ORDINANCE NO: 2009-278 Sponsors: SP Members E. D. Arao and Ricardo S. Alajeno SECTION 3. Definition of Terms. For the purpose and interpretation of this ordinance, the following terms shall mean: Barangay Clearance. A written document officially issued by the concerned barangay government upon careful study or review of certain required data and the payment of stipulated fee(s), where such document is a pre-requisite for the issuance of permits or licenses by the City or other higher authorities as needed by a person or juridical person. Building Permit. A written document issued by the City Government upon careful examination of all necessary support data and payment of stipulated fee(s) for the construction of a building within the city's jurisdiction as needed by a person or a juridical entity. Failure on the part of the department concerned to comply with this provision shall mean an ADMINISTRATIVE LIABILITY, unless such act is supported with appropriate lawful evidence, which is also provided for in this ordinance. SECTION 5. Issuance of Barangay Clearance. For such clearance, the Sangguniang Barangay shall impose a reasonable fee for barangay clearance issuances through a Barangay Ordinance which must be duly reviewed and confirmed by the Sangguniang Panlungsod. The application for such barangay clearance shall be acted upon by the barangay concerned within seven (7) working days from the filing thereof. SECTION 6. Forfeiture of the Barangay Clearance. In the event that the clearance is not issued within the above-prescribed period without valid reason, the City may issue the needed license or permit as applied for, but which must be duly supported by lawful evidence(s). SECTION 7. Formulation of the Implementing Rules and Regulations (IRR). To facilitate ease of enforcement of this ordinance, the Offices of the Building Official and the City Assessor shall jointly lead the formulation of the IRR in coordination with the City Legal Office, City Engineer's Office, City Treasurer's Office, City License and Permits Division, Liga ng mga Barangay and the City DILG. SECTION 8. Repealing Clause. All other statutes inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly. SECTION 9. Separability Clause. If any provision or part hereof is declared invalid or unconstitutional, the remainder of the ordinance or part thereof not otherwise affected shall remain valid and subsisting. SECTION 10. Effectivity Clause. This ordinance shall take effect upon its approval.
