ORDINANCE NO: 2015-349 (Sponsored by: Committee on Ways & Means) "AN ORDINANCE FURTHER AMENDING PARAGRAPHS (a) AND (b) OF SECTION 4 UNDER ARTICLE IX OF CITY ORDINANCE NO. 2015-349, ENTITLED "AN ORDINANCE ESTABLISHING THE GUIDELINES AND POLICIES GOVERNING THE OPERATION AND MANAGEMENT OF THE CITY COMMERCIAL CENTER OF THE CITY GOVERNMENT OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF" WHEREAS, the City Government of Pagadian, in applying its proprietary function and in an effort to raise local revenue, established and operated the City Commercial Center (C3) right at the heart of the business district of the City; WHEREAS, to ensure an effective and efficient operation and management of the said facility, this Sanggunian, during its 95th Regular Session held on 01 September 2009, enacted City Ordinance No. 2009-288 which, in gist, established the Guidelines and Policies governing the operation and management of the City Commercial Center; WHEREAS, after quite some time in the course of its operation, and considering the recommendation of the C3 Board, it is thus established the necessity to amend and/or modify provisions of the ordinance so as to conform to the demand of the changing needs in furtherance of providing a better service to the C3 stallholders/stall owners, in particular, and the entire populace, in general; NOW, THEREFORE, in session assembled, be it ordained by the Sangguniang Panlungsod (11th City Council) of the City of Pagadian, that: SECTION 1. - The hereunder specified amendments and modifications to City Ordinance No. 2009-288, entitled: "An Ordinance Establishing the Guidelines and Policies Governing the Operation and Management of the City Commercial Center of the City Government of Pagadian and Imposing Penalties for Violation Thereof" are hereby instituted, to wit: a) The provision for "Ground Floor P50.00 per square meter/day" under the "Food Court Sections" of Item No. 4 in Paragraph (a) (RENTALS, per Square Meter per day) of Section 4 (Stall Rentals/Sale) under Article IX (Occupation, Ownership, Lease and Assignment of C3 Stalls) is hereby deleted thus the Item No. 4 shall now be read as follows: "4) Food Court Sections: Second Floor P45.00 per square meter / day Third Floor 40.00 per square meter / day It shall be the responsibility of the City Government to maintain the cleanliness of these areas and provide the same with uniform tables and chairs which shall be made available for use by diners/patrons free of charge." b) Item No. 1 (Ground Floor) under Paragraph (b) (SALE, per Square Meter) in Section 4 (Stall Rentals/Sale) of Article IX (Occupation, Ownership, Lease and Assignment of C3 Stalls) is hereby amended and modified with the addition/insertion of the herein provision: "Food Court Section, Class AA P52,000.00 per square meter." The same item and its stipulations shall now exist as: "1. Ground Floor: Food Court Section, Class AA P52,000.00 per square meter Class "A" 49,000.00 per square meter Class "B" 47,000.00 per square meter Class "C" 45,000.00 per square meter Class "D" 43,000.00 per square meter SECTION 3. Repealing Clause. - The pertinent provision of City Ordinance Nos. 2009-288, 2010-302 and 2011-325 which are inconsistent herewith are hereby repealed and/or modified accordingly; SECTION 4. Effectivity - This Ordinance shall take effect immediately upon its approval. ENACTED AND APPROVED by the 11th City Council of Pagadian City during its 70th Regular Session held on 17 March 2015 at the Sangguniang Panlungsod Session Hall, Pagadian City.
