RESOLUTION NO. 2018-414 (Sponsor: Honorable Cesar C. Dacal, Jr) "A RESOLUTION ENACTING CITY ORDINANCE NO. 2018-414 WHICH IN SUBSTANCE RECALLS OF CITY ORDINANCE NO. 2018-414" WHEREAS, this Sangguniang Panlungsod during its 70th Regular Session on 23 January 2018 passed and enacted City Ordinance No. 2018-398, entitled: "An Ordinance Requiring All Drivers And Riders/Passengers Of Motorcycles To Wear Duly Approved Protective Half-Face Helmet With Uncovered Face While Driving And Imposing Penalty For Violation Thereof"; WHEREAS, the same ordinance was forwarded to the Honorable City Mayor for approval as mandated by Republic Act No. 7160, the Local Government Code of 1991, but that the same was returned unsigned by the City Chief Executive together with his endorsement requesting for its amendment through the inclusion of a explicit provision thereto exempting riders of motorcycles with engine displacement of 400 cubic centimeters and above from the use of half-face helmets as well as the reconsideration on the provision of the use of face masks as a matter of personal protection against airborne diseases, in case of outbreaks, or harmful gases; WHEREAS, the letter-comment Honorable City Mayor was referred to the Committee on Police, Fire & Public Safety and the Committee on Health & Social Services who then proposed its formal recall and recommended that the Committee on Laws, Rules & Policy Formulation be tasked to revisit the affected provisions and to come up with the necessary modifications in the interest of its practicality and enforceability; WHEREAS, this body now deems it to the best interest of public welfare to come up with the most practical regulation on the use of safety helmets and face masks by motorists that would be ideally applicable to local motorists as well as those passing through the territorial jurisdiction of Pagadian City thereby justifying the recall of City Ordinance No. 2018-398; NOW, THEREFORE, on seconded motion of Honorable Cesar C. Dacal, Jr., be it RESOLVED to enact, as this body in session assembled hereby enacts the hereunder quoted ordinance: CITY ORDINANCE NO. 2018-414 "AN ORDINANCE RECALLING CITY ORDINANCE NO. 2018-398" Section 1. Recall. - City Ordinance No. 2018-398, entitled: "An Ordinance Requiring All Drivers And Riders/Passengers Of Motorcycles To Wear Duly Approved Protective Half-Face Helmet With Uncovered Face While Driving And Imposing Penalty For Violation Thereof" is hereby recalled. Section 2. Effectivity. - This ordinance shall take effect immediately.
