ORDINANCE NO: 2012-332 "AN ORDINANCE AMENDING ARTICLE IX OF CITY ORDINANCE NO. 2012-332, ENTITLED: "AN ORDINANCE ESTABLISHING THE GUIDELINES AND POLICIES GOVERNING THE OPERATION AND MANAGEMENT OF THE CITY COMMERCIAL CENTER OF THE CITY GOVERNMENT OF PAGADIAN AND IMPOSING PENALIES FOR VIOLATION THEREOF" BY ADDING A SPECIFIC SECTION TO PROVIDE FOR A SET OF FEES FOR ADVERTISEMENT/ANNOUNCEMENTS" Be it ordained by the Sangguniang Panlungsod (10th City Council) of Pagadian City, in session assembled, that: SECTION 1. Power to Establish, Form, Location, Application, Etc. - That pursuant to the provision of the Local Government Code, the City Government of Pagadian is authorized in the exercise of propriety function to establish an economic enterprise that would increase the revenue collections of the LGU in order to strengthen its public services through funds derived from its operation. In line with this, the City Government of Pagadian shall operate a commercial building to be known as City Commercial Center (C3) which is located at Barangay Santiago, Pagadian City. That the stalls of the said commercial building shall be sold to the general public to the highest bidder and shall be in accordance with COA rules and regulations. SECTION 2. Article IX of City Ordinance No. 2009-288 is hereby amended with the insertion of Section 5 as follows, to wit: Advertisement/announcement outside wall of the building. a. Corner Pajares & Rizal Ave. P220.00/sq.m/month b. Pajares Ave. Upper portion P220.00/sq.m/month c. Pajares Ave. Lower portion P180.00/sq.m/month d. Pajares Ave. corner Jamisola P160.00/sq.m/month e. Ariosa St., Upper portion P140.00/sq.m/month f. Ariosa St., Lower Portion P140.00/sq.m/month Advertisement/Announcement inside the building particularly at the atrium. a. Stall owners/Lessee P 2.50/sq.m/day b. Non-Stall Owners/Non-Lessee P 5.00/sq.m/day SECTION 3. Adjustments - The section numbers of Section 5, Section 6, Section 7, up to Section 25 shall be accordingly adjusted to accommodate the above-referred amendment. SECTION 4. Separability Clause - If for any reason any provisions, section or part of this ordinance be declared invalid or unconstitutional by a court of competent jurisdiction, such judgment shall not affect or impare the remaining provision, sections of existing laws and other ordinance. SECTION 5. Repealing Clause - All Ordinances, Rules and Regulations or part(s) thereof which may be in conflict or inconsistent with any provisions or this ordinance are hereby repealed or modified accordingly. SECTION 6. Effectivity - This ordinance shall take effect immediately upon its approval.
