ORDINANCE NO: 2020-449 (Sponsored by: Committees on Commerce, Trade & Industry & Economic Enterprises and Cooperatives; and on Laws, Rules & Policy Formulation ) "AN ORDINANCE PROVIDING FOR AN EXTENSION OF THE PERIOD OF AVAILMENT ON THE GRANT OF INCENTIVES/PRIVILEGES STIPULATED AND/OR SPECIFIED UNDER CITY ORDINANCE NO. 2020-449, ENTITLED: "AN ORDINANCE ADOPTING AN UPDATED PAGADIAN CITY INVESTMENTS, INCENTIVES AND PROMOTION CODE OF 2019" UNTIL MARCH 31, 2021" WHEREAS, to stimulate local economic growth and development by increasing local capacities, enhance investment climate, promote productivity, generate employment, increase resources that will consequently improve the quality of lives of the locals, City Ordinance No. 2020-449, entitled: "An Ordinance adopting an updated Pagadian City Investments, Incentives and Promotion Code of 2019," was formulated and drafted in consonance thereof and mainly based on the current economic trend and analysis on fit and appropriate industries to be established in our City; WHEREAS, the onset of COVID-19 has severely affected all business sectors of the city, hence, to help these businesses recover/recoup their losses, as well as continually create an attractive atmosphere for investors, there is a need to extend the period of availment of the privileges offered by City Ordinance No. 2019-423 up to March 2021; NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the Sangguniang Panlungsod of Pagadian in session duly assembled that: SECTION 1. Declaration. - There is hereby declared an extension of the period of availment on the grant of incentives/privileges offered under City Ordinance No. 2019-423 until March 31, 2021. It shall be understood that, upon the expiration of the specified period, a written recommendation from the Honorable City Mayor for another extension may be granted and/or approved by the Sangguniang Panlungsod through a resolution extending the period of availment of such incentives provided under City Ordinance No. 423. SECTION 2. Supplementary Provision. - For purposes of this Ordinance, the phrase "up to March 2020" under Section 45 of Article XV, (Date of Effectivity) of City Ordinance No. 2019-423 is hereby deleted, which shall hereinafter be read as follows, to wit: "SECTION 45. Date of Effectivity. - This Code shall take effect after its publication once a week for two (2) consecutive weeks after its approval." SECTION 3. Repealing Clause. - All ordinances, rules, order and regulations or parts thereof contrary to or inconsistent with any of the provisions of this ordinance are hereby amended, modified and/or repealed accordingly. SECTION 4. Separability Clause. - If any provision of this ordinance or the application thereof to any person, barangay or circumstances is held invalid, the remainder of this ordinance and the application of such provisions to other persons or circumstances shall not be affected thereby. SECTION 5. Date of Effectivity. - This Ordinance shall take effect immediately upon its approval.
