ORDINANCE NO: 2007-257

BE IT ORDAINED by the Sangguniang Panlungsod of the City of Pagadian in Session assembled:

SECTION 1. TITLE- This Ordinance shall be known as "Regulatory Ordinance on the gathering, shipment, sale and/or distribution of shellfish within the City of Pagadian. This is also to be referred to as the Anti-Red Tide Ordinance of Pagadian City.

SECTION 2. PURPOSE- This ordinance is adopted to safeguard the consuming public from hazardous/toxic effects of Red Tide infested shellfishes which may be unlawfully harvested. A shellfish infected with red tide is highly toxic and taking it for fond can cause paralytic poisoning which can result to permanent injury or death to any human person.

SECTION 3. DEFINITION OF TERMS- The term as used in this ordinance shall be construed as follows:
Auxiliary Invoice. A document accompanying the shipment of shellfish issued by the Local Agricultural Officer concerned from the point of origin to its final destination within the Philippines stating the kind of fishery project being transported, its quantity, estimated value if sold, the fee paid therefore, the serial number of the receipt used and the clear identity of the person who received the payment; all these being intended to monitor the movement of shellfish within the country.

Bivalve. An animal with two valve shells, e.g., clam, mussel, oyster, etc.

SECTION 5. PENALTY- Violation of this ordinance shall subject the offender to the penalty of a fine of not less than ONE THOUSAND (P1,000.00) PESOS but not more than TWO THOUSAND FIVE HUNDRED (P2,500.00) PESOS or an imprisonment of not less than One (1) month but not to exceed Six (6) months, or both in the discretion of the court

SECTION 6. REPEALING CLAUSE-  All existing ordinances or parts thereof which are inconsistent with the provisions of this ordinance are hereby repealed or modified accordingly.

SECTION 7. SEPARABILITY CLAUSE-  If any section or provision of this Ordinance or the application thereof to any person or circumstance is held invalid or unconstitutional, the remainder shall not be affected thereof.

SECTION 8. EFFECTIVITY- After validation by the Sangguniang Panlalawigan, this ordinance shall take effect within ten (10) days after its posting in the bulletin board at the City Hall and in two (2) other conspicuous places within the City and its publication in a local newspaper.

ENACTED AND APPROVED by the Sangguniang Panlungsod (8th City Council) of Pagadian City during its 124th Regular Session held on March 20, 2007 at the Sangguniang Panlungsod Session Hall.
