""AN ORDINANCE CREATING AND PROVIDING SUPPLEMENTAL GUIDELINES FOR THE PROCEEDS OF THE PRIMARY CARE BENEFIT 1 (PCB1) TO BE PROVIDED BY THE PHILIPPINE HEALTH INSURANCE CORPORATION FOR THE QUALIFIED BENEFICIARIES AND DEPENDENTS ENLISTED UNDER THE INDIGENCY PROGRAM OF HIS EXCELLENCY PRESIDENT BENIGNO SIMEON C. AQUINO III KNOWN AS THE FOUR (4) Ps (PANTAWID-PAMILYANG PILIPINO PROGRAM)"

	Be it ordained by the Sangguniang Panlungsod of the City of Pagadian in session assembled, that:

SECTION 1. - TITLE. This ordinance shall be known as the "The Supplemental Guidelines on the Use of the PhilHealth Trust Fund for the Primary Care Benefit (PCB) Package" exclusively applying to the City Health Office of Pagadian City.

SECTION 2. - MAINTENANCE OF PHILHEALTH PCB1 FUNDS. A PhilHealth Trust Fund is to be created and be maintained and will receive from the proceeds of the Primary Care Benefits 1 to be provided by the Philippine Health Insurance Corporation (PhilHealth) for the qualified members and dependents of the Sponsored Programs enlisted under the 4Ps (Pantawid Pampamilyang Pilipino Program) in the City of Pagadian. 

SECTION 3. - USE, MANAGEMENT AND DISPOSITION OF THE PER FAMILY PAYMENT RATE (PFPR). - The use, management and disposition of the Per Family Payment Rate shall be governed by the following rules:

The Per Family Payment Rate (PFPR) shall be released on a quarterly basis by PhilHealth under the following conditions:

3.1. 	Eighty (80%) Percent of the PFPR is for operational cost and shall be divided as follows:

a. Minimum of Forty (40%) Percent for drugs and medicines (Philippine National Drug Formulary) (to be dispensed at the facility) including drugs and medicines for:

a.1	Asthma
a.2	Acute Gastro-Enteritis, and;
a.3	Pneumonia

b.	Maximum of Forty (40%) Percent for re-agents, medical supplies, equipment (i.e., ambulance, ambubag, stretchers, etc.), information technology (IT equipment specific for facility use needed to facilitate reporting and database build-up), capacity building for staff, infrastructure or any other use related, necessary for the delivery of required service including referral fees for diagnostic services if not able in the facility.

3.2.	The remaining Twenty (20%) Percent shall be exclusively utilized as honoraria of the staff of the PCBI facility and for the improvement of their capabilities as would enable them to provide better health services:

a.	Ten percent (10%) for the physician;
b.	Five percent (5%) for other health professional staff of the facility; and 
c.	Five percent (5%) for non-health professionals/staff, including volunteers and community members of health teams (e.g., Women's Health Team, Community Health Teams).

SECTION 4. - ADVOCACY FOR NHIP PARTICIPATION AND MANDATING COMPLIANCE TO NHIP RULES. The Sangguniang Panlungsod agrees to actively advocate for NHIP participation by private and non-government organizations within its territorial jurisdictions and mandating compliance to NHIP rules by entities to obtain LGU permits/licenses.

SECTION 5. - REPEALING CLAUSE. - All ordinances, orders, rules and regulations or part thereof, which are inconsistent with any provision or portion of this ordinance are hereby deemed repealed or modified accordingly.

SECTION 6. - SEPARABILITY CLAUSE. - If for whatever reason any part of this Ordinance is declared invalid or unconstitutional by competent authority, those that are held valid or can stand by itself should continue to be in full force and effect.

SECTION 7. - EFFECTIVITY CLAUSE. - This Ordinance shall take effect after compliance and approval with the provision of Section 16 and Section 447 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991 and other existing laws and regulations.

ENACTED AND APPROVED by the 11th City Council of Pagadian City during its 5th Regular Session held on August 13, 2013 at the Sangguniang Panlungsod Session Hall, Pagadian City.
