ORDINANCE NO: 2012-331 "AN ORDINANCE DECLARING AND OBSERVING THE 6th - 12th DAY OF JULY AS THE COMMEMORATION OF THE PAGADIAN CITY BUSINESS WEEK" WHEREAS, the National Government led by the Department of Trade and Industry celebrates the SMALL & MEDIUM ENTERPRISE DEVELOPMENT WEEK nationwide simultaneously thus making the activity more meaningful and significant; WHEREAS, the institutionalizing observance of the Business Week locally will provide entrepreneurs, businessmen and aspiring students taking HRM and related courses within the vicinity of Pagadian City with an avenue for the sharing of updates, information and ideas to enhance and expand their knowledge on trade and commerce and strengthen the city's trade and industry sector; NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod (10th City Council) of Pagadian City, in session assembled, that: SECTION 1. Title. - This Ordinance shall be known as "An Ordinance Declaring and Observing the 6th - 12th day of July as the Commemoration of Pagadian City Business Week" otherwise known as "Pagadian City Business Week." SECTION 2. Coverage. - The Ordinance shall apply to the entire territorial jurisdiction of the City of Pagadian. SECTION 3. Scope. - The celebration shall be a seven (7) day activity to commence on July 6 and will culminate on July 12. SECTION 4. Coordinating Body. - The Trade-Tourism Promotions Division under City Mayor's Office and the Tourism Council with the collaboration of Pagadian-ZDS Chamber of Commerce & Industry Foundation, Incorporation (PZCCIFI) shall be the coordinating body of the "Pagadian City Business Week" celebration with the participation of different Educational Institutions offering HRM courses, Agricultural Sector, and Entrepreneur Sector. SECTION 5. Celebration and Activities. - Businessmen and students from the Educational Institution offering HRM Courses shall annually celebrate every July 6 to 12 by conducting following activities, among others, to wit: PAKALS - a culinary competition to be participated in by educational institution in the city that are offering HRM courses; Agricultural Forum; Entrepreneurial Forum; SECTION 6. Creation of a Multi-Sectoral Committee; its Functions & Responsibilities. - There is hereby created a Multi-Sectoral Committee that shall be composed of the following: Chairman : City Mayor Vice-Chairman : SP Committee on Trade & Industry & Economic Enterprise & Cooperatives Members : PZCCIFI President PZCCIFI Board of Directors and Members Trade-Tourism Promotion Division Officer Chairman, Pagadian City Tourism Council Representative of the Business Sector Representative of the Academic Sector (from the Educational Institutions offering HRM courses) Representative of the Agriculture Sector and shall be invested with the following functions and responsibilities, to wit: Plan and oversee the celebration which will be conducted in accordance to an approved theme; Undertake post-activity evaluations to further improve the conduct of future activities; Formulate such pertinent guidelines for the search and grant of awards, subject to the approval of the Sangguniang Panlungsod; Initiate the conduct of fund raising drives for the prizes and awards or propose to the Sangguniang Panlungsod the appropriation of funds for the expenditures of the celebration; and Perform such other duties and responsibilities relevant to the celebration and its activities or as may be delegated by the City Mayor. SECTION 7. Appointments. - The membership of the representatives from the different sectors to the Multi-Sectoral Committee shall be effective upon their appointment by the City Mayor. SECTION 8. Separability Clause. - If for any reason any provisions, section or part of this ordinance be declared invalid or unconstitutional by a court of competent jurisdiction, such judgment shall not affect or impart the remaining provision, sections of existing laws and other ordinance. SECTION 9. Applicability Clause. - All other matters relating to the impositions in this ordinance shall be governed by the pertinent provisions of existing laws and other ordinances. SECTION 10. Repealing Clause. - All Ordinances, Rules and Regulations or part(s) thereof which maybe in conflict or inconsistent with any provisions or this ordinance are hereby repealed or modified accordingly. SECTION 11. Effectivity. - This ordinance shall take effect immediately upon its approval. ENACTED AND APPROVED by the 10th City Council of Pagadian during its 83rd Regular Session held on 10 July 2012 at the Sangguniang Panlungsod Session Hall, Pagadian City.
