ORDINANCE NO: 2010-311 "AN ORDINANCE FURTHER AMENDING/MODIFYING CITY ORDINANCE 2009-288, ENTITLED: "AN ORDINANCE ESTABLISHING THE GUIDELINES AND POLICIES GOVERNING THE OPERATION AND MANAGEMENT OF THE CITY COMMERCIAL CENTER OF THE CITY GOVERNMENT OF PAGADIAN AND IMPOSING PENALTIES FOR VIOLATION THEREOF" Be it ordained by the Sangguniang Panlungsod (10th City Council) of the City of Pagadian in session assembled, that: SECTION 1. To enhance the operational viability of the City Commercial Center (C3), the herein modifications shall supplant the provisions of City Ordinance No. 2009-288 particularly Items (a) and (b) in Section 4 of Article IX (Occupation, Ownership, Lease and Assignment of C3 Stalls), to wit: a) RENTALS of Stalls and Kiosks. All spaces inside the C3 that are identified and classified as for rental/lease in the plan shall be rented out in accordance with the following rates, viz: Ground Floor: Class "A" P 50.00 per square meter/day Class "B" 45.00 per square meter/day Class "C" 360.00 per square meter/month Second Floor: Class "A" P 40.00 per square meter/day Class "B" 35.00 per square meter/day Class "C" 320.00 per square meter/month Third Floor: Class "A" P 30.00 per square meter/day Class "B" 25.00 per square meter/day Class "C" 280.00 per square meter/month Food Court Sections: Ground Floor P 50.00 per square meter/day Second Floor 45.00 per square meter/day Third Floor 40.00 per square meter/day It shall be the responsibility of the City Government to maintain the cleanliness of these areas and provide the same with uniform tables and chairs which shall be made available for use by diners/patrons free of charge. Fourth & Fifth Floor: Office Spaces P 350.00 per square meter/month The rates above-specified and fixed are inclusive of the uniform amount of Thirty (P30.00) Pesos per square meter per month for the Common Utility Service Areas (CUSA). However, the C3 Management shall, starting on the third year of operation, be authorized to impose an annual Five (%) Percent increase in the rates of rental and the CUSA. b) Lease of Stalls. The hereunder specified areas of the City Commercial Center and the rest of the spaces otherwise mentioned or included in item (d) of this Section are designated as for lease and shall be available for disposition based on the rates of rental specified in letter (a) of this Section, to wit: 1. First Floor. The area measuring Four Hundred Eighty-Five (485) square meters located in the southeast portion (corner J. Ariosa & F. Jamisola Streets); 2. Third Floor. The area located in the southeast portion (corner J. Ariosa & F. Jamisola Streets) measuring Four Hundred Twenty-Five (425) square meters and the southwest portion (corner F.S. Pajares Avenue & F. Jamisola Street) measuring Three Hundred Fifty-Two (352) square meters. c) SALE of Stalls, per Square Meter. All stalls within the C3 which are identified and classified as "for sale" in the succeeding provision shall be disposed of through public auction in accordance with the following prescribed floor rates, to wit: Basement: Class "A" P40,000.00 per square meter Class "B" 37,000.00 per square meter Ground Floor: Class "AA" P52,000.00 per square meter Class "A" 49,000.00 per square meter Class "B" 47,000.00 per square meter Class "C" 45,000.00 per square meter Class "D" 43,000.00 per square meter Second Floor: Class "A" P46,000.00 per square meter Class "B" 44,000.00 per square meter Class "C" 42,000.00 per square meter Third Floor: Class "A" P42,000.00 per square meter Class "B" 40,000.00 per square meter Class "C" 38,000.00 per square meter d) Stalls for Sale, Classification. Section 6 of Article 7 is likewise amended and modified as follows: SECTION 6. - Amount to be Deposited, in case of Lease. a) It shall be obligatory for awardees of stalls for lease to pay, within ten (10) working days after awarding, to the City Treasurer, a non-refundable occupancy fee equivalent to three (3) months of the monthly rental. Only after such fee is paid and the accomplishment of the required documents shall the awardees be allowed to occupy their respective designated stalls. Failure to pay the same within the prescribed time would subject the cancellation of the award. b) Security Deposit. The awardees of all leased areas Two Hundred (200) square meters and above in the first and second floors of the City Commercial Center shall be required to post with the City Treasurer, over and above the Occupancy Fee above-stipulated, a refundable Security Deposit equivalent to three (3) months of the total monthly rental. c) Pre-termination. Lease contracts of stalls may be pre-terminated at the option of the lessee within three (3) months upon written notice. No penalties shall be imposed and the Security Deposit fully refunded. SECTION 3. The payment scheme for such stalls identified for sale the terms of which is provided under Section 7 of Article 7 as amended by Section 2 of City Ordinance No. 2010-302 is likewise modified and superseded by the options and payment schedule hereunder specified, viz: SECTION 7. - Stalls For Sale, Payment Scheme. Any and all awardees of stalls identified for sale may occupy their chosen and assigned units upon payment of the required fees based on the hereunder terms and options, to wit. Repealing Clause. - Pertinent provisions of City Ordinance No. 2009-288 and 2010-302 are hereby repealed and/or modified accordingly. SECTION 4. Effectivity. - This Ordinance shall take effect immediately upon its approval.
