ORDINANCE NO: 2018-405 (Co-Sponsors: Committee on Tourism, Sisterhood Program, Arts & Culture; Committee on Police, Fire and Public Safety; and Committee on Ways & Means) "AN ORDINANCE LIFTING THE IMPOSITION OF CURFEW IN THE CITY OF PAGADIAN THEREBY, IN EFFECT, REVOKING THE EFFECTIVITY OF CITY ORDINANCE NO. 2017-378, ENTITLED: "AN ORDINANCE IMPLEMENTING A CURFEW WITHIN THE TERRITORIAL JURISDICTION OF THE CITY OF PAGADIAN AND PROVIDING PENALTIES FOR VIOLATION THEREOF"" WHEREAS, City Ordinance No. 2017-378 was enacted by this Sangguniang Panlungsod purposely to pre-empt any spill-over of hostilities by restricting the free movement of people during the height of the military operations in the City of Marawi; WHEREAS, such bold move on the part of the City Government was implemented in the interest of public order and security notwithstanding its awareness of the negative impact of the imposition of curfew to local businesses; WHEREAS, with the restoration of normalcy in Marawi City and the recognizable confidence of its neighboring local government units on the matter of containment of the conflict with the neutralization of the assailants which observation is further bolstered by the assurance of the military authorities-on occasion of the Committees' joint meeting to evaluate the over-all peace and order condition-that there is no immediate threat to local and regional security in so far as insurgency and destabilization activities are concerned, this body deems it important to reconsider the city's stand on the matter of limiting civil liberties by way of a curfew; NOW, THEREFORE, Be It Ordained by the Sangguniang Panlungsod (12th City Council) of the City of Pagadian, in Session Assembled, that: SECTION 1. Declaration. - The imposition of curfew in the City of Pagadian is hereby lifted thus, in effect, revoke the effectivity of City Ordinance No. 2017-378, entitled: "An Ordinance Implementing a Curfew within the Territorial Jurisdiction of the City of Pagadian and Providing Penalties for Violation Thereof". SECTION 2. Repeal of Other Ordinances with Similar Intentions. - The enforceability of the following ordinances is likewise terminated, viz: a) Ordinance No. 89, series of 1946, "An Ordinance Prohibiting any Persons to Loiter or Go About the Poblacion of Pagadian, Zamboanga, Within the Limits, Without Any Specific and Justified Aim or Purpose, during the Time Herein Provided for"; and b) Ordinance No. 12, series of 1961, "An Ordinance Enforcing the Curfew Hour and Prohibiting Persons and Vehicles from going around the Municipality of Pagadian from 10:00 O'clock in the evening to 3:00 O'clock in the morning," as amended by Ordinance No. 11, series of 1968, and further amended by Ordinance No. 13, series of 1969 and Ordinance No. 25, series of 1970; SECTION 3. Effectivity. This Ordinance shall take effect upon its approval. ENACTED AND APPROVED by the 12th City Council of Pagadian City during its 91st Regular Session held on 03 July 2018 at the Sangguniang Panlungsod Session Hall, Pagadian City.
