ORDINANCE NO: 2006-252 "AN ORDINANCE PRESCRIBING THE POLICIES AND GUIDELINES FOR THE PROPER UTILIZATION OF THE CITY'S SPORTS COMPLEX" Be it Ordained by the Sangguniang Panlungsod of Pagadian City in Session assembled: SECTION 1. - This ordinance shall be known as "AN ORDINANCE PRESCRIBING THE POLICIES AND GUIDELINES FOR THE PROPER UNITILIZATION OF THE CITY'S SPORTS COMPLEX." SECTION 2. - Definition of Terms: As herein used, the following would mean: GYMNASIUM - refers to the entire edifice containing a space/court and equipment (s)/facilities for various indoor activities located at San Francisco District, this City formerly known as ZSPCTA GYM hereinafter referred to as the CITY GYM. OVAL - refers to the area where outdoor games are played including its surrounding bleachers. LESSEE - refers to an individual person, organization, entity or agency that rents in order to make use or enjoy the utilization of the City Gymnasium, its facilities, the oval and/or the entire sports complex. FACILITIES - refers to the equipments to be used for various indoors and outdoors activities which include the Sound Systems, Band Instruments, Fans, Chairs and the like. UTILIZATION - refers to the act of availing, enjoying, occupying or making use of the facilities, services and any/or the entire sports complex itself. SPORTS COMPLEX - refers to the City Gym with its facilities, the Oval which includes the football field and track and field areas located at the former Pagadian City Pilot School Compound. PERMIT - refers to a written warrant or license duly issued by the Permit and License Division, Mayor's Office duly assessed by the City Engineer's Office for the utilization of the City Sports Complex or a portion thereof. RENTAL FEE - refers to a fixed charges paid by the lessee(s) for the availment/utilization/enjoyment of the facilities and/or employment of services of the City Sports Complex or part thereof. BLEACHERS - refers to the surrounding area intended for the people to sit while watching a track and field game or a football game at the oval. SECTION 3. - Requisites for the Utilization of the City Gymnasium and its Facilities. No person, organization, entity or agency shall be allowed to make use of the services or utilize the City Gymnasium without complying the following requirements, to wit: All bookings should be made one (1) month prior to the date of the activity at the City Engineer's Office for assessment on electricity consumption, especially those functions that need a much higher voltage consumption, i.e., CONCERT, DISCO, RALLY, etc. Letter-request addressed to the Office of the City Mayor for purposes of booking and scheduling. Said letter request must be submitted two (2) weeks before the schedule of activities to avoid duplication/conflict of schedules. Acknowledgement from the office of the City Police (PNP). Payment of permit and rental fees to the City Treasury prescribed by this ordinance, the corresponding receipts of which shall be presented to the Permit and Licensing Division prior to the issuance of the permit. Issuance of permit from the Permit and Licensing Division. Approval from the Office of the City Mayor. SECTION 4. - Requisites for the Utilization of the Oval. No person, organization, entity or agency shall be allowed to make use of the services or utilize the City Oval without first complying the following requirements, to wit; Letter-request addressed to the Sangguniang Panlungsod through the Office of the City Vice Mayor. This letter-request must be submitted two (2) weeks before the schedule of activities to avoid duplication/conflict of schedules. Said letter-request shall be included in the calendar of business of the Sangguniang Panlungsod for its collegial action which will include scheduling and/or booking after due consultation with the City Police (PNP). Payment of permit and rental fees to the City Treasury as prescribed by this ordinance, the corresponding receipts of which shall be presented to the Permit and Licensing Division prior to the issuance of the permit. Issuance of Permit from the Permit and Licensing Division. Approval of the request by the Sangguniang Panlungsod through an SP Resolution. SECTION 5. - Supervision and Control. 5.A Gymnasium: 5.A.1 The City Mayor shall have the full control and supervision in the management of the City Gymnasium. 5.A.2 The City Mayor shall have the authority to assign or designate caretakers or maintenance personnel for the City Gymnasium. 5.A.3 The City Mayor shall have the authority to assign security guards or peace officers for purposes of maintaining peace and order in/or around the premises especially at times of its utilization. 5.A.4 The City Mayor shall have the authority to revoke the permit or license granted to the lessee(s) when satisfactory evidence could show violation(s) of the policies and guidelines have been committed. 5.B. City Oval: 5.B.1 The Sangguniang Panlungsod through the Office of the City Vice Mayor shall have the full control and supervision in the management of the City Oval. 5.B.2 The Sangguniang Panlungsod through the Office of the City Vice Mayor shall assign or designate caretakers or maintenance personnel for the City Oval. 5.B.3 The Sangguniang Panlungsod through the Office of the City Vice Mayor shall have the authority to revoke the permit or license pertaining to the usage of the City Oval when satisfactory evidence(s) is established that violation of the policies and guidelines had been committed. SECTION 6. - General Policies and Guidelines in the Proper Utilization of the City Gymnasium, its Facilities and City Oval. The lessee shall ensure orderliness and cleanliness of the City Gymnasium, its facilities and/or oval before leaving the premises. All users of the City Sports Complex or any part or parts thereof shall, at all times therefore ensure that proper wastes disposal and management are observed and adhered to strictly during and after their respective activities. Any loss, damage(s) to the city gym including its facilities and/or city oval at the time of the lessee(s) occupancy/use and/or utilization due to negligence, the obligation of replacing and/or restoring the lost and/or damaged property/facilities or equipments must be shouldered by the lessee(s). No equipment(s) assigned at the City Gym and the Sports Complex like chairs, sound system and band instruments shall be released from the custody of the property custodian for private or personal use. Overtime usage of the City Gymnasium and its facilities not stipulated in the permit or contract shall mean additional charges to the lessee, which will be computed on a per hour basis. In no instance shall the City Oval or any portion thereof be used and/or availed at for test/practice driving for all types of motor vehicles. No vehicles of all types are allowed to pass and/or park in the vicinity of the football field. The Office of the City Vice-Mayor through the Sangguniang Panlungsod reserves all the rights to revoke permit/s granted to the lessee if valid reasons and violations are found thereof on the usage of the City Oval. SECTION 7. - Schedule of Fees and Charges for the Utilization of the City Gymnasium, its Facilities and City Oval. City Gymnasium and its Facilities: Permit Fee 100.00 Venue (Per Day/Per Night) 2,000.00 Lights (Night Time Only/hour) 400.00 Payment for current with Sound System (Per Day/Per Night) 700.00 Band Instruments 2,000.00 Chairs (per chair) 3.00 Additional Fee for the next succeeding days/per chair 1.00 Additional Fees: Use of Commercial Sound System that will consume: 150 KVA up (per day) 1,200.00 2015-50 KVA (per day) 400.00 For income generating functions: plus 100% of venue rental and plus 100% of lights/night. All government functions will be charged 50% only on venue rentals. Basketball Court Rental, including Basketball Goal (with lights): P300.00/ hour P150.00/hour (for City Government Employees) CITY OVAL: Permit Fee 100.00 Venue Rental (per day) 500.00 SECTION 8. - Maintenance of Trust Fund. The City Government shall maintain a trust fund of the revenue derived from the rental and other fees in the utilization of the City Gymnasium, its facilities and/or City Oval subject to the usual accounting and auditing rules and regulations. This fund shall be exclusively used for the expenses in the operation and maintenance/improvements of the City Sports Complex and its facilities/equipment(s). SECTION 9. - Penalty Clause. Persons, groups and entities that will avail of, by way of lease any portion thereof, including the facilities thereon found not complying with and/or violating the provision of the ORDINANCE shall be barred from availing and using the Sports Complex and its facilities thereof in the future. SECTION 10. - Separability Clause. Any section or provisions of this ordinance which maybe declared unconstitutional shall not affect the other section(s) or provision(s) hereof. SECTION 11. - Effectivity. This ordinance shall take effect upon its approval. ENACTED AND APPROVED by the Sangguniang Panlungsod (8th City Council) of Pagadian City during its 107th Regular Session held on November 14, 2006 at the Sangguniang Panlungsod Session Hall.
