ORDINANCE NO: 2017-372 (Co-Sponsors: Committee on Finance & Appropriations; and Committee on Ecology) "AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF THE CITY ENVIRONMENT AND NATURAL RESOURCES OFFICE; DEFINING THE COMPOSITION AND FUNCTIONAL RESPONSIBILITIES OF THE DEPARTMENT; AND THE CREATION OF RELEVANT PERSONNEL POSITIONS AND DEFINING THE QUALIFICATIONS, DUTIES AND FUNCTIONS ATTACHED THERETO" Be it ordained by the Sangguniang Panlungsod (12th City Council) of the City of Pagadian, in session assembled that: SECTION 1. Creation. - There is hereby created and established in the personnel structure of the City Government of Pagadian the City Environment and Natural Resources Office. SECTION 2. Objective. - This Ordinance is enacted to focus, unify and synchronize local government action on all programs and priorities towards environmental protection, conservation and/or rehabilitation. SECTION 3. Primary Responsibilities. - The department shall be vested with the duty and responsibility to come up with a comprehensive plan and strategic measures consistent with national laws, issuances, rules and regulations as well as City Ordinance No. 2016-365, entitled: "An Ordinance Adopting an Updated Comprehensive Solid Waste Management Ordinance in the City Of Pagadian" for: forest protection & watershed management; solid waste collection, final disposal and other public services; pollution control & research; urban ecosystem development; and other concerns related to environment and ecology such as but not limited to Clean & Green, Eco-Tourism, Parks & Playgrounds SECTION 4. Organizational and Functional Structure. - The following personnel positions with its set qualifications are hereby created and/or effectively transferred from the Office of the City Mayor to operate and exercise the mandate of the office in accordance with the functions, duties and responsibilities hereunder specified, to wit: a) One (1) City Government Department Head I, Salary Grade 25. Functions, Duties & Responsibilities: 1) Formulate measures for the consideration of the Sangguniang Panlungsod (SP) and provide technical assistance and support to the City Mayor in carrying out measures to ensure the delivery of basic services and provisions of adequate facilities relative to the environment and natural resource services provided for under Section 17 of the Local Government Code (LGC); 2) Develop plans and strategies and upon approval thereof by the City Mayor implement the same, particularly those which have to do with the environment and natural resources programs and projects which the City Mayor is empowered to implement and which the SP is empowered to provide for under this Local Government Code; 3) In addition to the foregoing duties and function, the Department Head shall: i. Establish, maintain, protect, and preserve communal forest, watershed, tree parks, mangroves, greenbelts, and similar forest projects and commercial forest, like industrial tree farm and agro forestry projects; ii. Provide extension services to beneficiaries of forest development projects, technical, and infrastructure assistance; iii. Manage and maintain seed banks and produce seedlings for forest and tree parks; iv. Provide extension services to beneficiaries of forest development projects and render assistance for natural resources-related to conservation and utilization activities consistent with ecological balance; v. Promote the small-scale mining and utilization of mineral resources, particularly, mining of gold; vi. Coordinate with government agencies and non-government organization in the implementation of measures to prevent and control land, air, and water pollution with the assistance of DENR; vii. Be in the front-line of the delivery of services concerning the environment and natural resources, particularly in the renewal and rehabilitation of environment during and in the aftermath of man-made and natural calamities and disasters; viii. Recommend to the Sangguniang Panlungsod and advise the City Mayor on all matters relative to the protection, conservation, maximum utilization, application of appropriate technology and other matters related to the environment and natural resources; ix. Relate waste management and environment concerns to Philippine Agenda 21; x. Exercise such other powers and perform such other duties and functions as may be prescribed by law and ordinances. Qualifications: 1) Education : A degree holder preferably in environment, forestry, agriculture or any related course. 2) Eligibility : First Grade Civil Service Eligible or its equivalent. 3) Experience : At least Five (5) years relevant experience. 4) Other qualification : city resident and of good moral character Administrative Division: Functions: 1) Prepare budget and control funds of the Department and other accounting related works; 2) Perform works and keep records connected with personnel and personnel management; 3) Facilitate the compliance of pertinent documents for the procurement of supplies and materials of the department. 4) Perform proper & systematic recording, filing, encoding, and manage incoming and outgoing communications. 5) Facilitate the preparation of Office Performance Commitment and Review (OPCR) and consolidation of Individual Performance Commitment and Review (IPCR). Personnel: 1) One (1) Administrative Officer IV, Salary Grade 15 Duties and responsibilities: a. Takes charge of the Administrative Division. Gives work assignments to employees performing administrative and support functions. b. Ensures proper and systematic recording, filing, encoding, and manage incoming and outgoing communications. c. Initiates the preparation of Office Performance Commitment Review (OPCR) and consolidation of Individual Performance Commitment and Review (IPCR). d. Prepares memoranda, letters and other important documents upon instruction of the Department Head. e. Facilitates the preparation of DTR's, Accomplishment Reports, Project Procurement Management Plan (PPMP) and others as prescribed by other concerned offices. Qualifications: a. Education : A degree holder preferably in Business Administration major in Human Resource Management or any related course b. Eligibility : First Grade Civil Service Eligible. c. Experience : At least Two (2) years relevant experience. Environment and Natural Resources Division: Functions: 1) Implement plans and programs pertaining to natural resources using ridge to reef approach of environmental management; 2) Prepare an Environmental Management plan, policy development and recommendations; 3) Codify Environment related ordinances; 4) Ensure the protection of remaining 4,000 hectares forest, the sustainable development of 1,000 hectares forest buffer area and 7,000 hectares upland grasslands which constitute the upper watershed by instituting sound upland farming systems and alternative livelihood through a viable Community-Based Resource Management system; 5) Establish and maintain forest and agro-forest nurseries in strategic sites; 6) Implement community-based systems on marine and coastal resources management, development and protection: coral reef, mangrove, sea grass, and swampland with City Agriculture and DENR; 7) Ensure the sustainable development of the 30 kilometer river body length by establishing river line buffer, and quarry development regulation in coordination with DENR & Provincial Mining Regulatory Board; 8) Promote awareness on the holistic approach of environmental management and protection; 9) Establish, develop and maintain parks, islands and playground in the urban center; 10) Undertake greening and landscaping project in strategic areas to maintain a canopy of lush green trees and vegetation; 11) In coordination with DPWH implement roadside tree planting along highways or major thoroughfares to buffer air and noise pollution; 12) Develop plans, programs, and projects related to clean and green, eco-tourism, cleaning of waterways, rivers, parks and playgrounds; 13) Exercise such other powers and perform such other duties and functions that may be prescribed by law or ordinance. Personnel: 1) The Environment and Natural Resources Division, Office of the City Mayor, including its personnel bearing item numbers 115 to 125 is hereby transferred to this Department to undertake and perform the functions duties and responsibilities of this division. Waste, Pollution Control Management & Public Services Division: Functions: 1) Develop plans, programs, and projects on solid waste consistent with the approved 10-Year ESWM Plan of the City; 2) Conduct a Waste Assessment Characterization Study (WACS) every three years or as prescribed by the NSWMC; 3) Ensure the segregated collection and proper disposal of Residual and Special Waste from the collection point areas of the barangays; 4) Properly maintain the City Ecological SWM Park in consonance to the mandate of RA 9003 and other environmental laws & regulations; 5) Establish Eco-Center and Organic Demo Farms to showcase best practices on solid waste management; 6) In coordination with City Agriculture maximize to the fullest the production of organic fertilizer and promotion of organic farming in the city to be able to attain 72.14% solid waste reduction by 2025 onwards. 7) Ensure the management and cleanliness of public cemetery of the city. 8) Prepare Environmental Impact Statement (EIA) or IEE Checklist for projects of the City Government that requires ECC/CNC; 9) Ensure the submission of quarterly Self-Monitoring Report (SMR) and semi-annual Compliance Monitoring Report (CMR) to EMB-R9 for establishments and projects of the City; 10) Ensure the application for new projects and renewal of the same for "Permit to Operate" Air Pollution Source Installation and "Permit to Discharge" wastewater; 11) Monitor and evaluate the levels of land and water pollution within the City and conduct research and studies to design different pollution control measures; 12) Develop plans and program on pollution control and policy recommendation; 13) Exercise such other powers and perform such other duties and functions that may be prescribed by law or ordinance. Personnel: 1) The General Maintenance and Public Services Division, Office of the City Mayor, including its personnel bearing item numbers 176 to 190 is hereby transferred to this Department to undertake and perform the functions, duties and responsibilities of this division which shall be renamed and referred to as the Waste, Pollution Control Management & Public Services Division. SECTION 5. Transfer of direct supervision and control over personnel. - Upon approval of this ordinance and the constitution of the department, direct supervision and control over the Environment and Natural Resources Division and the General Maintenance & Public Services Division shall now be transferred to the City Environment and Natural Resources Office. SECTION 6. Budgetary Requirement. - Funds for personnel services and such necessary appropriations for maintenance and operating expenditures for the Department shall be provided in the Executive Budget of the City Government beginning January 2017. SECTION 7. Separability Clause. - In the event that any provision of this ordinance or parts thereof is declared unconstitutional, the other parts not so affected, shall remain in full force and effect. SECTION 8. Repealing Clause. - All ordinances, rules and regulations, or parts thereof whose provisions are in conflict with or contrary to the provisions of this ordinance, are hereby repealed, amended, or modified accordingly. SECTION 12. Effectivity. - This ordinance shall take effect immediately upon its approval.
