Asugas Co-Sponsors: Committee on Laws, Rules and Policy Formulation; Committee on Police Fire and Public Safety; and Committee on Barangay Affairs "AN ORDINANCE REQUIRING ALL BARANGAY GOVERNMENT UNITS WITHIN THE CITY OF PAGADIAN TO RESPECTIVELY MAINTAIN A DATABASE/LOGBOOK OF BARANGAY INHABITANTS INCLUDING THE LISTING OF THEIR VEHICLES AND ESTABLISH A REGISTRY LOGBOOK FOR VISITORS/TRANSIENTS/GUESTS TEMPORARILY STAYING IN HOUSEHOLDS, RENTABLE AREAS/BOARDING HOUSES INCLUDING INFORMATION ON THEIR VEHICLES" WHEREAS, based on the records of the Pagadian City Police Station a significant number of criminal incidents perpetrated locally are committed using vehicles for their get-away; WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the "Local Government Code of 1991" provides that: "Every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare. xxx among other things, the preservation and enrichment of culture, promote health and safety, xxxx maintain peace and order, and preserve the comfort and convenience of their inhabitants xxx" WHEREAS, the barangay could play a very important role in providing crime deterrence by strengthening within the confines of their jurisdiction an effective system of identifying residents and transients and monitoring their movements and activities; NOW THEREFORE, be it ordained by the Sangguniang Panlungsod (12th City Council) in session assembled that: Section 1. TITLE. - This Ordinance shall be known as: "AN ORDINANCE REQUIRING ALL BARANGAY GOVERNMENT UNITS WITHIN THE CITY OF PAGADIAN TO RESPECTIVELY MAINTAIN A DATABASE/LOGBOOK OF BARANGAY INHABITANTS INCLUDING THE LISTING OF THEIR VEHICLES AND ESTABLISH A REGISTRY LOGBOOK FOR VISITORS, RESIDENTS, TRANSIENTS, OR GUESTS TEMPORARILY STAYING IN WITH FAMILY RESIDENCES, RENTABLE AREAS/BOARDING HOUSES INCLUDING INFORMATION ON THEIR VEHICLES." SECTION 2. Definition of Terms. - As used in this Ordinance, the following word and phrases shall mean, to wit: database - a collection of updatable information of the residents of the barangay that is systematically organized and managed that is easily accessible whenever needed that shall contain information of persons and families, their personal details and circumstances including detailed information on their vehicles; inhabitants - refers to individuals taking permanent and/or semi-permanent residence within the barangay; visitors/transients/guests - refers to individuals and groups who take temporary residence in the barangay for a certain period; rentable areas/boarding house - refers to spaces leased for use by visitors/transients/guests as temporary dwellings for short periods of time; vehicles - shall mean any kind of land transportation equipment used by residents and/or visitors whether personally owned, leased or rented; SECTION 3. PURPOSES. - This Ordinance is enacted for the following intentions: as an effective tool to instill citizen's awareness and vigilance in the relentless pursuit of a crime-free environment through the collective and collaborative effort of the government and the residents; and to establish and maintain relevant information of the barangay's workforce. SECTION 4. ROLES, RESPONSIBILITIES, AND IMPLEMENTATION MECHANICS. - All Barangay Government Units, through the Office of the Punong Barangay, shall establish and maintain a database of all households in the Barangay and its inhabitants which shall contain, among others, the following data and the confidentiality of which shall be preserved at all times. The release of relevant personal information may be authorized by the Punong Barangay only upon written request by government law enforcement agencies and for justifiable medical emergency situations: Family Information: Name of the Head of the Family: Date and Place of Birth, Occupation Name of Spouse: Date and Place of Birth, Occupation Residential Address: (House Number, Purok, Street) Name of Children: their respective Dates & Places of Birth, Civil Status, Occupation Kinds of Vehicles owned: Type, Brand Name, Plate Number, Engine & Chassis Number, Color, Classification (private or public utility transportation) The Office of the Punong Barangay shall maintain a log book specifically for visitors/transients/guests coming into the barangay which shall contain the following details of the visitor(s), to wit: Names of the Visitors, their respective addresses, purpose of visit or stay; Brand Name, Type, Plate Number, Color, Classification (private or public utility transportation) of vehicle(s) used, if any. It shall be the duty and obligation of any and all barangay residents who will receive and/or accommodate visitors/transients/guests who shall be staying for at least one (1) day to provide the above-referred information to the Office of the Punong Barangay. In the case of boarding and lodging houses, it shall be the primary responsibility of the operator to require clients to register and present proof of identity and oblige such client to disclose the number of days or months of stay including such data on vehicles used, if any, before such boarders or lodgers may be accommodated. The information above gathered shall be reported to the Office of the Punong Barangay within six (6) hours after admission to stay. With reference to the vehicles used by transients/visitors/guests, the herein actions shall be performed by the concerned residents, viz: SECTION 5. EXEMPTION. - Hotels/Motels/Apartment buildings with CCTV Surveillance System is exempted by this ordinance because of the existing City Ordinance No. 2014-343 entitled: "An Ordinance Mandating Business Establishments operating within the territorial jurisdiction of the City of Pagadian to install closed circuit television system and prescribing penalties for violation thereof." SECTION 6. PENALTIES. - a) Failure of any barangay government unit to comply with the provisions of this ordinance shall subject the Barangay Chairman and the other responsible Barangay Officials to disciplinary action as provided for under Republic Act No. 7160. b) Release of relevant confidential personal information of any barangay resident from the database by any elective barangay official and/or appointed barangay worker without the written approval of the Punong Barangay or the Officer In-Charge in his absence, shall be subject to appropriate legal action as provided for under Section 60 of Republic Act No. 7160. SECTION 7. SEPARABILITY. - In the event any provision of this ordinance shall be declared invalid, the other parts hereof shall remain enforceable and in full force and effect. SECTION 8. EFFECTIVITY. - This Ordinance shall take effect immediately upon its approval. ENACTED AND APPROVED by the 12th City Council of Pagadian City during its 16th Regular Session held on 08 November 2016 at the Sangguniang Panlungsod Session Hall, Pagadian City.
