ORDINANCE NO: 2015-346 (Co-Sponsors: Committee on Tourism, Sisterhood Program, Arts & Culture; and Committee on Laws, Rules & Policy Formulation) WHEREAS, records disclose based on the report of DOT Accredited Entities 2013-2014 of the Office of the Department of Tourism Region IX that there are tourism enterprises (primary & secondary) within the city that are still not accredited/recognized with the Department of Tourism due to their minimal response on the said accreditation, a citywide simultaneous mandatory accreditation of primary tourism enterprises and voluntary accreditation of secondary tourism enterprises is warranted in order to promote the city as a safe and wholesome tourist destination; WHEREAS, pursuant to Republic Act No. 9593 "Tourism Act of 2009" under Section 14 (c) in subchapter II-A that the Office of Tourism Standards and Regulation is co-mandated to develop and enforce a comprehensive system of mandatory accreditation for primary tourism enterprises, and voluntary accreditation for secondary tourism enterprises, in accordance with prescribed guidelines and standards; WHEREAS, mandatory accreditation of all primary tourism enterprises cannot be implemented without the assistance of the local government units; NOW THEREFORE, be it ordained by the Sangguniang Panlungsod 11th City Council, in session assembled that: SECTION 4. DEFINITION OF TERMS - As used in this ordinance, the following words, acronyms or phrases shall be defined as follows: Department refers to the Department of Tourism created pursuant to Presidential Decree No. 189 (1973), as amended. Tourism enterprises refers to facilities, services and attractions involved in tourism, such as, but not limited to: travel and tour services; tourist transport services, whether for land, sea or air transportation; tour guides; adventure sports services involving such sports as mountaineering, spelunking, scuba diving and other sports activities of significant tourism potential; convention organizers; accommodation establishments, including, but not limited to, hotels, resorts, apartelles, tourist inns, motels, pension houses and home stay operators; tourism estate management services, restaurants, shops and department stores, sports and recreational centers, spas, museums and galleries, theme parks, convention centers and zoos. Primary tourism enterprises refers to travel and tour services; land, sea and air transport services exclusively for tourist use; accommodation establishments; convention and exhibition organizers; tourism estate management services; and such other enterprises as may be identified by the Secretary, after due consultation with concerned sectors. SECTION 7. EFFECTIVITY. This Ordinance shall take effect immediately upon its approval.
