ORDINANCE NO: 2020-448 (Sponsored by: Committee on Ways & Means) "AN ORDINANCE FURTHER RECLASSIFYING THE STALLS IDENTIFIED AS FOR RENTAL/LEASE IN ALL FLOOR LEVELS OF THE CITY COMMERCIAL CENTER (C3) AND PROVIDING FOR AN AMENDED RATES OF RENTAL THEREOF AND, IN EFFECT, AMENDING PARAGRAPH (A) OF SECTION 4, UNDER ARTICLE IX OF CITY ORDINANCE NO. 2020-448 AND SECTION 1 OF CITY ORDINANCE NO. 2020-448" WHEREAS, as the entire country is facing a formidable battle against the Coronavirus Disease (COVID-19), various public health measures and quarantine protocols were implemented and effected purposely to contain, if not prevent, the spread of such virus and--in the process--all sectors of society particularly the business and investor sector were severely affected thereto; WHEREAS, recognizing the foregoing predicament, this august body, taking into consideration the recommendation of the C3 Board and in an effort to help promote and sustain the viability of business ventures inside the City Commercial Center (C3), deems it practical and justifiable to amend and/or modify the ordinance by further reclassifying the stalls and adjust the corresponding rates of stall rentals thereat so as to provide economic relief to the affected stallholders; NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod (the 13th City Council) of Pagadian City in session assembled that; SECTION 1. - Paragraph (a) of Section 4, under Article IX of City Ordinance No. 2009-288, entitled: "An Ordinance Establishing the Guidelines and Policies Governing the Operation and Management of the City Commercial Center of the City Government of Pagadian and Imposing Penalties for Violation Thereof," and Section 1 of City Ordinance No. 2015-349, are hereby amended and shall thereafter be read as follows, to wit: "SECTION 4. - Stall Rentals/Sale. All stalls within the C3 shall be charged the following rental/sale fees: RENTALS, per Square Meter per month. All stall inside the C3 that are identified and classified as for rental/lease in the plan shall be rented out in accordance with the following rates. Ground Floor: Class "A" P405.00 per square meter/month Class "B" 395.00 per square meter/month Class "C" 385.00 per square meter/month Class "D" 375.00 per square meter/month Second Floor: Class "A" P315.00 per square meter/month Class "B" 305.00 per square meter/month Class "C" 295.00 per square meter/month Class "D" 285.00 per square meter/month Third Floor: Class "A" P225.00 per square meter/month Class "B" 215.00 per square meter/month Class "C" 205.00 per square meter/month Class "D" 195.00 per square meter/month Food Court Section Ground Floor P50.00 per square meter/day Second Floor 45.00 per square meter/day Third Floor 40.00 per square meter/day It shall be the responsibility of the City Government to maintain the cleanliness of these areas and provide the same with uniform tables and chairs which shall be made available for use by diners/patrons free of charge." Fourth & Fifth Floor: Office Spaces P200.00 per square meter/month SECTION 2. - Repealing Clause. - Paragraph (a) of Section 4, under Article IX of City Ordinance No. 2009-288, entitled: "An Ordinance Establishing the Guidelines and Policies Governing the Operation and Management of the City Commercial Center of the City Government of Pagadian and Imposing Penalties for Violation Thereof," and Section 1 of City Ordinance No. 2015-349, entitled: "An Ordinance Further Amending Paragraphs (a) and (b) of Section 4 under Article IX of City Ordinance No. 2009-288," and all other previous ordinances inconsistent with this Ordinance shall be deemed amended, modified or repealed accordingly. SECTION 3. - Effectivity Clause. - This Ordinance shall take effect immediately upon its approval.
