Culve) "AN ORDINANCE SETTING THE STANDARDS FOR QUALIFICATION, ACCREDITATION, MONITORING & EVALUATION OF NON-GOVERNMENTAL/PEOPLES ORGANIZATIONS (NGOS/POS) AND THE PRIVATE SECTOR IN THE CITY OF PAGADIAN" BE IT ORDAINED by the Sangguniang Panlungsod, Pagadian City in session assembled that: Section 1. Title.- This ordinance shall be known as the "Ordinance Setting the Standards for Qualification, Accreditation, Monitoring & Evaluation of Non-Governmental/Peoples Organizations and (NGOs/POs) "and the Private Sector in the City of Pagadian". Section 2. Purpose.- It shall be the declared policy of the city to promote the establishment and operation of POs, NGOs and the private sector, to make them active partners in the pursuit of local autonomy. For this purpose, they shall be directly involved in any of the following plans, programs, projects or activities of the City Government: Local special bodies Delivery of basic sources & facilities Joint ventures and cooperative programs or undertakings Financial and other forms of assistance Preferential treatment for organization and cooperatives of marginal fishermen Preferential treatment for cooperatives development and Financing, construction, maintenance, operation and management of infrastructure projects. Section 3. Linkages with POs and NGOs.- The City may enter into joint ventures and such other cooperative arrangements with POs and NGOs to engage in the delivery of certain basic services, capability - building and livelihood projects, and to develop local enterprises designed to improve productivity and income, diversify agriculture, spur rural industrialization, promote ecological balance, and enhance the economic and social well-being of the people. Section 4. Procedures and Guidelines for Accreditation and Selection of Representatives of POs ,NGOs or private sector in Local Special Bodies. Section 6. Preferential Treatment for Cooperatives. Upon approval by a majority vote of all its members, the Sangguniang Panlungsod may grant a franchise to any person, partnership, corporation or cooperative to establish, construct, operate and maintain ferries, markets or slaughterhouses or such other similar activities within the city as may be allowed by applicable laws. However, city accredited cooperatives shall be given PREFERENCE in the grant of franchises as contemplated in this Ordinance. Section 7. Delivery of Basic Services and Facilities.- Pursuant to this provision, the City may sell, lease, encumber, or otherwise dispose of its public economic enterprise(s) in its proprietary capacity to the city accredited private sector to ensure their active participation in local governance. Section 8. Preferential Treatment for Organizations and Cooperatives. The duly registered and city accredited organizations and cooperatives of marginal fishermen shall have preferential rights in the grant by the Sangguniang Panlungsod to erect fish corrals, oyster, mussel or aquatic beds or bangus fry areas within a definite zone of the Pagadian municipal waters. Section 9. Financing, Construction, Maintenance, Operation and Management of Infrastructure Projects by the Private Sector. The City may enter into contract with any duly prequalified and city accredited contractor for the financing, construction, operation and maintenance of any financially viable infrastructure facilities under the Build-operate-and-transfer (BOT) agreement subject to the applicable provisions of R.A. 6957 authorizing the financing. Section 10. Formation of Federations. Every sectoral PO, NGO or Private Sector may federate themselves, PROVIDED that the would-be members are all city accredited organizations. The federation, thus formed shall formulate its own constitution and by-laws which shall be submitted to the Sangguniang Panlungsod for review and confirmation. Section 11. Non- accredited POs, NGOs and Private Sectors which have not submitted for accreditation cannot qualify to participate in any of the city plans, program or activities, nor can it it be granted any form of assistance. Section 12. Monitoring and Evaluation. All city accredited POs, NGOs and Private Sectors shall submit their respective annual accomplishment reports to the City DILG and Sangguniang Panlungsod for review and evaluation every July each year, starting July 2008. Section 13. Penalty on non-submission of annual accomplishment report. Failure to submit the annual accomplishment report on the scheduled date, as herein stipulated in this ordinance, shall mean REVOCATION/or EXPIRY of ACCREDITATION, thus, the concerned organization shall be barred/excluded from participating in any of the City plans, programs, projects or activities, to include financial or other forms of assistance. Section 14. Implementing Rules and Regulations (IRR). The City Planning and Development Office, in collaboration with the City Legal Office and the City DILG, shall formulate the IRR for the immediate enforcement of this ordinance. Section 15. Effectivity. This ordinance shall take effect immediately upon its approval. ENACTED AND APPROVED by the Ninth City Council of Pagadian City during its 26th Regular Session held on February 12, 2008 at the Sangguniang Panlungsod Session Hall.
