance facility used for the transfer of meat from one place to another in a hygienic manner;
Organoleptic - means any sensory properties of a product, involving taste, color, odor and feel. Organoleptic testing involves inspection through visual, feeling and smelling of products;
Post-Meat Establishment Control - shall mean control measures conducted on meat during transport up to the time of retail sale for the enforcement of regulations governing meat inspection;
Potable Water - water with standards of portability not lower than those contained in the latest edition of the "Philippine Standards of Drinking Water;"
Strike Operation/Raid - an all-out act of confiscating hot meat/spurious meat items and other pieces of evidence accessory to the act of illegal selling said products, such as, but not limited to, knives, cleavers, chopping boards, containers, weighing scales, makeshift stalls, vehicle/s, and the like, and apprehension of the suspect and his accomplices/cohorts for the purpose of detention, investigation, and filing of case/s;
Surveillance - the act of following a suspect or subject person or vehicle in order to obtain information related to a case or complaint being investigated or verified;
Suspect - the condition wherein final judgment on the animal, meat cannot be ascertained and would therefore require further inspection and/or examination;
ARTICLE III
The Pagadian City Meat Inspection Service (PCMIS); Creation, Operation and Supervision Control
SECTION 3.1. Creation of the Pagadian City Meat Inspection Service (PCMIS) and its Composition. Primary Duties and Responsibilities. - There shall be created the Pagadian City Meat Inspection Service under the City Veterinary Office who shall be primarily responsible over all meat inspection and meat hygiene activities within the territorial jurisdiction of Pagadian City;
SECTION 3.2. Personnel Complement. The Pagadian City Meat Inspection Service shall take office as a Section under the supervision and management of the City Veterinary Office. The Section shall be composed of the following minimum manpower complement, namely:

SECTION 3.3. Organization Structure. - Upon effectivity of this Ordinance, the Office of the City Veterinary in collaboration with the City Human Resource and Management Office (HRMO) shall immediately formulate the organizational structure of the Pagadian City Meat Inspection Service to ensure the individual personnel assigned in the said Section shall perform their respective functions, duties and responsibilities.
SECTION 3.4. Consideration of the Personnel in the PCMIS as Public Health Workers. - All personnel in the Pagadian City Meat Inspection Service (PCMIS) who are involved in meat inspection work shall be recognized and considered as Public Health Workers (PHW) and shall be responsible for the promotion of public health through the implementation of an effective meat inspection service and shall, for the purpose, be entitled to all benefits and emoluments due to a public health worker in consonance to Section 14.1 of the Department of Agriculture Administrative Order No. 01, series of 2014, otherwise known as the "Revised Implementing Rules and Regulations of Republic Act No. 9296 known as "The Meat Inspection Code of the Philippines" as amended by Republic Act No. 10536. All personnel shall also be trained on Basic Meat Inspection Training Course (BMITC) at NMIS before conducting meat inspection.
SECTION 3.5. Transitory Provision. - Pending the appointment of the staff of the PCMIS, the City Mayor shall initially designate such personnel to operate the Pagadian City Meat Inspection Service by detail or transfer from any department in the City Government of Pagadian, all of whom shall be under the direct operational control of the City Veterinary.
ARTICLE IV
Access to Meat Establishments
SECTION 4.1. Full Access to Meat Establishments, Meat Markets/Channels and Food Establishments. - Only the Meat Control Officers (MCOs) or the City Meat Inspectors (CMIs) and/or designated City Meat Inspectors (CMIs) shall have the authority to conduct or perform meat inspection work and shall conduct examination and inspection of all meat and by-products prepared for commercial purposes. As such, full access to all meat establishments, meat markets/channels and food establishments within the territorial jurisdiction of the city, at any time of the day, must be accorded to the designated meat inspectors to ensure the efficient and effective performance of their duty.
SECTION 4.2. Authority to Seek Assistance of Law Enforcers. - To ensure the unhampered performance of their duties and responsibilities, the Pagadian City Meat Inspection Service (PCMIS) when necessary, may seek the presence and assistance of law enforcers during or on occasion of serving any legal processes.
ARTICLE V
The City Slaughterhouse
SECTION 5.1. Establishment, Operation and Management of City Slaughterhouse. - There shall only be one slaughterhouse in the City of Pagadian to be operated and managed by the City Government of Pagadian through the Pagadian City Meat Inspection Service (PCMIS). It shall be understood that the slaughter of any kind of food animal for commercial or public consumption must be done in the City Slaughterhouse or other meat establishments duly franchised and regulated by the City Government.
SECTION 6.1. Establishment, Construction and/or Operation of Meat Establishments; Who are Allowed. - Any and all person, natural or juridical, are authorized to establish, construct and/or operate a Meat Establishment such as: Poultry Dressing Plant; Meat Cutting Plant; Meat Processing Plant; Cold Storage Warehouse and the like, except slaughterhouse, provided that the operator shall comply with all the requirements set under this Ordinance as well as other relevant laws and regulations.
SECTION 6.2. Filing of Application for Franchise to Operate Meat Establishment and Its Documentary Requirements. - All application for franchise to operate meat establishment in the city must first be filed in the Office of the City Mayor through the Pagadian City Meat Inspection Service -Office of the City Veterinary together with all pertinent documentary requirements for evaluation and initial consideration.
SECTION 6.3. Approval and Issuance of Franchise to Operate Meat Establishment. - The Sangguniang Panlungsod may approve the application and issue the necessary franchise to operate meat establishment in the City of Pagadian after satisfying the herein documentary requirements, to wit:
Letter of Intent addressed to the City Mayor through the Pagadian City Meat Inspection Service Section-Office of the City Veterinary relative to the application to operate meat establishment in the city;
A resolution from the Sangguniang Barangay if the applicant is the Barangay, and for any private individual or sector, a Sangguniang Barangay Resolution interposing no objection to the application to establish and/or operate meat establishment in the said barangay;
A resolution from the Sangguniang Barangay if the applicant is the Barangay, and for private sector, a Barangay Council Resolution of no objection allowing the proponent to apply for the establishment of Meat Establishment;
Visitors entering the Meat Establishment shall wear appropriate protective clothing and adhere to the other personal hygiene provisions of this Ordinance.
Meat handlers shall refrain from behavior which could result in contamination of food such as but not limited to:
Smoking
Spitting
Chewing or eating
Sneezing or coughing over unprotected food
Personal effects such as but not limited to jewelries, watches, pins and other items shall not be worn or brought in areas of production of the meat establishment.
Safety of Water Supply
There shall be an adequate supply of potable water to meet the water requirements in the operation of the Meat Establishment including the cleaning of food animals.
A minimum supply of potable water shall be made available, as follows:
227 liters per cattle
14 liters per swine
57 liters per goat and sheep
Equipment and Facilities
Hand washing facilities shall always be provided, suitably located and maintained in good condition.
Adequate means of natural or mechanical ventilation shall be provided to:
i. Minimize air-borne contamination of meat;
ii. Control ambient temperature;
iii. Control odors; and
iv. Control humidity
Adequate natural or artificial lighting shall be provided. Lighting fixtures shall be protected to ensure that food is not contaminated by breakages.
Adequate facilities for the storage of chemicals, cleaning implements, and others shall be provided.
Training
All employees involved in the production of meat shall be trained in personal hygiene, Good Manufacturing Practices, cleaning and disinfection procedures, product handling and protection
Regular and refresher /follow-up training courses shall be part of the overall training program.
Training program shall be routinely reviewed and updated whenever necessary.
Records Keeping
Suitable records shall be maintained, and kept for a minimum period of five (5) years. Records may be required by regulatory officers and shall be made available on request. The records shall show the following but not limited to:
Slaughter report
Condemnation report
Enforce the effective and efficient implementation of all related laws, administrative orders, ordinances and rules and regulation concerning meat inspection and hygienic slaughtering practices for locally registered Meat Establishment;
Submit a status and completion report to the City Mayor in relation to the conduct of enforcement activities, such as, but not limited to, monitoring, surveillance, search and seizure and others.
SECTION 21.4 The following shall be the areas of concern in conducting post-Meat Establishment control:
Meat markets/channels shall include, but not limited to, the following:
Wet markets;
Flea markets ("talipapa");
"Bagsakan" centers;
Rolling stores;
Meat shops/ stalls;
Lechon houses and stands;
Ambulant meat stalls/ vendors/ peddlers;
Grocery stores;
Restaurants, canteens, and eateries;
Catering services;
Hotels and other institutional buyers.
Private domicile, particularly, those suspected depots of "hot meat" subject to legal requirements; and
Other channels where meat and meat products are slaughtered, prepared, handled, processed, packed, stored, and distributed.
SECTION 21.5 The following items shall be the subject of regulation which could lead to legal procedure:
Carcasses/parts/offal whether imported or locally produced:
found to have come from clandestine slaughter;
adulterated as defined under RA No. 10536;
derived from non-food animals, such as dog meat, cat meat, etc;
from an unaccredited or banned country, and
Surveillance of suspected individuals and vehicles, or case finding to any meat channel committing a possible violation to this Ordinance. The surveillance personnel shall decide if a strike operation is necessary and shall present to the team his findings and recommendation/action plan. All subjects shall be divulged only during the final planning/briefing at the time prior to the conduct of a strike operation which shall be led by the surveillance officer;
A warrantless strike operation shall be conducted when the illegal activity is done in plain view. In case of clandestine activity, a search warrant shall be secured prior to the conduct of a strike operation;
Seizure of meat slaughtered, prepared, handled, processed, packed, stored, transported, distributed, or offered for sale as human food not in accordance with the provisions of RA No. 10536, RA No. 10611and other related rules and regulations;
Inventory of confiscated meat shall be properly accounted and turned-over to the disposal section of the LGU governing the confiscated items in accordance with existing Commission on Audit (COA) rules and regulations;
Proper coordination of activities between and among the concerned agencies, National Meat Inspection Service (NMIS), Food and Drug Administration (FDA), LGUs, PN P, etc;
Setting-up of checkpoint/s in identified strategic area/s, as the need arises;
Blotter the illegal activity after the conduct of operation at the nearest police station having jurisdiction over the area where the strike operation was conducted and obtain a copy of the police blotter for future reference; and
Filing of legal action/s against violators of the existing meat inspection laws, rules and regulations.
The team or any of the members, in the discharge of its or his/her official duties, shall be provided with legal assistance by the Local Government of Pagadian and National Meat Inspection Service (NM IS) when necessary, such as but not limited to, filling of cases against violators, when charged in court, during attendance to court hearings, etc.
SECTION 21.7 Corresponding logistical support shall be included in the annual budgetary appropriation of the City Government of Pagadian to sustain the functions and activities of the task force.
SECTION 21.8 The following official form shall be used during the conduct of post-ME control provided as annexes in this Ordinance:
Post-Meat Establishment Management Receipt (Annex B)
Summon Letter (Annex C)
Show Cause Directive (Annex D)
Notice of Final Warning (Annex E)
Notice of Violation (Annex F)
Hold Order (Annex G)
Condemnation Receipt (Annex H)
Coordination Letter to the Local Police (Annex I)
ARTICLE XXII
Guidelines on the Disposal of Confiscated Meat
SECTION 22.1 All the seized meat items shall be under the custody of the Task Force until it has been properly documented and disposed of by the LGU governing the confiscated items. The following shall be the minimum requirements in the disposal of meat seized during a strike operation:
All confiscated meat shall be disposed after 48 hours except those to be used as evidence in case of legal action. It shall be stored in a freezer storage to preserve its condition until the court have rendered judgment on the case;
As the need arises, five (5) two hundred fifty-gram (250g) samples units may be obtained randomly for organoleptic examination and other laboratory analyses. The laboratory results may be used as evidence in the on-going litigation
No confiscated items shall be donated to a charitable institution.
In cases where the violator was issued a notice of final warning and a summon order/show cause directive to appear and explain on the charges within 48 hours at the Pagadian City Meat Inspection Service (PCMIS), the seized items shall be disposed of properly. This action is for legal purposes in case the violator files a case against the regulatory agency.
Those confiscated meat items shall be either disposed of by:
Burying six (6) feet below the ground or
Passed for rendering in a registered rendering plant
Disposal procedures shall be properly documented for future reference. The condemnation receipt shall be signed by all concerned representatives, witnesses and other interested parties.
SECTION 22.2 All expenses incurred during the disposal of confiscated meat items shall be shouldered by the violator.
ARTICLE XXIII
Prohibited Acts
SECTION 23.1 No person, firm or corporation shall:
Slaughter any food animal or prepare meat in any Meat Establishment except in compliance with the requirements of this Ordinance;
Slaughter or handle in connection with slaughter, any food animal in a manner not considered humane;
Sell, transport, offer or receive for sale or transportation in commerce carcasses or parts thereof, meat required to be inspected under this Ordinance unless they have been so inspected and passed;
Do any act while they are being transported in commerce or held for sale, which is intended to cause or has the effect causing such articles to be adulterated or misbranded.
SECTION 23.2 Any person, firm or corporation found directly or indirectly violating any provision of this Ordinance, in addition to the penalties and sanctions prescribed herein, shall be charged under applicable laws.
Knowingly represent that any article has been inspected and passed under this Ordinance when, in fact, it has not been so inspected and passed.
SECTION 23.5 It shall be unlawful for any person, either for himself or in behalf of another person, firm or corporation or partnership to slaughter food animals which have not been submitted for ante-mortem inspection or to store, transport or sell carcasses, organs or parts thereof which have not been previously inspected and passed or have been found upon inspection to be unfit for human consumption.
SECTION 23.6 It shall be unlawful for any person, firm, or corporation to resist, harass, intimidate, assault, impede or interfere with any inspector during the performance of his duties and shall be held liable and charged accordingly under this Ordinance and other applicable laws. Any meat inspection officer who is harassed, intimidated, threatened, or assaulted during the performance of his duties shall be given full assistance by law enforcement agencies by the Local Government of Pagadian and other controlling authorities. A legal and Medical Assistance Fund shall be made available and taken from the City Meat Inspection Service Development Trust Fund (CM ISDTF) which shall be used for the legal and medical expenses of meat inspection officers and PCMIS personnel who are subjected to harassment, physical injury or retaliatory suits.
SECTION 23.7 It shall be unlawful for any person employed by the Local Government of Pagadian for the purpose of meat inspection work, to engage directly or indirectly in the business of buying, selling and trading or otherwise negotiating purchases or sales of meat for his own account or as an employee of another person, firm or corporation. Any person employed for the purpose of meat inspection work found directly or indirectly violating this section shall be charged under applicable laws, rules and regulations.
ARTICLE XXIV
Penalties and Sanctions
SECTION 24.1 Any carcass, parts of carcasses found to have been prepared, handled, packed, stored, transported or offered for sale as human food not in accordance with any provision of this Ordinance and other relevant laws and regulations shall be confiscated and disposed of properly at the expense of the person, firm, or corporation found to be in violation thereof.
SECTION 24.2 Any person who commits violation of any of the provisions stipulated herein shall be subjected to legal procedures guided by the penalties and sanctions provided in Chapter XIV of RA No. 10536, Section 9 of RA No. 10631, and Article XII of RA No. 10611.
SECTION 24.3 Administrative Penalties and Sanctions
Violation of Sections 23.1 and 23.2 of this Ordinance
First Offense - a fine of P1,500.00 and confiscation of meat;
Second Offense - a fine of P3,000.00 and confiscation of meat and three (3) months suspension from conducting business;
Third Offense - a fine of P5,000.00 and confiscation of meat and prohibition from conducting business for two (2) years
Violation of Sections 23.1.3 and 23.1.4 of this Ordinance
First Offense - a fine P1,500.00 and confiscation of meat
Second Offense - a P3,000.00 fine and confiscation of meat and three (3) months suspension from conducting business
Third Offense - a fine of P5,000.00 and confiscation of meat and prohibition from conducting business for two (2) years
Violation of Sections 23.3, 23.4, 23.5 and 23.6 of this Ordinance and "Hot Meat"
First Offense - a fine of P1,500.00 and confiscation of meat
Second Offense - a fine of P3,000.00 and confiscation of meat and three (3) month suspension from conducting business
Third Offense - a fine of P5,000.00 and confiscation of meat and prohibition from conducting business for two (2) years
Violation of Section 23.7
First Offense - Six (6) months suspension
Second Offense - Dismissal from government service
ARTICLE XXV
City Meat Inspection Service Development Trust Fund
SECTION 25.1 An independent and separate City Meat Inspection Service Development Trust Fund (CMISDTF) shall be established wherein Fifty Percent (50%) of collected fees, fines, charges and administrative fines shall be used for but not limited to the following purposes:
Regular repair, maintenance, improvement, upgrading or rehabilitation of the slaughterhouse facilities and meat section in the market to conform to the national standards;
Health assistance to PCMIS personnel who are physically injured while on duty;
Legal assistance to PCMIS personnel who are charged in court for causes related to work;
Establishment of PCMIS facilities such as but not limited to training center and laboratory facilities;
Capability development of the PCMIS personnel;
Operation of the Task Force "Bantay Karne";
Incentives to meat handlers, meat vendors, meat dealers, and other meat workers that are performing exceptionally in their compliance to sanitation standards;
Indemnification of condemned animals during ante-mortem inspection due to outbreaks;
Rice and groceries allowance for PCMIS personnel,
Payment of benefits such as provided in national laws such as, Magna Carta for S&T (Republic Act No. 8489), Section 14.1 of the DA-Administrative Order No. 01 Series of 2014 known as the "Revised Implementing Rules and Regulations RA 9296, otherwise known as The Meat Inspection Code of the Philippines" as amended by RA 10536 and others; and
Other forms of assistance and support to the livestock, poultry and meat industry in the province/ city.
ARTICLE XXVI
Separability Clause
SECTION 26.1 Should any provision, section, or part of this Ordinance be adjudged or declared illegal or unconstitutional by any court or competent jurisdiction, such judgment shall not affect or impair the remaining provision, sections, or parts, which shall continue to be in force and effect.
ARTICLE XXVII
Repealing Clause
SECTION 27.1 All Ordinances or provisions of Ordinances, which are inconsistent with this Ordinance, are hereby modified, revoked or repealed accordingly.
ARTICLE XXVIII
Effectivity Clause
SECTION 28.1 This Ordinance shall take effect immediately after its approval and publication in a newspaper of province-wide circulation for three (3) consecutive issues or after posting in two (2) conspicuous places of the city for fifteen (15) consecutive days.
