ORDINANCE NO: 2018-402 Committee on Infrastructure, Public Bidding and Community Development "AN ORDINANCE AUTHORIZING THE TEMPORARY CLOSURE TO VEHICULAR TRAFFIC OF THE BRIDGE ALONG P.L. URRO STREET, GATAS DISTRICT, THIS CITY, PURPOSELY FOR THE CONSTRUCTION AND REPAIR OF THE SAME WITHIN A PERIOD OF 120 CALENDAR DAYS." WHEREAS, Section 21 of R.A. 7160 otherwise known as "The Local Government Code of 1991" provide that; "A Local Government Unit may, pursuant to an Ordinance, permanently or temporarily close or open any local road, alley park, or square falling within its jurisdiction: Provided, however, that in case of permanent closure, such ordinance must be approved by at least two-thirds [2/3] of all the members of the Sanggunian and when necessary, an adequate substitute for the public facility that is subject to closure is provided." WHEREAS, the City Government Pagadian, in line with the plans and programs of the National Government with reference to the massive construction, repair and widening of roads, bridges and the like, in pursuing the construction and repair of a bridge along P.L. Urro Street, Gatas District, this City; WHEREAS, there is a need to fast track the pursuance of the said project considering that the estimated period of completion is 120 calendar days, such that it is imperatively necessary to temporarily close both lanes of the bridge to vehicular traffic so as to avoid any work interruption aside from ascertaining the safety and security of both motorists and pedestrians alike passing the bridge. Be it ordained by the Sangguniang Panlungsod 12th City Council of the City of Pagadian in session assembled, that; Section 1. TITLE. - This Ordinance shall be known as "AN ORDINANCE AUTHORIZING THE TEMPORARY CLOSURE TO VEHICULAR TRAFFIC OF THE BRIDGE ALONG P.L. URRO STREET, GATAS DISTRICT, THIS CITY, PURPOSELY FOR THE CONSTRUCTION AND REPAIR OF THE SAME WITHIN A PERIOD OF 120 CALENDAR DAYS." Section 2. Prerequisite and Other Conditionalities in the implementation of the project - In effecting the foregoing project, there shall be proper observance and strict adherence to the following prerequisite and other conditionalities, to wit: The Contractor shall be required to install and set up appropriate billboards and/or signage in a conspicuous area notifying the public of the on-going construction and temporary closure of the bridge; The City Engineer, to prevent any untoward incident, must advise the contractor to strictly observe the contractor safety practices; The City Mayor through the Traffic Management Division shall formulate and implement re-routing scheme to help ease traffic congestion in the area; The contractor shall employ sound engineering practice and ensure that the project implementation is according to the plans and specifications; The 120 Calendar Days shall commence upon the effectivity of the ordinance. Section 3. Repealing Clouse - All existing ordinance, resolutions, motion or parts thereof not consistent herewith are hereby repealed, amended of superseded accordingly. Section 4. EFFECTIVITY. - This Ordinance shall take effect upon its approval.
