ORDINANCE NO: 2011-321 Sponsor: Committee on Infrastructure, Public Bidding & Community Development Co-Sponsor: Committee on Laws, Rules & Policy Formulation; and Committee on Education, Science, Technology & Accreditation "AN ORDINANCE DECLARING THE PERMANENT CLOSURE OF A PORTION OF SANSON STREET FROM CORNER SALERA STREET UP TO THE GATAS CREEK, SITUATED AT BARANGAY GATAS, THIS CITY" WHEREAS, with reference to the thrust of the City Government to make public education more accessible to its constituency, priority is set to help the city's component barangays having no existing public elementary schools in establishing one in their respective areas; WHEREAS, in relation to this program, Barangay Gatas-being without an established public elementary school, through its Sangguniang Barangay, sought for the permanent closure of a portion of Sanson Street (junction Salera Street and Gatas Creek) and for the declaration of the referred portion as the permanent school site of the proposed Barangay Gatas Elementary School; WHEREAS, information provided by the Offices of the City Planning & Development Coordinator and the City Engineer disclose that there are no immediate or future development plans considered by the City Government involving the use of the referred segment of the road mainly due to its natural condition; WHEREAS, the permanent or temporary close any local road, alley, park or square within the jurisdiction city is within the purview of the powers delegated unto the Local Government Units under Republic Act No. 7160 particularly Section 21, Chapter 2 , thus the enactment of an enabling ordinance is deemed imperative; NOW THEREFORE, be it ordained by the Sangguniang Panlungsod (10th City Council) in session assembled that: Section 1. - Closure. The portion of Sanson Street from corner Salera Street up to the Gatas Creek, situated at Barangay Gatas, this City, is hereby declared closed; providing, allocating and reserving, however, a road-right-of-way (alley) measuring three (3) meters wide in both sides of the area as ingress and egress to the interior lots. Section 2. - Allocation. The remaining space within the area closed in the preceding section is hereby designated and allocated as site of the Barangay Gatas Elementary School. Section 3. - Repealing Clause. Any ordinance or provision thereof inconsistent to this Ordinance is hereby amended or repealed. Section 4. - Effectivity. This Ordinance shall take effect immediately upon its approval.
